Kyle,
A few more points for tonight under De Veto.
1. Our avocado tree close to our fence is a heritage tree and if
any grading, digging, results in damage or the tree falls down
because of this, the developer should be liable for any
damages and replacement costs. A city appointed arborist
should inspect the tree before construction.
2. I am still perturbed by the fact that our houses were
dismissed as offices several times in the original meeting. I
know now that I am not the only neighbour objecting to the
invasion of privacy, grading issues, property line questions,
and negative impact to property values.
3. If the original variances were not given on the height of
existing 3+ story buildings, then this would not be allowed.

We understand that you will probably approve the building but
request the following to mitigate light, noise, and air polution:
a. A solid wall around the upper deck, not railings
b. Opaque windows on all windows that have a view onto our
home
c. Any noise generating appliance be put between the proposed
building and the original units. Not close to our home
d. Grading be assessed and approved to not let water run into our
yard which is in a flood zone.
e. Property lines properly surveyed
