Event Summary SUMMARY: On 6-1-20, at approximately 1200 hours, SLOPD and officers from other County and State allied agenciesbriefedatSLOCityHallregardingan "unpermitted" protest occurring in the City. Detectives learned throughsocialmediaandothersourcesthathiswasgoingtobealargeandpotentiallyviolentprotest. The protest occurred on 6-1-20 and was volatile, confrontational, unorganized, and unlawful. Many of theprotestersmadeanti-police statements and disobeyed lawful orders to stay off Hwy 101. The protest washaltedbyaskirmishlineatSantaRosaandWalnuttodenypedestrian/protest access to Hwy 101 for a secondtime. Protesters ignored up to 4 Safety Dispersal Orders and 4 Unlawful Assembly Orders, in violation of PC409. Seven suspects were arrested, and several others were removed from the area with use of less lethal forceoptions. DETAILS: On 6-1-20, we had four designated mobile field force (MFF) teams, motor officers, and bicycle officers deployedthroughoutthecitytoprotectboththeprotestersandthecommunity. The protest was expected to start atMissionPlazaatapproximately1400hours. MFF Teams 1,2, and 3 were deployed to several intersections andfreewayson/off ramps to direct protesters to the safest route. Between approximately 1330-1600 hours, thegroupofprotestersmarchedintheroadwayonthefollowingstreets: Chorro, Higuera, Monterey, Nipomo, Marsh, Morro, Osos, Monterey, Santa Rosa, Foothill, and Olive. At approximately 1458, the group of protesters were marching SB on Santa Rosa approaching the PD. AskirmishlinewassetuponthewestcurblineofSantaRosaatWalnut. The protesters became focused on theofficerswhohaddonnedtheirriothelmets. At one point a female in the protest called for and 8 minute and 46secondsofsilencefor "George Floyd" and the crowd quieted down, but demanded officers kneel to showrespectforthe "murder" of George Floyd. During their minutes of silence, the protesters were mostly seatedonthegroundandsilent. In an effort to show support of their cause and respect for the subject of their protestofficerskneeledduringthesilence. There was applause initially, but when the crowd stood up and startedwalkingNBSantaRosa. Some of them continued screaming "fuck you!" while flipping us off. It should be noted that a large group of peaceful protesters at this time splitofffromthemorehostileprotestorsandendedtheirmarch. I spoke and shook hands with one of the peacefulprotestleaderswhostatedsheappreciatedouracknowledgementandsupport. At approximately 1513 hours, protesters continued NB on Santa Rosa towards Foothill. At 1536 they sat in theroadattheintersection. Protesters took another 8 minute and 46 seconds of silence for "George Floyd". After, they turned and marched SB on Santa Rosa towards the HWY101 and at 1555 hours, they sat in theintersectionofSantaRosaandOlive. After a few short minutes, the group proceeded EB on Olive towards theHWY101onramp. CHP had patrol vehicles attempt to block the on ramp but were unsuccessful. TheprotesterswalkedrightbyCHPofficersandvehiclesanddidnotobeyverbalcommandstostop. The officersonscenedidnothaveenoughpersonneltostopthelargegroupofprotestersfromcontinuingontoHWY101 ENTERING HWY 101: At approximately 1600 hours, protesters entered HWY101 at the intersection of Lemon and Olive bypassingtheCHPpatrolofficersandvehicles. The protesters march SB on HWY 101 at times taking up both the NB andSBlanes. At 1620 hours, MFF team 3 was dispatched code 3 to partner up with CHP and SLOSO to block thefreewayatHWY101atMarsh. Three additional MFF teams responded which were a mix of officers fromSLOPDandotherlocalalliedagencies. The four MFF teams deployed a skirmish line on HWY101 at MarshalongwithCHPandSLOSOtodirecttheprotestersoffthefreeway. A skirmish line was formed across bothNBandSBlanesattheMarshofframp. At approximately 1641 hours, at my direction a Lieutenant from the California Highway patrol made dispersal announcements over the PA from one of their patrol vehicles. Afterapproximately10minutes, protesters ultimately exited the freeway and headed EB on Marsh. Atapproximately1650hours, all protestors had exited the freeway. MFF team 3 was assigned to trail theprotesters. Between 1650 and 1756 hours, the protesters continued marching in the