Works) 990 Pilm St. San Luis Obispo, CA 93401-3218 EMAIL WWA' TER&TC3m fV ET RE: "New Deck and Foundation Repair Permit: BLDG 1143-20I8, 679 Monterey St_, San Luis Obispo, CA 93401 Dear Mr. Johnson and Ms Stanwyck: I any the owner of the Historic "Bello House" located at the above address. l am currently at an impasse with the Public Works Department regarding the removal Of the City's Street Light which is the only light on my side of the block between Niponlo and Broad St. I am preparing the Mission style sidewalks, curbs and gutters required as a condition of a foundation repair permit for the Bello House:_ I have abandoned the deck and will simply replace two historic exterior stair ways. The cast of the public improvements for this foundation repair project are very significant. We are very close to pouring the 80 linear feet of Mission style downtown sidewalks, curbs and gutters. We do not have the capacity, authority, duty, ownership interest or budget to remove a large street light which I do not own, for which the City pays a separate electric bill, has authorized PG&E to disconnect. etc. l have to responsibility to assume the significant liabilities attendant with removal and disposal. On March 12, 2020, l scut correspondence to the E]gineering Development Review Division asking to coordinate the work and reflecting my understanding that I would install "a new street light box. base and bolts" ready for tlle City to remove the existing light standard, etc_ I heard nothing and have proceeded to enter contracts and commence construction. On April 30, l was informed that it is "ti-li to" Mly contractor to remove and transport the existing light pole as well as the current farmers Market banner. '-and the pole will need to be transported to the City of San Luis Qhispo's Corporation Yard (925 Prado Rd) for off-loading." The photo shows the large, historic light fixture which benefits many other private properties and the City's adjacent Lot ] 0, and the state of construction progress. The light fixture will prevent the installation of required Mission style tiles and replacement with the coored concrete and details required by the City. This is a purely public works responsibility acid not capable of delegating to a private owner wiil'out legal ownership of the fixture or any legal responsibility. Please have the City staff remove the light post immediately so we can proceed with the side- walk and other improvements. If that does not happen, then l will be forced to leave it in place and would be prevented from placing a new decorative light fixture (which I need to order immediately) and will not be able to have contractors return to the site to engage in any removal or installation of a new fixture, box, bolts, etc. City Manager/ As5i5tant City Manager (Pub. CODE SEC. 66020 Importance: High Hello Matt, I have just reviewed the encroachment fee in the amount of $2,036.22, including an IT Surcharage of $60.27, to have the privilege of spending somewhere between $40,000 and $50,000 to replace the public sidewalks with a very expensive "Mission style" sidewalks (with tiles, colored concrete, etc. etc.), and replace the only street light on the block at an additional expense of approximately $12,000, which benefits an adjacent City parking lot, the City streets and sidewalks. While an encroachment permit may be required, it should be without any fee or IT surcharge, since it is for the purpose of providing public improvements which are of direct benefit to the City and will be owned entirely by the City after construction. I do appreciate your consistent professionalism and courtesy. However, I am filing a Notice as required by law with the City Council of paying the fees and providing the decorative street light, reserving my rights to the return of the fees and exactions, on statutory and constitutional nexus bases. The statute allows me pay under protest, prohibits withholding the permit, and allows me torecover the costs from the City within 180 days of the date of the Protest. Given the current crisis, I will be serving the notice by mail, and as an attachment to an email to you for filing with the City Clerk and appropriate distribution. The ARC recommended final approval of the project design to the City Council, based on the following findings, and subject to the following conditions: Findings 1. As designed and conditioned, the building materials, style, character, and form of the new structures within the project will promote the architectural character, style, form, and materials of the existing Downtown and Chinatown Historical Districts and complement the architectural character of the surrounding buildings and area consistent with the City's Historic Preservation Program Guidelines. 2. The project is consistent with standards contained in the Citys Community Design Guidelines for the downtown, which encourage projects to be pedestrian -oriented, and to have proportions and design details that - complement surrounding structures. 3. The project's design is consistent with the design principles contained in Section 4.16 of the Land Use Element including providing pedestrian -oriented spaces on the ground floor of buildings, continuous storefronts, and upper -floor dwellings and offices_ 4. The project is consistent with the mitigation measures adopted by the City Council on December 18, 2007, with the certification of the Chinatown Project EiR & Update and the recently -completed Addendum. All underlying lots small be merged or lot lines shall otherwise be adjusted prior to - building permit issuance if required by the Building Division and/or Planning Division. Encroachments into or construction staging within the public night -of -way will require notification of the affected businesses prior to the commencement of each phase of construction and demolition to the satisfaction of the Public Works Director. 22. The historic granite curbing located along the Palm Street frontage shall be salvaged and incorporated into the final public improvements to the satisfaction of ,the Public Works Director. 23. The existing curb ramp located at the southeast comer of Palm and Chorro serves the pedestrian load from this development and shall be upgraded per ADA and City Engineering Standards. Any street paving, utility relocations, or upgrades related to this installation shall be completed by the developer. 24. The project shall comply with the Engineering Standards in effect at the time of building permit submittal. The City expects that new standards relating to street furniture may be in effect at the time of building permit application_ These aesthetic standards include but are not limited to public benches, matching trashlrecydle receptacles, newsracks, tree grates, and pedestrian -level fighting fixtures. 25_ The project shall include pedestrian -level lighting. fixtures and the required appurtenances and infrastructure per City Engineering Standard #7915 -and the approved downtown lighting plans. 'Existing cobra head fixtures shall be removed unless otherwise deemed necessary for pedestrian and/or vehicle safety by the Public Works Director. 