Approve the project plans (Attachment A) and specifications (Attachment B) for Roadway Sealing 2022, Specification Number 1000560; and 2. Authorize staff to advertise for bids; and 3. Authorize the City Manager to award the Construction Contract pursuant to Section 3.24.190 of the Municipal Code for the bid total, if the lowest responsible bid is within the publicly disclosed funding amount of $2,600,000; and 4. Authorize the City Engineer to approve Contract Change Orders up to the available project budget. REPORT-IN-BRIEF Following the City of San Luis Obispo's (City) Pavement Maintenance Plan (Pavement Plan), staff recommends advertisement of a slurry sealing project to provide maintenance and striping improvements to the streets shown in Attachment C. Also included in this bid package are maintenance and striping plans for the Islay Park Parking Lot and Madonna Inn Shared-Use Path, which were also identified for pavement maintenance. The 2022 “Project” is defined in Attachment C. Pavement maintenance projects often involve complete removal and replacement of roadway striping and pavement markings, which provides excellent opportunities to incorporate planned safety and complete street1 improvements as part of these larger roadway maintenance efforts. The 2022 Project will implement several complete street modifications envisioned for Marsh and Higuera Streets in the City’s Downtown Concept Plan and the recently adopted Active Transportation Plan to improve downtown safety and mobility for all road users. 1 A complete street is a transportation facility that is planned, designed, operated, and maintained to provide safe mobility for all users, including bicyclists, pedestrians, transit vehicles, truckers, and motorists, appropriate to the function and context of the facility. Page 397 of 984 Item 5h These strategies include design elements intended to improve pedestrian crossing safety, increase separation between bicyclists and motor vehicle traffic, and calm traffic and reduce speeds through the downtown. Additionally, the 2022 Project will implement neighborhood greenway and traffic calming elements consistent with the Active Transportation Plan and Safe Routes to School Plans within the Laguna Lake and northern Foothill neighborhoods. This Project will be funded in Fiscal Year 202 2-23. Allocated funds for this Project are estimated to be sufficient. DISCUSSION Background On April 14, 1998, the City Council adopted the City's Pavem ent Plan. In 2009, the Pavement Plan was updated to provide additional emphasis on arterial streets. A key element of the Pavement Plan is a rotating and methodical approach to ensuring all areas of the City receive regular preventative and/or corrective p aving maintenance. The City implements this rotation by performing maintenance in two neighborhood Pavement Areas in one year, and then focusing on arterial street work in the second year, thereby alternating between neighborhood areas and arterials bi-annually. Last summer, streets maintenance funding was used for the rehabilitation of portions of Marsh and Higuera, which included asphalt replacement and striping enhancements. Improvements to both pedestrian and cyclist access in the form of curb ramps and buffered bike lanes were also completed. Project The 2022 Project is structured with a Base Bid and one Additive Alternative A to maximize the scope of work within available funding. The Project’s Base Bid (Attachment C) includes street sealing in Area 6 (Laguna Lake Neighborhood), 7 (North Downtown) and 9 (Downtown Core). The Project’s Additive Alternative A includes curb ramp/bulb-out improvements, signal upgrades and storm drain replacement at the intersection of Higuera and Nipomo. The strategy is to award the contract with the Base Bid and Additive Alternative A as funding will allow, up to the Publicly Disclosed Funding amount of $2,600,000 in compliance with Public Contract Code Section 20103.8(c). If the lowest responsive bid submitted by a responsible contractor is in excess of the Publicly Disclosed Funding amount, the Additive Alternate will not be recommended for award. Page 398 of 984 Item 5h Roadway Sealing 2022 This year, program funding is planned to be used to seal neighborhood streets within Area 6 and 7. Also included with the Project are portions of Area 9 (Downtown Core) that were deferred from the 2021 Street Maintenance Project in order to not magnify the disruption and inconvenience that typically create impacts on downtown businesses. In addition to roadway maintenance, striping improvements and curb ramps will be constructed to