streets throughout downtown SanLuisObispo. Teams were re-deployed to several locations to monitor the protesters. At 1756 hours, OfficerEthertonwhowasonuniformbicyclepatrol, notified the command post that the protesters were talking abouttakingoverthefreewayagain. Per the command post it was decided that we were going to deny pedestrianaccesstothefreewayand1042WalnutSt. (SLOPD). The plan was to place a skirmish line on the south curblineofWalnutatSantaRosa. Additionally, we had plans to shut down Osos and Walnut to prevent WB trafficonWalnutandNBtrafficonOsos (HWY 101 NB onramp and NB offramp). At approximately 1800 hours MFF teams arrived at Santa Rosa and Walnut and were instructed to deny theprotestersaccesstoNBSantaRosa, EB Walnut and WB Walnut. At approximately 1815 hours, the group of protesters were approaching the intersection of Santa Rosa andWalnut. A group for approximately 30-40 protesters linked arms stood mid-block on Santa Rosa betweenPeachandWalnut. The several hundred other protesters stood behind them. At this time, Officers wereinstructedtoputtheirgasmasksonbecausewebelievedthegroupofprotesterswasgoingtotrytomarchpastourskirmishline. The group walked toward the skirmish line and stopped when they got close. I attempted to talk to the protesters leaders who were told they had to turn around and head SB Santa Rosa (noHwyaccess) to continue their march. The protesters refused and stood their ground while screaming anti-police and threatening to break through out skirmish line. They were aggressive at times and challengedofficerstofightandcontinuallythreatenedtobreechtheskirmishline. At about 1845, Capt. Smith arrived and took over as incident command. He started to dialogue with some oftheapparentprotestleadersinattempttogaincomplianceandconveywewouldnotbelettingtheprotestcontinueNBSantaRosa, EB Walnut and WB Walnut. They were instructed to turn around and continue SBSantaRosa, but they still refused. PROTEST ORGANIZER ANNOUCEMENT: At approximately 1853 hours, an unknown female organizer stood up on a retaining located in front of thebusinesslocatedontheSWcornerofSantaRosaandWalnut. She had a megaphone and announced to thecrowdthattheprotestisoverandrequestedeveryonetoleavepeacefully. She warned the crowd that thepolicewillnotallowthemtocontinueNBonSantaRosa. She told the crowd that if they do not disperse, theywillgetteargassed. When she made this announcement several of the protesters stated, “we are ready”. ANNOUNCEMENTS: At about 1914 hours, Sgt Shalhoob was tasked with announcing a Formal Safety Dispersal OrderforPotentialSafetyIssue (appx 20' from frontline protesters). He made the announcement 3 times over thecourseofabout5-10 minutes on the loudspeaker of patrol unit 2002. The crowd got quite during the secondannouncementandappearedtobelisteningtotheannouncement. This dispersal order appeared to upset theprotesters. They began yelling, “who is the organizer” and appeared frustrated the protest was concluding. SAFETY ORDER ADVISEMENT: The following is the verbatim order that was given: " Attention, this is Sgt. Shalhoob of the San Luis Obispo Police Department. We have received information thatthereisapotentialsafetythreattothisevent. We have spoken to the event organizers and they have asked us to help disperse this assembly immediately until the validity of this threat can be determined. We are askingallofyoutodisperseimmediatelyinanorderlyfashiontoavoidanypossiblethreatstoyoursafety." At about 1940 hours, Sgt. Shalhoob was tasked with making Unlawful Assembly announcements on the sameloudspeakerofmarkedpatrolunit2002. He made three announcements over the loudspeaker (appx 20’ awayfromfrontlineprotesters) over the course of about 10 minutes and in addition advised they could continueexercisingtheir1stamendmentrightwhilewalkingonthesidewalk. After the first announcement, I stood atthelineandconfirmedtheannouncementswerenotloudenoughforthecrowdtoclearlyhear. I instructedSgt. Shalhoob to move his vehicle closer (approximately 5-8’) towards the crowd, which he did. Additionally, IrequestedCHPhavetheirfixwingairplaneandhelicopterleavetheareatoreducethenoiseandallowprotesterstoheartheannouncements. This was confirmed when some of the crowd