NEW BUSINESS 2. New Business: 3490 Empresa Drive (ARCH-0516-2021). Review the proposed removal of 10 trees and replanting of 14 trees. Tree removals are proposed to facilitate an office/warehouse development consisting of 16,741 square feet of commercial space, with associated parking and onsite landscaping. (Kyle Bell, Associate Planner) Recommendation: Recommend the Planning Commission find the proposed tree removals and compensatory planting plan as part of the 3490 Empresa Drive Development Project consistent with the Tree Regulations. The Tree Committee may provide recommended considerations or condition(s) related to the tree removals and compensatory planting. TREE REMOVAL APPEALS Any person aggrieved by an act or determination of the authorized approving authority exercising the authority herein granted shall have the right to appeal the decision of the authorized approving authority as set forth in Section 12.24.180 of the City of San Luis Obispo Municipal Code. Appeals received by the City Clerk within ten calendar days from the date of determination or act shall cause the director to withhold tree removal permits and any permits for construction or demolition actively relying on the subject tree removal until the appeal is heard and a decision is reached. 3. 3150 Rockview Pl. SITE DATA SUMMARY The project consists of a proposed development of a vacant commercial property to include a two-story warehouse and office development consisting of 16,741 square feet of commercial space. The project to remove 10 existing trees and replace with 14 trees (Attachment 1, Tree Removal Plans). 1.0 COMMITTEE PURVIEW The Tree Committee’s role is to review the project and provide a recommendation to the Planning Commission regarding consistency with the policies and standards set forth in San Luis Obispo Municipal Code (SLOMC) §12.24 (Tree Regulations). Applicant Bryan Ridley Zoning Commercial Retail (C-S-SP) within the Higuera Commerce Park Specific Plan General Plan Services and Manufacturing Site Area ~23,714 square feet Environmental Status Categorically exempt from environmental review under CEQA Guidelines Section 15332 (In-Fill Development Projects) Meeting Date: February 28, 2022 Item Number: 2 Item 2 Packet Page 4 ARCH-0516-2021 3490 Empresa Drive Page 2 2.0 PROJECT DESCRIPTION The project includes the removal of nine (10) on-site trees; six (6) Oak trees, and three (4) London Plane trees. The six Oak trees range in size from 6-inches to 10-inches in diameter at breast height (DBH), and the London Plane trees range in size from 16-inches to 34-inches (DBH). The Arborist Report (Attachment 2), prepared by Chris Stier, at Greenvale Tree Company, identified that the Oak trees are in good condition but show evidence of overcrowding due to the overlapping canopies and significant one-sided leans. The London Planes were also identified to be in good condition; however, the 34-inch London Plane tree seems to have outgrown the original planter. The arborist report recommends removal of the trees as necessary to accommodate the proposed building footprint. The project proposes to replace the 10 trees with 14 new trees (replacement ratio 1.4:1). Tree Type and Quantity Tree Species Street & Shade Trees (size undetermined) (14) Species undetermined 3.0 TREE REGULATIONS The City’s Tree Ordinance (Municipal Code Chapter 12.24) was adopted in 2010 and recently updated in 2019 with the purpose of establishing a comprehensive program for installing, maintaining, and preserving trees within the City. This ordinance establishes policies, regulations, and specifications necessary to govern installation, maintenance, removal, and preservation of trees to beautify the city; to purify the air; to provide shade and wind protection; to add environmental and economic value; and to preserve trees with historic or unusual value. Criteria for Construction Related Tree Removal Recommendations. SLOMC §12.24.090 subsection F.4 requires review by the Tree Committee for tree removal requests related to discretionary permit applications for Major Development Review1, to make a recommendation based on criteria set forth in subsection G. The criteria are provided below with a description of how the proposed project responds. • Size of Tree. The size of the trees proposed for removal range from 6-inches to 34-inches DBH. Staff recommends that the Tree Committee provide feedback to the applicant team and Planning Commission regarding potential preservation of the 34-inch London Plane tree, as the building footprint could be slightly re-oriented to preserve the tree, and minor site improvements could be made to enhance the existing planter to accommodate the continued growth of the tree. • Location of Tree on Private Property. All trees proposed for removal are located on private property. The trees are located throughout the property; some trees are visible from the public right-of-way, including most prominently the London Plane trees. Staff recommends that the Tree Committee provide feedback to the applicant team and Planning Commission regarding the potential preservation of the 16-inch London Plane tree closest to the existing driveway approach, as this location does not interfere with the proposed building footprint, and site improvements may be 1 Zoning Regulations § 17.106.030. Levels of Development Review. (D) Major. Major Development Review is a discretionary Planning Commission review process that includes public notice with a public hearing conducted as is required for all Planning Commission actions. The species of trees proposed for removal include Oak trees which are native to California, and London Plane trees which are non-native species from southeastern Europe. • Forestry Best Practice. The project includes a replanting plan for an additional 14 trees that significantly increases the biodiversity of the existing tree species and age distribution throughout the neighborhood. Staff recommends that the Tree Committee provide feedback to the applicant team and Planning Commission on the preferred species of all tree plantings (such as deciduous species) within the parking lot and along the street, as well as the preferred size of all new tree plantings. • Public Right-of-Way Obstruction or Displacement. The project site street frontage does not contain any existing street trees, therefore no street trees are proposed for removal. • Compliance Regarding Compensatory Plantings. Per the Tree Regulations, tree removal shall be compensated by planting a minimum of one new tree for each tree removed onsite (1:1 replanting ratio). There are 10 trees proposed for removal throughout the site. The applicant is proposing to replant 14 trees; this is a replanting ratio of 1.4:1. The compensatory planting plan complies and exceeds the requirements of the Tree Regulations. • Heritage Trees. None of the trees proposed for removal have been designated Heritage trees. In the future a new building will be built that will affect a group of six Coast Live Oak (grew from seedlings) and four London Plane Trees (planted). All six oaks and three of the London Plane trees are directly along the current lot line and one London Plane tree near the corner parking island will be within the eventual buildings footprint. Quercus agrifolia (trees assessed as a group) Canopy – Canopies of the trees are in good condition. Healthy growth with good color. Very crowded conditions with overlapping canopies. Some twig and leaf dieback mainly due to low light levels. Likely two or three oaks will eventually dominate under current conditions; smaller understory oaks will die. Foliage is growing through the chain-link fence and is choking out original planted shrubbery. Branches – Several of the oaks I noted narrow branch crotches with included bark. Some are developing significant leans and one-sided growth due to overcrowding. Those closest to the small building adjacent will need trimming very regularly to accommodate the building. Overall growth and position of the branches are influenced by crowding and lack of light. Lots of small deadwood due to low light levels – fire hazard. Trunk – I saw no cankers, lesions or galls. Some trunks are leaning due to low light levels. Roots – No excavation of roots was made. These are close enough that curbs, pavement etc. will eventually be disrupted/broken by roots. Platnus x acerfolia (trees assessed as a group) Canopy – Canopies of the trees are in good condition. Healthy growth with good color. These trees are doing very well considering drought conditions. Some twig dieback (normal). Branches – Likely these trees have been pruned several times to open the trees and to give the trees shape and balance. Branch spacing, balance and weight are all very good. I see no real concerns with branch structure. Trunk – I saw no cankers, lesions or galls. Roots – No excavation of roots was made. These are close enough that curbs, pavement etc. will eventually be disrupted/broken by roots. Tree in small planter near building is most likely to begin breaking curbs and pavement – planter is very small for tree size.