meet current ADA and City standards. Furthermore, staff identified cost benefits to incorporating parking lot maintenance and bicycle pathway maintenance projects identified within the 2021-23 Financial Plan. The Islay Park parking lot and the Madonna Inn Pathway were identified for maintenance in 2022. These maintenance projects would use the same slurry sealing treatment as the neighborhood streets, and economies of scale will be realized through overall lower unit costs for a larger scale maintenance treatment operation. In anticipation for this year's roadway sealing project, the City's Street Maintenance team has applied crack sealing treatment and spot repairs within Area s 6 and 7. Toste Construction completed crack sealing work in Area 9 Downtown Core. This preparatory work increases the slurry seal's long-term effectiveness and reduces overall construction costs. Slurry seal is a cost-effective surface maintenance treatment that extends pavement life and prevents premature pavement failure that would result in more expensive asphalt replacement or reconstruction work. Applied as a thin pavement sealant, it shields the pavement beneath from ultraviolet damage, minimizes wa ter intrusion, and provides a new wearing surface for vehicles. This preventative maintenance treatment is less costly and more environmentally beneficial than full pavement replacement since slurry seal requires less petroleum products in the manufacturing, delivery and application than pavement replacement. Prior to the application of slurry sealing, localized pavement areas that have completely failed will have to be replaced as indicated by white paint. In order to expedite project delivery and reduce construction cost, staff separated the curb ramp upgrades from the street sealing work, with the curb ramp improvements to be constructed under a separate construction contract just ahead of the summer paving . A separate bid package was prepared to construct 38 curb ramps that was approved by Council on February 15, 2022 (Attachment D). Laguna Lake Neighborhood (Pavement Area 6) In addition to local roadway sealing and striping replacement, proposed improvements within Area 6 include accessible curb ramp upgrades and development of a new neighborhood greenway as identified in the Active Transportation Plan (Figure 1: Laguna Lake Neighborhood Street Enhancements). Page 399 of 984 Item 5h A neighborhood greenway is a shared street (bikes and autos share travel lanes) with traffic calming (speed humps), custom guide signage and pavement markings to convey a low-traffic route prioritized for walking and bicycling (Figure 2). These enhancements will improve walking and biking along these corridors to both CL Smith Elementary and Laguna Middle School, while preserving on-street parking and access for drivers. Additionally, speed humps will be installed alon g Oceanaire Drive as part of Neighborhood Traffic Calming improvements. While this segment was not originally identified to receive traffic calming features as part of the paving project, following a neighborhood meeting in October 2021, many neighbors on Oceanaire expressed on- going concerns for illegal speeding and requested traffic calming. Oceanaire provides direct access to C.L. Smith Elementary and Laguna Middle Schools. Staff verified that the existing vehicle speeds warrant traffic calming, and consideration was given to adding speed humps along Oceanaire between Los Osos Valley Road and Madonna Road. Prior to agreeing to add traffic calming to the paving project scope, staff provided notices and surveys to each property owner and occupant along Oceanaire to gauge support for this proposal. The survey results demonstrated a clear majority of residents in support of speed humps along Oceanaire. Page 400 of 984 Item 5h Figure 1: Laguna Lake Neighborhood Street Enhancements Page 401 of 984 Item 5h Figure 2: Custom Guide Signage and Pavement Markings Staff received additional input from the community and Active Transportation Committee (ATC) at the ATC’s recent February 24th meeting regarding the critical connection between the recently completed shared use path on Madonna and the neighborhood greenway which provides safe route to school access to both CL Smith Elementary and Laguna Lake Middle schools. Members of the committee, as well as students and parents who currently walk and bike this route on their way to and from school , requested that staff consider an on-street extension of the two-way path on Madonna along the east side of Oceanaire to the Atascadero Street intersection. Staff has considered this request