On our end, now I am going to reach out to the BCC to get a clearer idea of what they permit in 5033 and 26070(j)(3) and from there I will have a better understanding of what we can allow within out Security Plan. Thank you also for the lead on San Francisco, I’ll also reach out to their folks and see what they have allowed in their security requirements. Also just so I am clear it sounds like you have now officially signed over your ownership in NHC and no longer have an equity interest in the company? Would you send me over the document in a separate email? Hi Georgina and Greg, Since we last spoke I had reached out to the City of San Francisco's cannabis program about their permitting of overnight product storage on retail floors (they were one of the other jurisdictions we've seen this occur in). However I have yet to hear back and it's been quite a while. Since it could be a sensitive security related question, you all might be more likely to get a response than me. I have attached an email from Grover Beach City Manager Matt Bronson detailing how they were able to permit this. Essentially with high security standards and a requirement of restricted access by management employees after hours (which creates the temporary limited access area), the BCC gave them leeway to allow it. On another note, after we spoke I also had my attorney review the NHC SLO operating agreement, and even though my interest was not actively vesting under the 4 year vesting period, since I'm no longer employed there, he did say that a document assigning my interest had to be signed to make it official. So far we have not permitted any cannabis business to store product on the shelf. I know you had spoke to Chad about getting your building considered a vault however, we checked the BCC regulations and the BCC regulations do not allow for cannabis goods to be stored out of limited access areas. The BCC rule 5033 Storage of Inventory states, “All inventory stored on the licensed premises shall be secured in a limited-access area”. Additionally, Limited-access area, “means an area in which cannabis goods are stored or held and is only accessible to a licensee and its employees and authorized individuals”. Problem: Retail Areas are accessible to retail customers. Therefore no business is allowed to store cannabis products on the retail floor overnight even if the building is considered a vault as retail customers would come in an out of the “limited-access area.” We unfortunately cannot go over the BCC regulations and therefore are unable to permit Megan’s Organic Market to leave products on the shelf and instead ask you continue to follow your approved Security Plan and Inventory Procedures.
