Hi Brian,
I got a call from Matt Hoffman of NK Builders ( who says he’s ready for
Planning’s final inspection for the Leitcher House on permit BLDG-1332-2015 (667
Monterey).
You reviewed plans (see PLBLDG-1088-2018) and so I told him I would relay his
information to you so you can arrange an inspection.
Let me know if I can be of any help setting this up…

Hi Rafael,
We are working through some items on the Leitcher House (Part of the Monterey Place project) that
involve the occupancy classification of the building and openings relative to the property line. I
thought it would be helpful to walk through these items with you just to make sure we are on the
same page and we don’t head down the wrong direction.
Do you have any time available either this afternoon or tomorrow afternoon? I don’t think it will
take more then 15-20 minutes max.

Rodger, we need to be careful as the R-3 occupancy classification under the CBC does
specify the following uses as permitted uses:
· Boarding Houses (nontransient) with 16 or fewer occupants
· Boarding Houses (transient) with 10 or fewer occupants
· Same for congregate residences.

As a reference, please look at the CRC 1.1.3 (Scope): Specifically states Owner-occupied
lodging houses with 5 or fewer guestrooms shall be permitted to be constructed as One
and Two family dwellings using the CRC. Please note the italics and double lines in the
margin indicating that this is both a change in code and State Fire Marshal specific
language. The building classification “Boarding House (transient)” is not included in the
CRC. If the use of the building is other than owner-occupied it would be covered under the
CBC as either R-1 (transient) or R-2 (non-transient).

Hello All,
Would you be willing to meet with the applicant to discuss the lot line adjustment proposed
for 667 Monterey (LLA 56-14), to help us move toward some final action on this
application?
From our recent discussions about adjusting lot lines to place a line around the Leitcher
Building, it is apparent that the applicant’s argument (see below) is not supported by
Building or Fire. The applicant contends that exterior fire wall ratings and limitation on
building openings (particularly those of the reconstructed porch around the building) will not
apply to the relocated building because it should be classified as an R-3 Occupancy Type
under the 2013 CBC, as a Boarding House (transient).
It will be useful to discuss with the applicant, in person, the reasons that the proposed 2-
guest-room Bed & Breakfast Inn could not be considered a Boarding House (transient), and
thus would not be classified as an R-3 Occupancy Type, and why it would instead be
classified as an R-1 Occupancy Type. It may also be helpful to discuss how the current
proposal relates to the future phases of the larger Monterey Place project, and the
possibility of achieving compliance with building safety codes through “no-build” easements
to provide proper building separation.
Let me know if you are available for such a meeting, and if so, I will set something up with
the applicant.

Walter…below are answers from the Architect to the questions in your last e-mail
pertaining to the lot line adjustment for the future location of the Leitcher House, which
seems to provide resolution. The remaining issue is the lot line location on the west side.
The attached exhibit shows a 5’ setback on the west side, as required by building, and
the setbacks to the future buildings on the west and east sides.
I hope we can now get scheduled for a hearing. Thanks.

Plans to show the required exterior wall fire rating for any new proposed property line in
accordance with Chapter 6 Table 602 2013 CBC. Please note that “no openings are
permitted within 5 to 10 of proposed property line. ( No occupancy classification was
specified on plans submitted)
· The building is classified as a Boarding House (R-3) occupancy. Per
Table 602, item i, fire-resistance rating shall not be required where the
fire separation distance is 3 feet or more and equipped with
automatic sprinkler system.
2. Verify allowable openings and openings protective in accordance with Table 705.8 2013
CBC. It is assumed that the (F) notation is for “future location of building exterior walls.
· Per 705.8.1, Exception 2, buildings whose exterior walls are not
required to be fire-resistance rated shall be permitted to have
unlimited unprotected openings.
3. Verify that any existing projections are in compliance with requirements in Table 705.8
2013 CBC.
· N/A. The existing porch will be reconstructed and the new porch will
be meet the exception listed above.

Correct, however the “order of precedence and use” clearly states how conflicts in code
language are to be resolved. Being that the most specific and most restrictive shall prevail. I
checked the code language with other States and they have identical language when it
applies to transient lodging. This may need an official code interpretation from the SFM.
