He said that a variance was previously granted to permit a parking space and trellis to be located in the street yard as a part of his plans to expand his house. He said that he has re-evaluatled the plans and would prefer to amend hi-, request for a variance to allow tht- addition to his house without providing ary parking. This would obviously preclude the request for a setback variance. The board concurred with the applicant that this alternative would be more attractive. A motion was made by Dan Snaith, seconded by Sylvia Drucker, and passed unanimously approving Variance Appl. V0823 -A, subject to the following findings: i<indings 1. There are exceptional circumstances applying to the site it that a creek occupies a significant portion of the lot making it impossible to construct a conventionally size:d house with parking, without using portions of the required street yard setback. 2. The variance does not constitute a grant of special privilege in that the request is to enlarge the existing house to a size enjoyed by most of the people in the immediate neighborhood who do not have similar natural constraints on their property. 3. The variance will not adversely affect the health, safety or general welfare of the neighborhood because the house addition is attractive, fits the design of the existing house, limits the total size of the house to a size similar to the existing neighborhood. Use Permit Appl. 5-80. Request to allow reduced street yard setbacks from 20 -feet to 11 -feet and from 20 -feet to 16 -feet, 108 Broad Street, Keith Gurnee, applicant. Mr. and Mrs. Gurnee, applicants, were present and explained the request. They stated that they wanted to increase the area of the house and because of the confining characteristics of the lot with a creek occupying a significant portion of it, they are requesting permission to build in part of the required street yard setback. They also stated that there is insufficient room on the property to conform to the parking requirements of two spaces. They propose to provide one parking space, but it would have to encroach into the required street yard, requiring a variance for the parking space and the trellis cover. Dan Smith stated that he felt the building encroachment of 9 feet into the street yard was acceptable but did not like the parking space and trellis extending to the front property line. The car would appear to be half -way in a garage. If the trellis were tc be made more massive to cover the car, it would also serve to diminish the open feeling of the front yard. He also noted that the house is being improved more than 50% of its value, and thereby is required to meet all zoning regulations including providing two parking spaces. The applicant is asking for a variance to provide one space only. Sylvia Drucker felt that the request was reasonable and that if planting were provided against the trellis, it would soften its presence in the setback. She felt than covered parking would be a convenience for the applicant. All the Board members felt that the design of the addition was complimentary to the existing house and the neighborhood. A motion was made by Sylvia Drucker, seconded by Jerry Kenny and passed unanimously approving use permit appl No. 5-80, to permit expansion of the house to encroach 6 feet and 9 feet into the required street yard setback.
