HomeMy WebLinkAboutItem 5 - Construction Board of Appeals Advisory Appointments Department Name: Administration Cost Center: 1021 For Agenda of: February 16, 2021 Placement: Consent Estimated Time: N/A FROM: Greg Hermann, Deputy City Manager Prepared By: Teresa Purrington, City Clerk Kevin Christian, Deputy City Clerk SUBJECT: CONSTRUCTION BOARD OF APPEALS ADVISORY APPOINTMENTS RECOMMENDATION Confirm appointments to the Construction Board of Appeals (CBoA) as recommended by the Council Liaison Subcommittee. DISCUSSION The City recruits annually to fill scheduled Advisory Body vacancies, making new appointments each March to fill terms that typically commence on April 1st of each year. Recruitment for unscheduled vacancies is done as needed but is consolidated with the annual recruitment when possible. The current annual recruitment interviews for vacancies are ongoing at this time. On February 3, 2021, CBoA recruitment interviews were held. Due to long term vacancies on the CBoA and an immediate need for an upcoming CBoA meeting, the Council Liaison Subcommittee is recommending the following immediate appointments to the CBoA: • Robert Vessely to a 4-year term commencing April 1, 2021 and expiring March 31, 2025. • Gresham Eckrich to a 4-year term commencing April 1, 2021 and expiring March 31, 2025. • Nicholas Graves to a vacancy with a term expiring March 31, 2021, and to the subsequent 4-year term commencing April 1, 2021 and expiring March 31, 2025. • Christopher Wiedeman to a vacancy with a term expiring March 31, 2022. The remainder of the annual recruitment Advisory Body appointment recommendations will be presented to City Council on March 16, 2021. Note that at this time recruitment remains open on the following Advisory Bodies: • Investment Oversight Committee – 1 position • Jack House Committee - 1 position (seat prerequisite – current or retired Cal Poly School of Agriculture faculty) Item 5 Packet Page 35 Policy Context The Advisory Body Handbook, last adopted by City Council in February 2018, outlines the recruitment procedures, membership requirements, and term limits. Also contained in the Advisory Body Handbook are the bylaws for all advisory bodies, some of which include additional membership requirements. Additionally, the City Council Policies and Procedures Manual, last adopted in August 2019, describes the “Appointment Procedure” and “Process” for Advisory Body appointments. Recruitment and appointment recommendations were performed in conformance with all recruitment procedures, processes, and bylaws found in these resources. California Government Code Section 54972, Local Appointments List (Maddy Act) requires that on or before December 31st of each year, each legislative body shall prepare an appointments list for their boards, commissions, and committees whose members serve at the pleasure of the legislative body. This obligation was met and is on-going. Public Engagement In addition to the Maddy Act posting on the City’s website and City Hall kiosk, notices that the City was accepting applications for the CBoA were placed in The New Times, on the City’s website and “e-notification” service and distributed via City social media outlets. CONCURRENCE The Council Liaison Subcommittee concurs with the recommendations. ENVIRONMENTAL REVIEW The California Environmental Quality Act does not apply to the recommended actions in this report, because the action does not constitute a “Project” under CEQA Guidelines sec. 15378. Item 5 Packet Page 36 ALTERNATIVES Council could recommend changes to the recommended appointments or direct staff to re- open recruitment for additional candidates. This is not recommended as there were sufficient qualified candidates for the positions, and the Council Liaison Subcommittee feel they have been quite thorough in their consideration of applicants and the Council’s needs in their selection process.
