AGREEMENT
REGARDING MAINTENANCE OF MECHANICAL PARKING LIFTS
The undersigned ("Owner") hereby certifies that it is the owner of the hereinafter legally
described real property located within in the City of San Luis Obispo at:

This agreement isQiade and entered into this /J*day of 20��
by and between AxV 100100C (hereinafter called "Owner") and the
City of San Luis Obispo,a Municipal Corporation, (hereinafter called "City").
WITNESSETH
WHEREAS, Owner is the owner of that certain real property located in the City of
San Luis Obispo, County of San Luis Obispo, State of California, as described in
attachment "A" (the "Property"), and
WHEREAS, Owner has made application with City to modify or to construct a
Mechanical Parking Lift s), described and delineated on plans submitted with Building
Permit application 1'��G+-01Go-zol-7 , as defined in Section 17.72.090.D of the
Municipal Code; and
NOW, THEREFORE, in consideration of the City of San Luis Obispo (the "City")
allowing the approval of a mechanical parking lift to be located in accordance with the
building permit as required parking spaces, on said property, Owner does hereby
covenant and agree to maintain the approved mechanical parking lift(s), layout, location,
indicated parking spaces as conditions of building permit approval. Mechanical parking
lift system(s) and all required operational safety systems shall be maintained and be in
operable conditions at all times, with the exception of periods of maintenance. The
Owner, residents, employees, and any other users of the mechanical parking lift(s)
(hereinafter called "Operators") shall be responsible to have complete training on the
safety operation of such system(s) and ensure that any user of the system(s) is fully
trained. Operation manuals shall be kept in safe accessible place. Owner hereby
agrees that City has the right to enforce this covenant.
This Covenant and agreement shall run with all of the above described land and shall
be binding upon Owner, and future owners, encumbrances, their successors, heirs or
assignees and shall continue in effect until released by the City upon submittal of
request, applicable fees and evidence that this Covenant and agreement is no longer
required by law.
IN WITNESS WHEREOF, the parties hereto have executed this agreement on
the day and year first written above.
