Dear Mr. Kline:
Thank you for your letter dated October 19, 2020. While I appreciate your response to our
dissatisfaction with the situation regarding the dangerous sidewalk in front of our home, you still have
not resolved this in a way I would have expected considering how long this issue has not been addressed
properly in the first place.
Just because you did not receive a complaint from my neighbors over the years, does not mean that the
damage was not there before I took residence. Both of my neighbors on each side have stated the
sidewalk damage has been there for years before I moved in. They have stated that Public Works has
continuously filled it in with asphalt over the years causing even more of a safety hazard instead of
addressing it in the first place with the prior owners. It was clearly not necessary for the neighbors to
call since your Streets Maintenance Program and City workers were repairing this sidewalk with asphalt
long before we moved in and at least since 2013 as you stated. The City workers should have noted this
and advised your department to send a letter to the owners at that time.
According to you, permit fees will be only $75.97 and while that is minimal, the concrete will not be that
minimal. It will more than likely cost several thousand or more and is not as inexpensive as you think.
Have you priced concrete and labor lately? Furthermore, it is not even about the cost, but more of the
fact that once again the City workers and Public Works dropped the ball. As I recall our phone
conversation on September 21, you stated "this would not have happened on my watch and would have
been addressed with the previous owners."
I applied for the tree removal since one of the Amber trees was infected and I wanted to prevent any
further damage from occurring to the sidewalk and driveway. Again, to remind you, the sidewalk
damage that is currently existing is what has been there for at least one to two decades if not more
according to my neighbors. I did my part to prevent further damage and really expected Public Works to
have done their part to properly inform the prior owners when they first started repairing the damage
to the sidewalk.
I would like to further mention that there are several additional houses in my neighborhood that have
sidewalk damage from trees that have not been addressed thus proving the City workers do not report
but just fill with asphalt.

At this time, I would like to request further discovery regarding this issue. Therefore, please provide
copies of asphalt repair records to the sidewalk over the years as per the Freedom of Information Act. If
necessary, I will continue fighting this issue through a City council complaint and escalate to court with
my lawyer who is aware of the correspondence that has taken place. I have neighbors who can attest
and witness the foregoing as true and correct.
My hope is that we can still resolve this in an equally amicable manner.
