City Clerk SUBJECT: General Municipal Election for November 8, 1983 � 0 s n s CA0 RECOMMENDATION: i A) Adopt resolution calling the election; B) Adopt resolution requesting consolida- ! tion with the County; C) Receive and file Certificate of Sufficiency and continue ' placing of the parking initiative on the ballot to Wednesday. 7/6/83 at 6:00 p.m. � � Council discussion of possible advisory measures also to be continued to this date. BA�CKGROUND: Pursuant to the City Charter amended at the last General Municipal Election in March, 1981, the General Municipal Election will be held Tuesday. November 8, 1983. This amendment a1loWed the city to consolidate with the State School Governing Boards and Uniform District Elections (UDEL) , in an effort to hold election costs down and possibly allow for a larger voter turnout. The General Municipal Election provides for the election of the Mayor and two Council- members and may include any measures submitted bq Council or citizens i.e. initiatives, referendums, recalls. The only initiative submitted by petition in time for the November ballot (pursuant to Election Code Section 4006) was the parking initiative (Certificate of Sufficiency attached). The Council maq propose amendment(s) to the City Charter, any proposition for the issuance of bonds or any other advisory question. The last day to submit any measure to the County is July 18, although the last regular meeting of the Council is July 5. PURPOSE OF RESOLUTIONS: The resolution calling the election (Exhibit A) also includes additional filing requirements pursuant to the City's Campaign Election Ordinance adopted 8/16/70 and �^ revised 9/15/81. In particular Section 4 of the resolution allows for the filing of a , an additional 400 word supplement to the Statement of Qualifications setting forth � , the candidate's stand on local issues (Section 2807.1.f of Ordinance 903). This � statement will be included with the sample ballot at no cost to the candidate. Section 5 of the resolution will permit r��atinl���a�. arguments in addition to arguments g for or against a measure already provided for by Elections Code Section 4015. '„, The resolution consolidating the election provides for the basic holding of the �' election i.e. printing and mailing of the sample ballots, ballot counting. setting up precinct workers and canvassing the results. Requirements called for by the City's Campaign Election Regulations will be performed by the City. This will include separate advertising and filing requirements in addition to those mandated by the State. The majority of the advertising and notices required by the State's Election Code will also be performed by the City. All filings i.e. statement of qualifications, 400 word supplement, Conflict of Interest, state and city financial reporting will be � handled through the City Clerk's Office. , CF.RTIFICATE OF SUFFICIENCY: The parking initiative filed by Ron Bearce, Chairman for Parking Alternatives, was filed on May 31 , 1983 and contained the signatures of more than 10 percent of the �w� ° � � c�ty o� san ��.��s o��spo � � � �������� ������ ���',; � voters of the City of San Luis Obiepo pursuant to Section 4011. The Council is being asked to accept the Certificate of Sufficiency and will be required to act as to placing the ordinance on the ballot. Staff is recommending Council defer this action to Wednesday, July 6 - 6 p.m. The options available at that time are: � 1, Adopt the ordinance without alteration; & � 2� Submit the ordinance for placement on the November ballot without alteration; � G 3. Do not place the initiative on the ballot if legal findings are made that the � initiative is invalid. Opinion as to its validity will be submitted by the City Attorney at Council's meeting of July 6. ALTERNATIVES: 1. Amend the resolution calling the election, however. only Section S is optional. 2� Failure to adopt the resolution consolidating the election would result in two elections being held on the same day. An impractical solution at best. 3. Continue discussion of any one of the resolutions or the Certificate of Suffic��st� for additional report or clarification, CONCURRENCES: City Attorney FISCAL IMPACT: $27,130 is anticipated to conduct the 1983 election for Mayor and two Councilmember I seats and was approved by the Council on 6/19/83. Several factors will influence the City�s General Municipal Election expenditures: 1, Any measures, initiatives or teferendums placed on the ballot according to the entity placing it i.e. City of San Luis Obispo, School Districts, Cuesta College, Special Districts or measures placed by other cities in the County. 2. Number of candidates placed by the City of San Luis Obispo, School Districts, Cuesta College or Special Districts, if any. RECOMMENDATION: A) Adopt resolution calling the General Municipal Election to be held Tuesday, November 8, 1983; B) adopt resolution requesting the San Luis Obispo County Board of Supervisors to consolidate the General Municipal Election on Tuesday, November 8, 1983, with the School District Governing Boards and Special Districts Election to be held on said date; C) receive and file Certificate of Sufficiency and continue discussion of placing the parking initiative on the ballot to Wednesday, July 6, 1983, at 6:00 p.m. Council discussion of possible advisory measures also to be continued to this date.
