California law that governing manufactured housing is entitled the "Manufactured Housing Act of 1980" (Gov.
Code Section 18000). The California Department of Housing and Community Development (HCD) oversees
alterations of existing manufactured homes required to bear a U.S. Department of Housing and Urban
Development (HUD) label. “Manufactured home,” for the purposes of this part, means a structure that was
constructed on or after June 15, 1976, is transportable in one or more sections, is eight body feet or more in
width, or 40 body feet or more in length, in the traveling mode, or, when erected on site, is 320 or more square
feet, is built on a permanent chassis and designed to be used as a single-family dwelling with or without a
foundation when connected to the required utilities, and includes the plumbing, heating, air conditioning, and
electrical systems contained therein.
The HCD’s regulations can be found in California Code of Regulations, Title 25, Division I. These regulations
establish minimum design and construction standards for all multifamily manufactured homes and
mobilehomes built before June 15, 1976. These regulations are preemptive over any local requirements.
The provisions of this part apply to all parts of the state and supersede any ordinance enacted by any city,
county, or city and county which conflict with the provisions of this part. HCD may promulgate regulations to
interpret and make specific the provisions of this part relating to construction, titling and registration,
occupational licensing, advertising, commercial transactions, and other related or specifically enumerated
activities, and, when adopted, these rules and regulations shall apply in all parts of the state.
In summary, the modifications to the previously existing mobilehome park to replace with manufactured
housing is entirely under the review authority by HCD. In this circumstance HCD is the sole review authority for
replacement development and may supersede any local ordinance. HCD is not required to coordinate or refer
any plans redevelopment with manufactured housing within mobilehome parks. HCD does not have any
requirements that pertain to parking requirements.
The project includes 33 manufactured units that are replacing the 33 previous mobilehomes