responded and left theareaormovedtothesidewalk. Others decided to stay by sitting down or standing in the street. UNLAWFUL ASSEMBLY ADVISEMENT: " I am Sgt. Shalhoob with the San Luis Obispo Police Department. I hereby declare this to be an unlawfulassembly, and in the name of the People of the State of California command all those assembled at theintersectionofSantaRosaandWalnutSt.'s in the City of San Luis Obispo to immediately disperse, which means to break up this assembly. If you do not do so, you will be subject to police action, includingarrest. Police action could include use of necessary and reasonable force which could result in injury. Section409oftheCaliforniaPenalCodeprohibitsremainingintheareajustdescribed, regardless of your purpose, youwillbeinviolationofsection409. The following routes of dispersal are available. Southbound Santa RosafromWalnutSt. You have 5 minutes to disperse." After the announcements were made several protesters decided to sit down in the street, making a visualstatementofnotcomplyingwiththedispersalorders. ARREST OF PEOPLE WHO REFUSED TO DISPERSE: At approximately 1950 hours, I instructed SLOSO Commander Scott’s MFF team to make an arrest of twosuspectswhoweresittinginthestreetneartheSEcornerofSantaRosaandWalnut. SLOSO took the twosubjectsintocustodywithoutincident. After allowing ample time for the crowd to disperse, Captain Smith and I came up with a plan to move theskirmishlineforwardtomovethecrowdsouthonSantaRosa. At approximately 2000 hours, we moved theskirmishlineforwardandbeganpushingtheprotestorsbackwards. Protesters who did not move were goingtobetakenintocustodybydesignatedarrestteams. As we moved approximately five feet, we took anothersuspectintocustodyforfailingtodisperse. During the arrest, a protester attempted to lynch the suspect fromofficers. Within about 20-30 seconds of pushing our line forward, various unidentified protesters beganthrowingwaterbottlesatofficers. Officer assigned as grenadiers began shooting Pepperball’s at the ground infrontoftheprotesters. This decision was made because it was the lowest level of force to disperse the unrulyprotesters. As we continued our skirmish line SB on Santa Rosa, I instructed the skirmish line to stopapproximately20’ south of Walnut. Unknown protesters continued to throw water bottles and beganthrowingfireworks, M80’s, and other various items towards officers. As MFF team leaders checked on theirteams, the unruly protesters started to close the distance and remained standing in the middle of the street. The protesters were approximately 40’ in front of the skirmish line. At approximately 2014 hours, CaptainSmithauthorizedCNgascanisterstobedeployedtoincreaseassistindispersingtheunrulyprotesters. Officers who have specifically gas trained were assigned to deploy the canisters. I continued to move theskirmishlineSBonSantaRosatotheintersectionofSantaRosaandPeach. Around this time, Lt. Mickel arrivedonscenetoassistwithincidentcommand. Officers who were assigned as grenadiers deployed additional Pepperball’s rounds, BIP 40 rounds, marking 40batonrounds, bean bag shotgun, and Oleoresin capsicum (OC) towards the protesters who continuing to throwitemstheabovelisteditemstowardsofficers. As we approached Peach, unruly protesters began throwingrocksatofficers. At approximately 2036 hours, MFF teams controlled Santa Rosa from Walnut to the intersection of Peach. Mostofthecrowdhaddispersedtheareaexceptforapproximately30-40 protesters who were still challengingofficerbystandinginthestreetonSantaRosa, Between Peach and Mill. At 2040 hours, we had each skirmishlinesprint20yardsapproximatelythreeseparatetimes. Each time we did this we noticed several of the unrulyprotestersrunawayfromus. At approximately 2042, the skirmish line was mid-block on Santa Rosa between Peach and Mill. Lt MickelorderedSgt. Kemp’s team to form an arrest team and flank the unruly protesters. At 2046, Sgt. Kemp’s teammovedEBonMillandattemptedtoarrestanyagitators. While doing this, the protesters began running SB onSantaRosatowardsPalm. Sgt. Kemp’s team arrested one individual. As this was happening, I moved the restoftheteamtotheintersectionofSantaRosaandMill. We then took over the intersection and most of theunrulyprotestersleftthearea. It should be noted that between 2020-2042 hours officers were continually having items thrown at them byunrulyprotesters. These items are listed above. At approximately 2100 hours, all personnel were relieved and walked back to the police department. SecurityofthePoliceDepartmentwasturnedovertotheSLOPDnightwatchofficers. While we were cleaning upseveralprotestersshowedupandsatatontheSWcornerpeacefully. 