26. A properly -sued underground grease interceptor shall be provided for any commercial kitchen in the project. This interceptor must be placed to allow convenient access by service vehicles, including grease interceptor pumping trucks. 27. Facilities shall be provided to allow restaurant equipment. washing, including but not limited to: floor mats, trash cans, etc. Washing facility shall be covered and connected to sanitary sewer and not be allowed to be discharged to the storm drain or surrounding environment. 28. Manifolds for multiple water meters shall be used to the maximum extent to reduce the number of water services in the street right-of-way (example: the two water the located in front of building D). Depending on the meter sizes required at each location, six meters utilizing one-2° service may not be passible. The project address should be established prior to building permit application if possible. Otherwise, the address will be established during permit review and prior to permit issuance. 15. A separate demolition plan and permits are required for the structures located on the project site. The plan shall include an inventory of all improvements located on the City parcel and within the public right-of-way. Any historic materials shall be noted and shall include a matrix of the proposed disposition. Unless otherwise proposed or required to be re -used within the project, the historic granite curbing, walls, and stairs located on the project site shall be preserved and delivered to an approved location to the satisfaction of the City. 16. The demolition plans shall show the location of all existing utilities. Existing utilities shall be approved for re -use or shall be abandoned per City Engineering Standards. The applicant should confirm whether any utilities remain from the previous demolition of the structure(s) located on the project site. City improvement plan records and/or sewer mainline televising records are available upon request. 17. A lot line adjustment or merger shall be processed by a separate Planning application through the Planning Division to remove the underlying property lines. Unless otherwise specifically approved for deferral by the City, all underlying parcels shall be merged prior to building permit issuance. 18. Projects involving the construction of new structures generally requires that complete frontage improvements be installed or that existing improvements be upgraded per city standard. MC 12.16.050 19. New curb, gutter, sidewalk, curb ramps, bulb -outs, street parking, signage, striping, parking meters, street tree plantings, street lighting, demolitions, etc. shall be completed as a condition of the project. Except where standard streetlights are required, the frontage improvements shall include new pedestrian level streetlights per the approved master plan and City Engineering Standards. 20. The project is located within the Mission Style Sidewalk District of downtown. Unless otherwise directed and approved by the Public Work or Community Development Directors, all new or replaced improvements shall be constructed in the Mission Style per City Engineering Standards. 21. All proposed street furniture shall conform to City Engineering Standards and Community Design Guidelines. Final furniture placement and aesthetics shall consider need, phasing, pedestrian circulation, line -of -sight, and future maintenance. The proposed furniture and layout shall be approved to the satisfaction of the Public Works and Community Development Directors. 22. City Engineering standards include a preference for parkways over integral sidewalks where adequate sidewalk width is available and street parking has been removed. REPORT -IN -BRIEF The proposed Monterey Place project is a mixed -use redevelopment with lower level commercial space, a pedestrian paseo, restaurant pad, and rehabilitation and adaptive reuse of the historic Leitcher building into a bed and breakfast. Four separate buildings are proposed to be constructed, each with lower level commercial space and residential units above on floors 2-4. There are a total of 23 residential units proposed and approximately 24,000 square feet of commercial space. When the property was rezoned to Downtown -Commercial (C-D-H) Zoning in 2008, Council adopted conditions that required use permit approval by the Planning Commission and final project approval by the City Council for any proposed new development on the project site. The project has been reviewed and recommended for final approval by the Cultural Heritage Committee and Architectural Review Commission. The Planning Commission has approved a use permit for the project and adopted a Mitigated Negative Declaration of Environmental Impact. The proposal is PH 1 - 1 Resolution No. (2014 Series) Attachment 1 Page 6 Public Works 18. The building plan submittal shall include a final drainage report for this project_ The floodzone section of the report and final plans shall show compliance with the Floodplain Management Regulations. The plans shall be revised to show compliance with the NAVD88 map and creek profiles within the Flood Insurance Study with the effective date of November 16, 2012. In some cases the FEMA conversion from the NGVD29 datum and NAVD88 datum is more conservative than the conversion previously established by the City of San Luis Obispo. 19. All public improvements shall be designed and constructed in accordance with the City Engineering Standards in effect at the time of submittal of the working drawings. 20. Pedestrian level street lights shall be installed. per City Engineering Standards and the approved conceptual Downtown Lighting Plan. The final details of how the historic granite curb will be incorporated into the new curb, gutter, and sidewalk shall be reviewed and approved to the satisfaction of Public Works Director, 21. A pre -construction meeting and/or pre -demolition meeting shall be coordinated by the contractor or developer and shall include the appropriate representation from the Community Development Department and Public Works Department. The meeting shall include but is not limited to the scope of work, construction staging, pedestrian protection, tree protection, inventory of the historic granite curb to be salvaged, existing building protections, public art protection/relocation, and erosion control/site drainage provisions. 22. The building plan submittal shall include a complete site utility plan. Individual service connections shall be perpendicular to the street. On -site services shall. not be located within and parallel to the sidewalk unless specifically approved by the Public Works Director. 23. A separate public improvement plan and/or excerpt from the civil plans included with the building plan submittal will be required to document the proposed and constructed improvements within the public right-of-way. A separate public improvement plan review will be required in conjunction with the review of the public improvements. The improvement plans shall include the Monterey Street improvements but will also need to include the improvements related to the connection and alterations at the city owned Creek Walk parcel. 24_ Any conditions of approval related to the Use Permit and/or Mitigation Measures related to the Initial Study shall be incorporated into the building plan submittal and public improvement plans.
