City of San Luis Obispo, Agenda, Planning Commission Agenda TREE COMMITTEE Special Meeting Agenda Monday, September 27, 2021 Due to the increasing number of COVID-19 cases in San Luis Obispo County, City Administration has made the difficult decision to return to a virtual meeting format. There will be no physical location for the Public to view the meeting. Below are instructions on how to view the meeting remotely and how to leave public comment. Additionally, members of the Tree Committee are allowed to attend the meeting via teleconference and to participate in the meeting to the same extent as if they were present. New Business: 600 Tank Farm Rd. (ARCH-0406-2021); Review of the proposed removal of 26 trees and replanting of 236 trees. Tree removals are proposed to facilitate a proposed Mixed-Use development consisting of 280 residential units and up to 12,500 square feet of commercial service/office space, with associated parking and onsite landscaping. (Anthony Whipple, Acting City Arborist) Recommendation: Designate a Quercus agrifolia tree located at 159 Broad Street as a Heritage Tree. Staff encourages retention of this tree as it will enhance the Anholm Greenway Project. 5. Arborists Report: A. WCA has completed block pruning on Modesto Ash trees, Fraxinus velutina, in Area 2. City Staff is excited to have a pruning vendor available for emergency and on-call work. B. Ongoing Davey Resource Group Program Analysis with weekly meetings and recommendations. C. Staff is currently working to attain certification from Tree City USA. Tree removals are proposed to facilitate a proposed 125,200-square foot Airport Hotel development consisting of a 204-room, dual-branded hotel, with guest amenities including an outdoor patio and dining area, meeting space, fitness room, breakfast area, bar, and onsite parking and landscaping. An Initial Study/Mitigated Negative Declaration has been prepared for the project. Senior Planner Shawna Scott provided a PowerPoint presentation and responded to Committee questions. Public Comment: Will Powers --End of Public Comment— The applicant’s representative, Pamela Jardini, provided a brief overview of the tree removal project. ACTION: UPON MOTION OF COMMITTEE MEMBER LUCAS, SECONDED BY VICE CHAIR MINNICK, CARRIED 4-0-2 (Members Rosten and Root absent, one vacant seat), to forward the following conditional recommendation to the Planning Commission: • Before approving the project, the applicant must provide an updated, accurate, description of the tree species, size (DBH), and count of the trees to be removed. The Tree Committee believed that approving the project with an inaccurate description could potentially expose the City to litigation in the future. • Replace the 16 canopy shade trees with a minimum of 24-inch box trees. • Replace the 17 perimeter trees and 11 street trees along Broad Street with a minimum of 36-inch box trees. • Engineered soil should also be used for the 31 parking lot trees as an alternative to providing more physical space for those trees to grow. • Require that replaced trees throughout the project are 30% native species, at minimum. 4. Meeting Date: September 27, 2021 Item Number: 2 Item 2 Packet Page 4 GENP-0814-2019; SPEC-0407-2020; EID-0608-2020; ARCH-0406-2021; SBDV-0407-2021 600 Tank Farm Road Page 2 1.0 COMMITTEE PURVIEW The Tree Committee’s role is to review the project and provide a recommendation to the Planning Commission regarding consistency with the policies and standards set forth in San Luis Obispo Municipal Code (SLOMC) §12.24 (Tree Regulations). 2.0 PROJECT DESCRIPTION The proposed project is a 280-unit mixed use project on an 11.7-acre site generally north of Tank Farm Road and west of Acacia Creek. The project entitlements would change the land use designation and zoning from Business Park to Service Commercial with the Specific Plan overlay (C-S-SP), which would allow a mixed-use project providing up to 280 residential units and up to 12,500 square feet of commercial- service/office uses defined in AASP Table 4.3. The project also includes a 2,250-square foot clubhouse building with a 2,800-square foot patio area. In addition, various offsite transportation improvements are not part of the development itself, but are required in order to facilitate the project, and are therefore also evaluated in the Draft EIR. A Draft EIR has been prepared to analyze the effects of the project, and is available for review on the City’s website at: http://www.slocity.org/government/department-directory/community-development/documents- online/environmental-review-documents The project includes the removal twenty-six (26) trees (16 on-site, and 10 off-site); (16) Eucalyptus, and (10) California Pepper. All 16 of the Eucalyptus trees proposed for removal are located along Acacia Creek within the creek setback, the 10 California Pepper trees are located outside of the creek setback area. The Arborist Report, prepared by Jake Minnick, PLA, identified that the Eucalyptus trees that were observed for removal were in poor-moderate health and exhibiting signs of stress like pests, crown dieback, epicormic, and sucker growth. The 10 California Pepper trees were also identified to have a poor preservation