and finds it feasible to design a two-way protected facility consistent with best practices and safety measures. Figure 3 is a conceptual graphic of the proposed facility (note that this concept is not included in Attachment A Project Plans as this input was received after this submittal was prepared). This proposed design will offer a protected space for bicycle riders of all ability levels to promote safety, and comfortably navigate the transition from Madonna Road to Atascadero Street. The proposal also includes a new all-way stop at the intersection of Oceanaire and Atascadero to provide a more comfortable crossing for those walking and biking and to reduce conflicts with automobile traffic. It should be noted that the planned facility will require the removal of approximately six on-street parking spaces. Staff has reviewed the availability of on-street parking and determined there is adequate availability to support this proposal. Each adjacent property has sufficient on-site parking including a multivehicle driveway and garage. Page 402 of 984 Item 5h Additionally, on-street parking directly across the street appears to be underutilized and would provide additional parking opportunity. Residents and property owners directly adjacent to the proposed facility have been notified of the proposed parking removal and provided information on how to support or oppose the planned facility, including notice of this March 15th City Council meeting. Figure 3: Conceptual layout of Madonna/Oceanaire/Atascadero bicycle connection North of Downtown Neighborhoods (Pavement Area 7) In addition to local roadway sealing and striping replacement, proposed improvements within Area 7 also include accessible curb ramp upgrades, development of the Cerro Romauldo Greenway as identified in the City’s Active Transportation Plan and neighborhood traffic calming along Ramona Drive, as identified in the Bishop Peak/Pacheco Elementary Safe Routes to School Plan (Figure 4). Page 403 of 984 Item 5h Traffic calming proposed for Ramona and Cerro Romauldo includes addition of speed humps and neighborhood traffic circles at high-conflict intersections (Figure 5). These improvements will improve walking and biking along these corridors and access to Bishop Peak and Pacheco Elementary Schools as well as Cal Poly. As with Oceanaire, during community outreach activities many residents on Meinecke and Lincoln Street also shared concerns with ongoing speeding issues and cut-through traffic on their streets. Lincoln Street provides an access to a nearby neighborhood park (Anholm Park) and Meinecke Street creates a convenient cut -through route for drivers avoiding Foothill and Santa Rosa Streets. Again, staff verified that existing vehicle speeds warrant traffic calming consideration and residents and property owners along the route participated in a survey, which also demonstrated a clear majority in support of speed humps. As such, speed humps will be installed on Meinecke between Broad and Chorro and on Lincoln between West and Chorro. It should also be noted that both Meinecke and Lincoln Streets have in the past applied for participation in the City’s Neighborhood Traffic Management Program and are currently in the queue behind several other neighborhoods. Implementing traffic calming as part of the 2022 Roadway Sealing Project provides a great opportunity to address neighborhood traffic concerns at these locations now as part of a larger project, while allowing staff to focus current attention and resources on other neighborhoods in the Neighborhood Traffic Management queue with ongoing issues and concerns. Additional street modifications proposed in the paving plans based on community input include addition of stop signs at side streets along Lincoln Street (currently no stop or yield signs exist) and addition of 15 feet of red curb parking restrictions at the entry to Anholm Park to improve visibility of children and families walking to/from this neighborhood park. Page 404 of 984 Item 5h Figure 4: North Downtown Neighborhoods Street Enhancements Figure 5: Examples of Traffic Circle and Speed Hump Page 405 of 984 Item 5h Marsh and Higuera (Pavement Area 9 – Downtown Core) Pavement Area 9 encompasses the downtown core of San Luis Obispo. In addition to local roadway sealing, 19 new accessible on-street parking spaces will be provided throughout the project area to provide improved access to parking for those with mobility challenges. Crosswalks throughout the project area will be restriped with high -visibility “ladder style markings” to improve visibility for crossing