HomeMy WebLinkAbout1/27/2021 Item 3, Finger Wilbanks, Megan From:Helene Finger < To:Advisory Bodies Subject:Planning Commission Item #3 Bullock Lane Project Dear Planning Commissioners, I wanted to share a suggestion for tomorrow’s Planning Commission meeting agenda item #3, Bullock Lane project. I just finished reviewing the staff report and see that the project's Mitigated Negative Declaration (MND) is using the Class 1 Railroad Safety Trail as mitigation for several impacts while the Vesting Tentative Tract Map (VTTM) is written such that this multiuse trail will likely not be constructed prior to occupancy. Additionally, the current resolution wording creates an incentive for the developer to put the path on UPRR property so that they can shift the liability of building the trail to the City. Fortunately, there is a simple solution, just remove the red crossed-out sections from Item 80 of the resolution (see below). The developer should expect to include appropriate time for right-of-way negotiations (UPRR or others) in their project schedule. There is no reason for the City and our residents to take on liability for any delays in the developer's project schedule. The people who walk and ride this relatively low traffic volume street will have their safety compromised if the developer is issued occupancy permits (and 1,626 new motor vehicle trips/day) prior to connection of the multiuse trail. The only way to avoid this and ensure that the trail is built is to simply state, “The Project Applicant shall be responsible for funding and constructing the public improvements prior to issuance of any occupancy permits”. Building this small section of the Railroad Safety trail on Bullock Lane will close the only gap in a Class 1 trail from Tank Farm Rd to the train station and to downtown via the Morro Bike Boulevard.