suitability due to lack of vigor and moderate signs of stress like crown dieback and epicormic growth. The Arborist Report recommends the removal of the 26 trees and provides recommendations for tree preservation efforts for the remaining trees. The project proposes to replace the 26 trees with 213 new trees on-site and 23 street trees for a total of 236 new trees (replacement ratio 9:1), please note that six of the replacement trees are identified as palm trees (Attachment 1, Landscape Plans). This ordinance establishes policies, regulations, and specifications necessary to govern installation, maintenance, removal, and preservation of trees t o beautify the city; to purify the air; to provide shade and wind protection; to add environmental and economic value; and to preserve trees with historic or unusual value. Criteria for Construction Related Tree Removal Recommendations. SLOMC §12.24.090 subsection F.4 requires review by the Tree Committee for tree removal requests related to discretionary permit applications for Major Development Review1, to make a recommendation based on criteria set forth in subsection G. The criteria are provided below with a description of how the proposed project responds. 1 Zoning Regulations § 17.106.030. Levels of Development Review. (D) Major. Major Development Review is a discretionary Planning Commission review process that includes public notice with a public hearing conducted as is required for all Planning Commission actions. The size of the trees proposed for removal range from 3-inch Diameter Breast Height (DBH) to 64 inch DBH. x Location of Tree on Private Property. All trees proposed for removal are located on private property. The trees are located throughout the property; some trees are visible from the public right-of-way, including most prominently the Eucalyptus and California Pepper trees located along Acacia Creek. x Species of Tree. The species of trees proposed for removal include 10 California Pepper (non- native), and 16 Blue Gum Eucalyptus (non-native). x Forestry Best Practice. The project includes preservation of 34 trees on site that vary in size and maturity, the replanting plan includes an additional 236 trees that significantly increases the biodiversity of the existing tree species and age distribution throughout the site. x Public Right-of-Way Obstruction or Displacement. The project site street frontage does not contain any existing street trees, therefore no street trees are proposed for removal. x Compliance Regarding Compensatory Plantings. Per the Tree Regulations, tree removal shall be compensated by planting a minimum of one new tree for each tree removed onsite (1:1 replanting ratio). There are 26 trees proposed for removal throughout the site. The applicant is proposing to replant 236 trees on-site; this is a replanting ratio of 9:1. The compensatory planting plan complies and exceeds the requirements of the Tree Regulations. x Heritage Trees. None of the trees proposed for removal have been designated Heritage trees. The Arborist Report, prepared by Stalwork, Inc, identified that the Gold Medallion tree that is proposed for removal has been aggressively pruned over time and exhibits an unbalanced canopy, with a 16-degree lean over Broad Street (Attachment 2). The tree has also lifted two concrete panels of the existing sidewalk to the South and one panel to the North. The arborist report recommends removal of the tree due to the hazardous conditions of the sidewalk and replacement planting of four 36-inch box trees along Broad Street. The project proposes to replace the 1 tree with 11 new trees on-site and 8 street trees for a total of 19 new trees (replacement ratio 19:1). This ordinance establishes policies, regulations, and specifications necessary to govern installation, maintenance, removal, and preservation of trees t o beautify the city; to purify the air; to provide shade and wind protection; to add environmental and economic value; and to preserve trees with historic or unusual value. Criteria for Construction Related Tree Removal Recommendations. SLOMC §12.24.090 subsection F.4 requires review by the Tree Committee for tree removal requests related to discretionary permit applications for Major Development Review1, to make a recommendation based on criteria set forth in subsection G. The criteria are provided below with a description of how the proposed project responds. x Size of Tree. The size of the tree proposed for removal is 20-inch Diameter Breast Height (DBH). x Location of Tree on Private Property. The tree proposed for removal is located in the public right of way along Broad Street. x Species of Tree. The species of tree proposed for removal is Gold Medallion, which is a non-native species from Brazil. x Forestry Best Practice. The project includes a replanting plan for an additional 19 trees that significantly increases the biodiversity of the existing tree species and age distribution throughout 1 Zoning Regulations § 17.106.030. Levels of Development Review. (D) Major. Major Development Review is a discretionary Planning Commission review process that includes public notice with a public hearing conducted as is required for all Planning Commission actions. The tree