2. Video Review There were over 80 videos captured by officers during Monday 06.01.20 rally/protest downtown San LuisObispo. I focused on the BWC footage between 1800 to 2100 that day. This video starts as the protesters werewalkingN/B on Santa Rosa approaching Walnut. I reviewed BWC from 17 officers, 36 separate videos, whowereassignedtoeithertheskirmishlineontheS/ side of Santa Rosa at Walnut, the E/ side of Santa Rosa atWalnutorbehindtheskirmishlinesinasupportrole. Several of the videos are similar as many of the officer’s views overlapped each other. There are some subtledifferencesinwhatanglewascapturedbutIbelievetheyprovideanaccuraterepresentationofwhattheofficersfacedoncethedispersalorderwasgivenandtheprotestersfailedtoleavetheareaasdirected. I viewed the following videos: Officer Etherton: 3 videos 1 – (202006011811) 22:13 Santa Rosa and Walnut at Skirmish line as the crowd formed. Officer Ethertoncontactsleadersofthegroupaskingforassistancewithamedicalemergency. He directs them to march backdowntown. He gives directions away from the freeway. He gives group options but emphasizes the PD wantsthemtobesafe. He is asked, “Why are you geared up?” and he replies that “You ran at us.” Captain SmithconfirmstheintersectionofSantaRosaandWalnutisafirmlineinthesand. 2- (202006011917) 10:04 Santa Rosa and Walnut. Protestor yelling “You don’t give a fuck about us.” The toneoftheprotestor’s yelling is becoming angry. Instructions are given on how and what will be deployed to moveprotestorsback. Smoke, pepper balls, and then gas. Give instructions to the protestors. At 9:29 a linebackerapproachesEthertonandstatessomethingtotheeffectthatpeoplearestartingtofadeoutandthattheofficeronthelineshouldberotated. 3- (202006011943) 46:26 Santa Rosa and Walnut. The dispersal order is given along with the route fordispersal. Sgt. Shalhoob reminds protestors they have a 1st amendment right to walk on the sidewalk andcontinuetheirprotest. Captain Smith gives clear instructions first smoke, then pepper ball, and finally gas. Theskirmishlinecanbeseenmovingup. Deployment of crowd control measures begins. 29:00 gas is deployed. Thecrowdisinthestreet. Gas canisters being kicked back at officers. Officer Bravo: 2 videos 1-(20200611808) 1:00:12 Santa Rosa and Walnut. I can see protestors at the top of the hill. He moves up tosupporttheskirmishline. Protestors state this is a peaceful protest and they will not be stopped. Protestorstates “You want to hurt us.” Protestor “We want to go that way” pointing towards Walnut in front of the PDand “We do not want to fight.” Unknown protestor “Big pigs in the back, small pigs in the front.” An unknownfemaleasksfor “white people in the front.” Protestor “You are escalating this, then when shit starts you blameitonus.” Etherton steps in and asks for help getting to a female experiencing a medical emergency. 45:00unknownfemaleonmegaphoneannouncingpeoplecanleaveorstayandiftheystay, they may be arrested. 2-(202006011944) 59:34 Santa Rosa and Walnut. Protestorusingaleafblowertopushgasbackatofficers. I can hear flashbang, fireworks, and see gas deployment. Waterbottlesbeingthrownbyprotestors. Finishes up with officers moving up Santa Rosa to Mill. Officer Villanueva: 2 videos 1- (202006011807) 1:00:18 Santa Rosa and Walnut. Protestor “We are just a bunch of kids.” I can see theresponsetothemedicalemergencyofanunknownfemale. Can see organizers interact with each other. TheprotestorseeninDetectiveStradley’s video is yelling the same insults as seen in Villanueva’s video. Jaden laughs and replies “I got yours.” Aprotestor, “I’m sensing some shit” and “I am not scared.” Protestor replies to dispersal order, “Stand on yourwords, just don’t talk about it.” Implying to me he heard the order and was refusing to disperse.