pedestrians. Consistent with the Downtown Concept Plan and Active Transportation Plan, the 2022 sealing Project will reduce the number of auto travel lanes on Marsh and Higuera Streets between Santa Rosa and Nipomo Streets from three to two lanes in order to reduce illegal speeding and provide more street width for pedestrian and bicycle facilities, as well as existing and future parklets and sidewalk widening (Figure 6). (Note: this segment of Higuera has been temporarily striped in this configuration since 2020 as a pilot installation.) Additionally, these lane reductions have already been implemented on Marsh and Higuera Streets outside of the downtown core as part of the 2021 Downtown Pavement Improvements Project. These modifications will retain sufficient auto traffic capacity to accommodate existing and future auto demand, while preserving width for more significant future improvements, such as sidewalk widening. These plans will make the existing buffered bike lane on Higuera Street (Figure 7), originally installed as a pilot project, a permanent installation with addition of continuous green coloring, while physically protected bike lanes with concrete medians and planter boxes along the top will be installed on Marsh Street (Figure 8). To provide safe transitions and sight lines with bikeway improvements on Marsh, approximately 6 existing on-street stalls will be removed. Any parklet installations that are approved to remain as part of a Permanent City Parklet Program (currently in development) will be protected in place to the maximum extent feasible during construction. Finally, as requested by the Active Transportation Committee, a new pedestrian crossing phase is proposed for the north leg of the signalized Marsh/Santa Rosa intersection, reducing delays for pedestrians crossing Santa Rosa Street. It should be noted that the resealing limits of Area 9 in the downtown include intersections with existing Neighborhood Greenway street murals (Nipomo/Pacific and Morro/Pacific). These murals will be repainted following completion of the sealing project consistent with public art maintenance policies described in the City’s Public Art Program. Cost for this artwork maintenance will be funded from the Public Art Maintenance Account. Page 406 of 984 Item 5h Figure 6: Higuera and Marsh Improvements Figure 7: Higuera Street Cross Section Page 407 of 984 Item 5h Figure 8: Marsh Street Cross Section Benefits to Downtown Vitality & Streetscape Aesthetics Where feasible, staff endeavors to incorporate design elements that not only serve a functional purpose but add to the vibrant downtown environment. For example, staff is pursuing aesthetically appealing options for the physical buffer separating the protected bike lanes from vehicular traffic on Marsh Street in lieu of plastic flex posts or other less visually appealing features. The current design approach for Marsh Street includes use of concrete medians with “Mission Style” concrete color/finish, and addition of planter boxes within these medians where feasible, similar to those installed on Marsh and Higuera outside of the Downtown Core as part of the 2021 Paving Project (Figure 9). Where on-street parking exists adjacent to protected bike lanes, planter boxes would be located to retain access for passengers accessing their vehicles. Installation and maintenance of the planter boxes will be secured under a separate contrac t immediately following the complete installation of the medians. Figure 9: Protected Bike Lanes with Landscaped Planter Boxes (Marsh Street) Page 408 of 984 Item 5h In addition, providing a fresh and smooth surface creates the perfect canvas for future street art installations, which can be explored following the roadway sealing project as part of the City’s Public Art Program. Economic Recovery and Downtown Business Considerations As the designs have developed, and through the public engagement activities described further in this report, staff has received initial feedback from residents, visitors, and businesses in the downtown. One of the questions/concerns raised during the project planning process relates to the timing of this project and the effects it can have on downtown businesses as they hope to continue recovering from the impacts of the COVID -19 pandemic. Based on discussions with the downtown community, strategies proposed by staff to minimize potential disruption to downtown road users and businesses during con struction activities for 2022 paving efforts include: a. Deferring start of any disruptive construction activities in the Downtown core until September 