HomeMy WebLinkAbout2/24/2021 Item 3, Corey MEMORANDUM DATE: February 24, 2021 TO: Planning Commission BY: Kyle Van Leeuwen, Associate Planner FROM: Tyler Corey, Principal Planner SUBJECT: Item #3 USE-0803-2019 (1328 Foothill Blvd) – Agenda Correspondence Staff Response Memo DISCUSSION Staff received the following questions from a member of the Planning Commission and determined it would be helpful to provide these questions and responses to all Commissioners and the public, as the responses offer clarification regarding the proposed project. 1. Front Yard Parking Standards. Is the parking configuration a violation with Zoning Regulations Section 17.76.040, Front Yard Parking? Is the gravel area shown as a parking space on the plans accessible and does that area meet the minimum parking space dimensions? Staff Response: The two parking spaces identified to the left of the main driveway have been previously approved (Building permit GRAD-0025-2017). At the time the permit was approved, prior to the major Zoning Regulations update in 2018, this area was not considered “Front Yard”. This is because the “street” that extends to the left off of Foothill Boulevard is private and is not a public right-of-way. Per the definitions in place at the time, only the areas between public streets and residential structures were considered front yard. Therefore, these spaces are allowed front yard parking. The Zoning Regulations have since been modified, and the designation of “front yard” has been expanded to include the area between private rights of way and residential structures. The two parking spaces were created with a previously approved permit, which allowed for the curb to be grinded, the parking space dimensions were confirmed, and City engineering staff approved the proposed surface material used. 2. Code Violations. Is the Use Permit application in connection to a code case? There is currently a Delta Gamma sign on the duplex, and when looking at the aerial photo on Google Maps, the site is marked as Delta Gamma. Item #3 USE-0803-2019 (1328 Foothill) Memorandum: New Sorority Conditional Use Permit Page 2 Staff Response: The sorority is identified in the City’s code case system as in violation for unpermitted sorority. This was first identified by our Community Services Officer in September of 2019 during inspection of neighboring property and not connected to any filed complaints. The property owner and residents were directed to start the process to obtain a Conditional Use Permit for the Sorority use. They submitted for a use permit in December of 2019. 3. Current Tandem Parking: Is tandem parking is currently being utilized on-site? Staff Response: Based on staff observation, vehicles are parked within the driveway in tandem formation, which is allowed provided the vehicles are parked consistent with Zoning Regulations Section 17.76.040. There is a difference between “approved” parking spaces, which are provided to meet specific minimum parking requirements, and “allowed” parking locations, which is generally the driveway leading to the “approved” spaces of a residential site. For the subject property, tandem parking is not currently approved on the site as a means to meet the parking requirements for the current residential use. . In association with this use permit, the applicant is required to demonstrate how minimum parking standards would be met, and the applicant has requested approval of tandem parking to meet minimum parking standards. 4. Proposed Tandem Parking: The staff report notes that tandem parking exists in the surrounding neighborhood. Are there examples of nearby properties with similar tandem arrangements? And have any issues have arisen with the tandem parking configurations? Staff Response: A tandem parking arrangement was approved with the use permit for the fraternity across the street at 1335 Foothill Boulevard. This location has six (6) approved parking spaces, all in tandem (three spaces encumbered by three other spaces). There are no reported issues on record in regard to this tandem parking approval.
