Dear Property Owner,
On July 3, 2019 and August 6, 2019 City of San Luis Obispo Community Development Department staff issued
Stop Work Notices for the following violations of the San Luis Obispo Municipal Code or other relevant codes at
the above listed address:
1. Grading has occurred for the construction of a retaining wall within the creek setback and riparian area.
• San Luis Obispo Municipal Code § 15.04.020 OO:
Amendments – California Building Code
Amend Appendix Section J103to read as follows:
Permits required. Except as exempted in Section J103.2, no grading shall be performed without first
having obtained a permit therefore from the building official. A grading permit does not include the
construction of retaining walls or other structures. A grading permit shall be required for all work
within any waterway, including, but not limited to, earthwork, construction of drainage devices or
erosion control devices, removal of vegetation and modifications of banks and the bottom of the
waterway which may in the natural course of events lead to changes in flow characteristics. A
grading permit shall be required for all work that will create a stockpile of any earth material,
subject to the surety bond required by Section J103.4 to guarantee restoration of the site to a natural
or other condition acceptable to the building official.
• San Luis Obispo Municipal Code § 12.23.030:
Creeks, tributaries and riparian corridor regulations - Prohibited activities and conditions. It shall
be unlawful and a violation of this chapter for any person to engage in or maintain, or for any
property owner to allow or maintain, any of the following activities or conditions in regulated areas:
A. Collecting, gathering, or disturbance of any natural or cultural resources, except for pruning,
removal of materials or any other activities authorized under appropriate permits from state
and/or federal agencies or in conjunction with permitted city-sponsored activities.

• San Luis Obispo Municipal Code § 17.70.030:
E. Creek Setback Dimensions. Different setback dimensions are established in recognition of
different lot sizes and locations of existing structures for areas within the city in comparison with
areas that may be annexed, and in response to different sizes of the creek channels and tributary
drainage areas.
1. Creeks within the 1996 City Limits. Along all creeks within the city limits as of July 1,
1996, the setback shall be twenty feet, except as provided in subsections (E)(3), (E)(3),
and G of this section. Where the city limit follows a creek, the setback on the side within
the 1996 city limits shall be twenty feet, and the setback on the annexed side shall be as
provided in subsection (E)(2) of this section.
Corrective Action: The above unpermitted alterations will require the submission of plans to obtain a
grading permit. Plans may be required to be prepared by a qualified design and/or engineering
professional. Please visit city Planning and Building Departments at 919 Palm Street to determine if each
structure and/or alteration in its current location can be permitted to meet current zoning regulations and
building codes.
The city received a submission for a grading permit on August 21, 2019. The plans have undergone two reviews,
with the most recent review completed on January 7, 2020. According to our records, it has been over 30 days
since the last plan review was completed. We have yet to receive a resubmission of plans addressing the most
recent plan check comments.
We request that you voluntarily take action to resubmit plans to address the above noted violation(s) no later than
February 26, 2020. These violations constitute a public nuisance and must be abated. Failure to correct the
violation(s) by the specified date will result in the issuance of an Administrative Citation requiring payment of
FINES in accordance with SLOMC Chapter 1.24. For Municipal Code violations that remain uncorrected after
issuance of an Administrative Citation, the City may seek enforcement by other civil or criminal remedies.
Any person having a title interest in the property may request a Director’s review of this Notice by completing the
enclosed Request for Director’s Review Form and submitting it to the Community Development Department via
email at code@slocity.org or to 919 Palm Street, San Luis Obispo, CA 93406, within five (5) days of the date of
this Notice. This Notice shall be deemed final unless you timely file a Request for Director’s Review.