1st, avoiding the peak of the summer tourist season. b. Where feasible, scheduling working hours outside of peak weekday business hours, including a goal to maintain two lanes of traffic on Marsh and Higuera between 10 a.m. and 6:00 p.m. as much as possible. c. Advance noticing to adjacent businesses and residents prior to start of construction to provide project details, schedule and contact information for questions and project updates. d. Regular (weekly or bi-weekly) construction updates to notify the community of upcoming project activities and schedules. It should also be noted that the 2021 Downtown Paving proje ct required full pavement replacement on Marsh and Higuera Streets west of Nipomo, which results in a longer construction duration and much more disruptive construction activities compared to a slurry seal treatment, which is the type of treatment planned and specified for the 2022 project in the Downtown Core. Public Art Just after completion of the 2022 Roadway Sealing project, bronze plaques are proposed to be installed along the bikeway medians on Higuera and Marsh Street between Marsh/Higuera intersection and Toro Street. These plaques will have an image symbolic of Downtown San Luis Obispo and be an element to brand future bikeways and bicycle networks throughout the City. Page 409 of 984 Item 5h Previous Council or Advisory Body Action 1. Annual maintenance for public roadways, including street resurfacing, supports the Council Adopted Major City Goal of Open Space and Sustainable Transportation 2. This project was originally identified in the 2021-23 Financial Plan that was approved by Council. 4. Council appropriated an additional $150,000 to support Street Resurfacing and Reconstruction projects as part of the Mid-Year Budget on February 15th. 3. The Active Transportation Committee reviewed the preliminary and 90% design at their September 16, 2021 and February 24, 2022 meetings. The ATC took the following actions (draft form) at the mo st recent February 24th meeting: 1. Recommending support for the pavement plan for the North Downtown area as presented. 2. Recommending to proceed with the pavement plan for Area 7 as proposed, with a request that staff evaluate the feasibility of removing stop signs on Cerro Romauldo to improve bicycle throughput, if staff believes this can be accomplished pursuant to applicable engineering standards and without increasing collision risk. 3. To support the pavement plan with the recommendation that staff pay addit ional attention to the Atascadero/Oceanaire/Madonna section to make that segment safer for students, including staff consideration for the feasibility of adding a dedicated two-way protected bikeway on Oceanaire between Atascadero Street and Madonna Road. 4. That the committee is in agreement with the proposed plan for Marsh Street as City staff presented at the February 24, 2022, ATC meeting and should proceed as proposed. Policy Context The project directly supports several key City plans, policies and goals. The complete street components of the project support the recommendations of the Downtown Concept Plan and Active Transportation Plan—with installation of protected bike lanes and priority pedestrian/bicycle crossings along Marsh and Higuera St reets identified as Tier 1 (highest-priority) projects in the Active Transportation Plan. Neighborhood greenways and safe routes to school planned in Paving Areas 6 and 7 are also consistent with the Active Transportation Plan, the Bishop Peak and Pacheco Safe Routes to School Plan and Neighborhood Traffic Management Program. The improvements also indirectly support the General Plan mode share targets and recommendations of the City’s Climate Action Plan for Community Recovery to improve active transportation and reduce reliance on single-occupant vehicles. The project also supports the current Sustainable Transportation and Climate Action Major City Goals. Page 410 of 984 Item 5h Consistent with the October 2018 Purchasing Policy Update to the July 2015 Financial Management Manual, Council approval must be obtained before this proceeding with this project, as approval is required for Public Projects that cost over $175,000. Public Engagement Public engagement was conducted during the initial identification of this Project to be included in the 2021-23 Financial Plan. Concepts for the proposed complete street elements in the downtown core were included in the Downtown Paving Project 2021-22 community engagement, which included a virtual community meeting February 25, 2021, a presentation to the Downtown SLO Response and Recovery