Dear Commissioners,
The above project is item #4a on the ARC Agenda for 2/7/2022. In previous correspondence
with Community Development staff (Cohen, Scott) re: this project, we’ve copied your
Commission and now provide a few more additional comments.
There are two Conditions of Approval that were imposed on the Spevack property during the
subdivision process that must be emphasized (MS-78-09). These two conditions were the result
of exhausting Public Hearings through the Administrative Review, Planning Commission and
City Council hearings, and represent thoughtful agreement and compromise between the
surrounding residential neighborhood and the Applicant. The City’s imposed Conditions of
Approval enabled Spevack reasonable and generous development opportunities and the
neighborhood given assurance that their homes, views, decks and patios, and the value of their
real estate, would be respected and not adversely impacted.
On Parcel #1, there are two pre-fab residential units proposed, one of which is located
completely outside of the delineated building envelop that was proposed by the applicant
(Spevack) and adopted as a Condition of Approval of the three -lot subdivision approved by the
City Council on 1/5/2010. Why the ARC is evaluating a Site Plan on Parcel #1 that is completely
and totally in non-compliance with the restrictions placed on this parcel is dumbfounding.
Another Condition of Approval of the three-lot subdivision, requires that future development
must “be compatible with the scale and character of the existing neighborhood.” Following are
photos of the homes that abut Parcel 1 and are profoundly impacted by this proposed project.
The neighborhood was assured that future development would be compatible and
complimentary. So, what do we get? Cheap looking, unarticulated and incoherent, pre-fab
units. It would be tortured logic for the ARC or anyone to make the requisite findings that this
project is compatible, in character with, or even close to complying with this condition.

This project as proposed should be rejected and denied. The Applicant has demonstrated a
complete disregard with the development agreements and conditions that were established
many years ago and relied upon for future development on this property by the neighbors. This
type of thoughtless, dishonest and irresponsible development should never be permitted or
supported in our City.
