ROLL CALL Present: Commissioners Michael Hopkins, Steve Kahn, Nicholas Quincey (6:18), Michelle Shoresman, Mike Wulkan, Vice-Chair Robert Jorgensen, and Chair Hemalata Dandekar Absent: None Staff: Community Development Director Michael Codron, Senior Planner Brian Leveille, Assistant City Attorney Roy Hanley, and Deputy City Clerk Kevin Christian PUBLIC COMMENTS ON ITEMS NOT ON THE AGENDA None 1.CONSENT AGENDA – CONSIDERATION OF MINUTES ACTION: MOTION BY COMMISSIONER WULKAN, SECOND BY COMMISSIONER SHORESMAN, CARRIED 6-0-1 to approve the Planning Commission Minutes of June 10, 2020. Item 1 Planning Commission Meeting Minutes June 24, 2020 Page 2 of 3 Chair Dandekar called a recess at 6:10 to allow technical issues to be resolved. The meeting was called back to order at 6:18 with all Commissioners present, including Commissioner Quincey. PUBLIC HEARINGS 2. Review of an appeal of the Community Development Director’s decision to approval a new three-story, 3,439-square foot single-family residence on a sloped lot. The single-family dwelling includes an attached four-car garage and a 967-square foot accessory dwelling unit. Project includes requested exceptions from the Hillside Development Standards of the Zoning Regulations to allow portions of downhill building walls to exceed 15 feet in height and to allow retaining walls up to 12 feet in height (ARCH-0816-2019). This project is categorically exempt from environmental review (CEQA); Project Address: 1141 Ella Street; Case #: APPL-0233-2020; Zone: R-2; Steven Goschke, appellant. Assistant Planner Kyle Van Leeuwen presented the staff report and responded to Commission inquiries. Appellant, Steven Goschke, reviewed the points made in his appeal, stressing issues related to the lot’s calculated slope, applicable building code, exceptions, and project size and scale. Applicant Representative, Thomas Esser, provided an overview of the project, the project challenges, and the sensitivity given to the neighborhood in the design solutions. Chair Dandekar opened the public hearing. Public Comments Didier and Beatrice Cop, read by Deputy Clerk Christian Chair Dandekar closed the public hearing ACTION: MOTION BY COMMISSIONER KAHN, SECOND BY COMMISSIONER WULKAN, CARRIED 7-0-0 to adopt a resolution entitled: “A RESOLUTION OF THE SAN LUIS OBISPO PLANNING COMMISSION OF SAN LUIS OBISPO, CALIFORNIA, DENYING AN APPEAL (FILED BY STEVEN GOSCHKE) THEREBY APPROVING A NEW THREE-STORY, 3,439-SQUARE FOOT SINGLE-FAMILY RESIDENCE, 967-SQUARE FOOT ACCESSORY DWELLING UNIT, AND A 1,031-SQUARE FOOT, FOUR-CAR GARAGE ON A SLOPED LOT, WHICH INCLUDES REQUESTED EXCEPTIONS FROM THE HILLSIDE DEVELOPMENT STANDARDS OF THE ZONING REGULATIONS TO ALLOW PORTIONS OF DOWNHILL BUILDING WALLS TO EXCEED 15 FEET IN HEIGHT AND TO ALLOW RETAINING WALLS UP TO 12 FEET IN HEIGHT, WITH A CATEGORICAL EXEMPTION FROM ENVIRONMENTAL REVIEW, AS REPRESENTED IN THE STAFF REPORT AND ATTACHMENTS DATED JUNE 24, 2020 (1141 ELLA STREET, APPL-0233-2020)” Item 1 Planning Commission Meeting Minutes June 24, 2020 Page 3 of 3 3. Review of the acquisition of a portion of right-of-way adjacent to Los Osos Valley Road from the California Department of Transportation (Caltrans) to the City of San Luis Obispo. Property is for the use of City right-of-way and to be relinquished by Caltrans and exempt from environmental review; Project Location: Western edge of Los Osos Valley Road at Calle Joaquin intersection; Case #: GENP-0251-2020; Zone: Not Zoned (Currently Caltrans right-of-way); City of San Luis Obispo, applicant. Engineer Shelsie Kloepper presented the staff report and responded to Commission inquiries. Chair Dandekar opened the public hearing. Public Comments None Chair Dandekar closed the public hearing ACTION: MOTION BY COMMISSIONER WULKAN, SECOND BY COMMISSIONER HOPKINS, CARRIED 7-0-0 to adopt a resolution entitled: “A RESOLUTION OF THE PLANNING COMMISSION OF THE CITY OF SAN LUIS OBISPO, CALIFORNIA, DETERMINING GENERAL PLAN CONFORMANCE FOR THE ACQUISITION OF PROPERTY ADJACENT TO LOS OSOS VALLEY ROAD FROM THE CALIFORNIA DEPARTMENT OF TRANSPORTATION (CALTRANS) TO THE CITY OF SAN LUIS OBISPO (CITY) WITH AN EXEMPTION FROM ENVIRONMENTAL REVIEW, AS REPRESENTED IN THE STAFF REPORT AND ATTACHMENTS DATED JUNE 24, 2020 (GENP-0251-2020)” COMMENT AND DISCUSSION 4. Agenda Forecast – Senior Planner Brian Leveille provided an update of upcoming projects.