Board Meeting January 11, 2021, and updated information on a dedicated project webpage www.slocity.org/downtownpavingproject. For this Roadway Sealing 2022 project, a community-wide virtual workshop was held on October 7, 2021 to inform the public of the project scope and to request input on proposed designs. Based on community input from this meeting, additional corridors were identified for traffic calming elements consistent with City policies , programs and planning documents. Three neighborhood surveys were conducted in order for staff to gauge the neighborhood support for additional traffic calming on Oceanaire Drive, Meinecke Avenue and Lincoln Street. All neighborhoods demonstrated a majority support for traffic calming. Additionally, staff continues to be in coordination with Downtown SLO, San Luis Obispo Regional Transit Authority, San Luis Garbage and other partners. Updated project information has been maintained throughout the planning and design phase at www.slocity.org/2022pavingplan. Note that construction of the Roadway Sealing 2022 is one of five Capital Projects that will benefit and impact the Foothill neighborhoods north of downtown throughout the summer and fall of 2022, including the Anholm Neighborhood Greenway (tentatively re- named Cerro San Luis Greenway, pending Council concurrence), Area 6 and 7 Curb Ramps Installations, Verde/Luneta/Ramona/Broad Sewer Replacement and North Broad Street Neighborhood Park. A communications plan will be ongoing during these projects to ensure cohesive and efficient implementation and keep residents and commu ters informed throughout. Page 411 of 984 Item 5h CONCURRENCE This project has been reviewed and has concurrence from Public Works including the Transportation Manager, Parking Manager, SLO Transit Manager and City Engineer. Additionally, the project has been reviewed and has concurrence from the SLO City Fire Department. The City’s Communications Manager has also reviewed the project and is working with the project team to implement the communications plan. ENVIRONMENTAL REVIEW This project is categorically exempt from environmental review pursuant to section 15301 of the CEQA Guidelines (Existing Facilities) since it is a maintenance and replacement project. A Notice of Exemption will be filed through the Community Development Department. The complete street elements are consistent with the Land Use and Circulation Element as well as the Active Transportation Plan, therefore consistent with the environmental review of those documents. In addition, the types of complete street improvements proposed as part of this Project would all be considered categorically exempt from CEQA in the category of Existing Facilities, maintenance activities. Therefore, no additional environmental review is triggered. If funding is not sufficient to support all of this project’s needs, only portions of the contract would be awarded to reflect the work that can be completed with the available budget. In order to allow for project implementation during the summer months, and to lessen impacts to the traveling public, staff is recommending this project be approved for advertisement now. The Streets Reconstruction and Resurfacing account (90346) has a balance of $185,752, which includes appropriation of the additional $150,000 approved by Council with adoption of the Mid-Year Budget on February 15, 2022. Project funding also includes receipt of $3,474,877 in Fiscal Year 2022-23. However, $1,000,000 will have to be transferred back the Capital Project Reserve Fund as described in Council Report authorizing advertising of Area 6 & 7 Curb Ramps approved on 2/15/2022 (Attachment D). Due to the number of multi-modal transportation improvements proposed in this project, the Active Transportation Plan Implementation Account (100502) will contribute $200,000 in Fiscal Year 2022-23 towards this project. Page 413 of 984 Item 5h Curb ramp/bulbout improvements at the intersection of Higuera and Nipomo is proposed to come from the Sidewalk Annual Asset Maintenance Account (90849). Fund ing for storm drain replacement work at intersection of Higuera and Nipomo is proposed to come from the CMP Storm Drain Replacement Account (90742) which currently has a balance of $827,347 and sufficient to support storm drain replacement work. Remaining balance in this account will be used to support the culvert repair at the Broad and Leff intersection. The Parking lot Maintenance account (1000031) has a current balance of $167,069 and will receive an additional $35,000 in Fiscal Year 2022-23. These funds will be sufficient to