HomeMy WebLinkAboutLLHOA Rules EnforcementLaguna Linda Homeowners Association RULES ENFORCEMENT POLICY The Board of Directors, or association manager if applicable, shall be vested with all legal rights and authority to enforce the rules and regulations. These penalties apply for violations by the Homeowners Association members (owners), guests, tenants and employees of owners / tenants. Action for noncompliance with rules set forth in the CC&R's or the Rules and Regulations are as follows: The Board will give written notice to the owner of the rules violation giving 10 days to correct the violation. 2. Should the owner fail to correct the violation the Board will conduct a hearing of the rules violation giving 10 days notice of the hearing. Non-compliance after notice of the violation and the hearing may result in the following penalties. The Board may use whichever of these penalties that is warranted by the level of the rules violation and need not follow the sequence. Suspension of membership rights including use of the common areas and voting rights. 2. Monetary penalty in the following amounts per day until the violation is corrected: a. $25.00 b. $50.00 c. $100.00 3. Legal action to correct the violation and collect the penalties. A rules violation involving a parking issue or a health and safety issue may result in corrective action by any Board member / manager without following the above procedures providing verbal and or written notification is given. This may involve towing of vehicles or notification of the violation to the proper authority. See original colors on file vidth the Architectural Committee_ ROOFING Tile must match existing tile as closely as possible. No other type of roofing material may be used. If matching the is no longer available, tile from an area of the roof not visible from the common area must be used and a closely matching tile used to replace the tile that was moved. SOLAR P A-N-EL S If removed, solar panels must be replaced with another solar panel or with tile that matches the existing roof tile. See Roofing. SKYLIGHTS Skylights must match existing skylights. No white or reflective glazing is permitted. Natural aluminum is not permitted. GARAGE DOORS Replacement garage doors must match existing doors in color and style. See manufact rer.'style on file with Architectural Committee. FRONT DOORS Replacement or refinished front doors and side panels must closely march the existing doors_ Screen doors are not allowed on the exterior of the front doors. SIDE DOORS Side doors must be solid doors. The color must match the trim or the garage door_ WINDOWS & WINDOW SCREENS Replacements must match existing windows and screens. Exterior shutters are not allowed. LIGHTING Front porch and exterior garage fixtures must match or be similar to other fzxtures in the complex. Security lights are not allowed in front of homes and those within residential lots must be pointed down to avoid shining at neighboring properties which may be construed as a nuisance. SATELLITE DISHES The dish must be 18 inches or less in diameter and must be installed in a location that is least obtrusive to the surrounding neighborhood as long as the quality of reception is not impaired and there is not an unreasonable increase in the cost of installation. Wiring or cabling must be installed so as to be minimally visible and blend into the background to which it is mounted. FLAGS Flagpoles may not be installed on the common areas in front of residences. One United States flag, in good condition, may be flown from a flag holder at the corner of the garage during daylight hours. OTHER Additions to the exterior of the residences or interior windows facing the common area (wall hangings, clocks, stained glass, etc.) must blend with the exterior of the residence and must be approved by the Architectural Committee. Additions and alterations to residential backyards, including but not limited to spas, patio extensions, patio covers, etc. must be approved by the Architectural Committee to ensure that the additions/alterations do not impede or affect neighboring residential lots or the common areas (i.e. drainage, view obstruction, etc.).