proposed for removal is located within the public right-of-way along Broad Street and is requested for removal to accommodate sidewalk improvements to enhance the mobility of pedestrians. The existing tree’s root system has resulted in the damage to the existing sidewalk and has uplifted two concrete panels resulting in hazardous conditions for pedestrians. x Compliance Regarding Compensatory Plantings. Per the Tree Regulations, tree removal shall be compensated by planting a minimum of one new tree for each tree removed onsite (1:1 replanting ratio). There is only one tree proposed for removal on the site. The applicant is proposing to replant 19 trees; this is a replanting ratio of 19:1. Item 4 Packet Page 64 Heritage Tree Nomination Outstanding Quercus Agrifolia Street Tree at 159 Broad Street Address of tree and location on lot: The tree is in the public right of way at the street frontage of the historic Bressi Ranch, 159 Broad Street. It is adjacent to a seasonal stream coming downhill off Cerro San Luis Obispo. It is on a slight rise above street level. Requesting party (individual or group): Application prepared by Richard Schmidt, with/for North Broad Concerned Neighbors. Property Owner: We The People of San Luis Obispo. (Nominally “the City.”) Species: Quercus Agrifolia, “Coast Live Oak.” Age: About 50 years estimated (based on memory and affirmed by size/condition) Height: Approximately 55 feet. Apparent height from street view is greater due to slight elevation of base above street level and canopy over-arching the street. Spread: Approximately 55 feet. Trunk diameter at 56” above natural grade: Not strictly applicable. Well before 56”, the trunk symmetrically divides into three co-equal trunks. Just below the divide, the main trunk measures 33” in one direction and 29” on the perpendicular direction. At about 56” above grade the three sub-trunks range from about 15” for the smallest to 20” for the largest. Arboricultural or Historical Interest: This is a superior urban specimen of its species. • Beauty: This is a beautiful tree any way one looks at it. Being adjacent to and overhanging the street, all can enjoy its beauty. • Form: Unimpeded in any direction by other tree competitors, this tree exhibits a rounded spreading symmetry not found in most native specimens of its species. The tripartite trunk division is part of this tree’s distinctive and lovely form. • Public Value: This tree is unquestionably the finest street tree along this section of Broad Street. It adds robust green cover over more than half the street’s width along a sparsely-green section of the future Anholm Greenway. It is exactly the sort of “feature” tree a “greenway” should incorporate. • Robust Good Health: This “young adult” Quercus is in its prime, with robust good health, and vigorous growth which will only make it more special to its neighborhood in years to come. That it is so vigorous in a dry location makes it that much more remarkable. (We expect to see this sort of vigor in Quercus along permanent creeks, where there is abundant soil moisture, but not so much on a dry hillside like this.) Item 4 Packet Page 65 • Habitat Value: Being a native species, the tree is uniquely supportive habitat for native insects, birds and others. The tree is full of song birds much of the year. Song birds are “species of local concern” in our city. Protecting this tree helps protect these important but diminishing avian species. • Climate Value: Vigorous trees like this sequester carbon for the long term: we can anticipate this tree will live – and sequester its carbon -- for several more centuries if protected. The city’s Climate Action Plan establishes sequestration of carbon in trees as one of the city’s primary mechanisms for fighting climate change. • Urban Cooling: The large green canopy of this tree intercepts solar energy (transforming it through photosynthesis into carbohydrates and ultimately into carbon-sequestering wood), and prevents that solar energy from reaching the ground in the form of heat. Thus it cools its surroundings, including heat-absorbing pavement beneath it, lessening the urban heat island effect and reducing the human desire for energy-guzzling artificial cooling in the immediate vicinity. This tree thus contributes to climate control and reduction of urban warming. • Historical Significance: The tree is on the narrow street frontage of the historic Bressi Ranch on the flank of Cerro San Luis Obispo. This ranch is part of our local heritage, the late Mrs. Bressi being a Serrano, a family that goes a long way back in our community’s settlement and whose name is familiar thanks to nearby Serrano Drive. The ranch has recently changed owners, and the tree could be threatened by development. • Public Ownership: As a publicly-owned resource, the City should set a good example by providing this tree the designation and long-term protection it merits. This tree is a valuable street tree, a valuable urban example of one of our primary wild natives, plays roles in climate stabilization and in species protection, and will be an important asset to the Anholm Greenway. It is consistent with numerous city policies to protect and honor this tree as a Heritage Tree.
