Pete,
I had the opportunity to present your settlement offer to the City Council on Tuesday. After
discussion, the City remains confident that its officers acted properly and in good faith
reliance on CJIS information available to them at the time. Moreover, the City supports its
officers’ lawful actions to protect and assist in the removal of your clients’ minor children
from the drug exposed, dangerous and squalid conditions in which they were living,
notwithstanding Mr. Orndoff’s public misrepresentations as to officers’ actions and repeated
statements that your clients’ children were removed due to a “dirty house.” As I have
conveyed before, there is not such thing as a “discrete” settlement with a public agency; all
settlement agreements with public agencies are public records. Moreover, the settlement
you propose on behalf of your clients’ children would be subject to the approval of a minor’s
compromise by the court. Finally, the City is not interested in entering into an agreement
that would preclude it from disclosing the complete facts of this case in response to any
liability claims or past or future public misrepresentations that may be made against the City
or its employees. Accordingly, the City Council unanimously directed me to reject your
settlement offer.
We are treating this offer as a formal claim against the City for damages and I am including
our claims administrator and outside defense counsel, Josh George, on this response and
for further processing.

Hi Christine,
I’ve attached a copy of a pre-claim settlement offer. I am cautiously optimistic that I will reach a
negotiated disposition with the DA to settle the criminal case for different charges. So I think there is
a contingency where I do not file additional briefs in the criminal case, no live hearings are held, and
a very modest financial settlement is reached with the City. I see this as a win/win/win. The
taxpayers save money because there is no multi-day hearing and multi-day trial and our respective
clients have their privacy prioritized. Any chance you might be willing to discuss this on a call next
week?

Hi Christine,
The DA has a deadline of September 4th to file a response brief to our Williams motion to
suppress. I expect to file our response to that response on September 8th if the matter still
needs to be litigated. I still think there is a chance to reach a negotiated disposition with both
the DA and the City before then, but I wanted to let you know the timeline we are likely
working on. The suppression hearing is currently set September 22nd.
