The decision that the project will not be detrimental to the health, safety, welfare or property values of adjacent properties leaves me with additional questions. The privacy and safety of the properties to the west (Broad Street) are severely impacted by this project. Before this project receives approval please consider the concern items listed below. 1. Property lines are in dispute as presented in this application. No survey has been conducted that actually proves that 1321 Garden Street actually has the amount of land stated for a project of this scope. All four corners need to be established with a current survey. This survey should be required before this project moves forward. The results could change all plans as currently proposed. 2. “Existing trees” will mitigate both the overlook impact and provide screening to adjacent properties. a. The trees mentioned are Chinese Trees from Heaven. These are DECIDUOUS trees, leaving the properties to the west (Broad Street) exposed to this overlarge build as well as no privacy for six months a year. The trees are providing no reduction in the mass of the proposed structures. Open walking deck and extensive windows results in not a reduction of privacy; it is an elimination of it. b. The trees you are planning to use as the only barrier for privacy are an invasive non approved species that do not like their roots disturbed. So any grading, scraping or digging will disrupt their root structure. This can or will result in considerable damages to adjacent properties from instability. What long term requirement will there be in place to protect properties and to require that this project and any subsequent owners be required to maintain and replace trees to provide said “screening”. Without privacy the adjacent property values are reduced creating an undue hardship and reduction to the quality of life. 2 c. Downhill Drainage from this site will flow and pool at the base of the “screening trees” causing rot. 3. Opaque Windows are only mentioned in this report and in the packet to be required on the east façade of the build. Any and all windows facing Broad Street would need to be non-opening and opaque on all buildings proposed to provide any surety of privacy. As well as any doors that are glass or have glass windows would need to be opaque as well. The walking deck siding materials should be opaque as well. Providing zero visibility of people using it to the people in the homes and yards below. 4. Chimney height on the Accessory One Story unit as shown will allow gas and or smoke to permeate the yards, bedrooms and kitchens of properties on Broad Street. These emissions will flow directly into the adjacent homes affecting the quality of life and decreasing the value of the said properties. Please consider eliminating this feature or moving it to the Garden Street side where it can be stabilized using the other building to raise the height of the chimney this would raise the gas or smoke emissions above the surrounding properties. 5. Drainage from this build site will flow directly onto the rear of the property, this and will result in the screening trees demise as will as potential flooding.This area is a dedicated flood zone. Any groundwater allowed to drain freely and not collected and removed aggressively will result in flooding and damage to both the "screening trees" and the adjacent property.