support the Islay Park Parking Lot maintenance work identified in this project. The Pedestrian and Bicycle pathway Maintenance account (1000032) has a current balance of $5,775 and will receive an additional $150,000 in Fiscal Year 2022-23. These funds will be sufficient to support the Madonna Inn pathway maintenance work identified in this project. ALTERNATIVES Deny authorization to advertise. The City Council may choose not to authorize project advertisement. Staff does not recommend this alternative because this is the ideal time to advertise paving projects for summer construction. Additionally, advertising the project now will positions the City to begin work as early as possible and minimize impacts to the traveling public. Page 495 of 984 NOTICE TO BIDDERS NOTICE TO BIDDERS iv The City reserves the right to reject a responsive bid based on the non-responsibility of the bidder if the Director of Public Works or Designee finds, after providing notice and a hearing to the bidder, that the bidder lacks the 1. knowledge 2. experience, 3. or is otherwise not responsible as defined in Section 3.24 of the San Luis Obispo Municipal Code to complete the project in the best interest of the City. Rejected bidders may appeal this determination. Appeal must comply with the requirements in this Notice to Bidders. Maintain Sales Tax signage in work area. Return Sales Tax signs at the end of the project or upon the Engineer’s request. The Engineer will furnish one (1) GREEN WAY SYMBOL stencil as detailed in Sheet 59 of the project plans. Contractor can obtain additional stencil(s) at its own discretion and must be approved by the Engineer prior to use for this project. Sales Tax signs are stored at the City’s Corporation Yard on Prado Road. The contractor is responsible to load and transport from City Corporation yard to job site. Water to be used in the slurry seal emulsion must be potable water. 7 LEGAL RELATIONS AND RESPONSIBILITY TO THE PUBLIC Add to Section 7-1.03B PUBLIC CONVENIENCE, Traffic Control Plan Unless stated otherwise below, work hours are 7:00 a.m. to 4:00 p.m. (Monday through Friday) at all the affected streets. Unless otherwise approved by Caltrans and the Engineer, work within Caltrans Right of Way must be performed between the hours of 9:00 a.m. to 3:00 p.m (Monday through Thursday) and 9:00 a.m. to 2:00 p.m. Friday. Page 510 of 984 SPECIAL PROVISIONS SPECIAL PROVISIONS 3 SCHOOL ZONES All work within school zones (Appendix C) must be completed as the first order of work. The Contractor must prioritize work in school zones to finish the work before the start of the school year on August 18th, 2022. If these streets within school zones are not completed before school is back in session on August 18th, 2022, these streets will not be allowed full closure. The Contractor will be responsible to provide flaggers and maintain traffic for student drop off and pick up. When school is in session, work hours within school zones are limited to 9:00 a.m. to 2:00 p.m. (Tuesday through Friday) and 9:30 a.m. to 2:00 p.m. on Mondays. AREA 9 Unless stated otherwise below, all work within Area 9 must be completed at night between the hours of 10:00 PM to 8:00 AM (Sunday through Thursday). One lane of travel must be retained at all times. Slurry sealing and striping within Area 9 must start after September 1st, 2022, between normal working hours of 7:00 a.m. to 4:00 p.m. (Monday through Friday). Two lanes of traffic must be retained at all times on Marsh and Higuera. One lane of travel must be retained on all other streets. No work involving heavy equipment (i.e. loud machinery) within Area 9 during the 11:00 a.m. to 1:00 p.m. lunch period. CHANGEABLE MESSAGE SIGNS Contractor shall provide Changeable Message Signs (CMS) for the following locations: One CMS for any US 101 off ramp closure. See Appendix B – Caltrans Encroachment Permit for additional details and requirements. Additionally, two (2) changeable message signs (CMS) must be installed and operational 1 week prior to the start of construction and be maintained throughout the duration of the project at locations approved by the Engineer upon review of the submitted Traffic Control Plan. Changeable message sign shall be programmed for two flashes with the messages to be approved by the Engineer. NIGHT WORK Night work is permitted separately. Night work shall comply with the restrictions set forth in the permit by the City of San Luis Obispo Community Development. Night work is defined as work between the hours of 7:00 P.M. and 7:00 A.M. Page 511 of 984 SPECIAL PROVISIONS SPECIAL PROVISIONS 4 Prior to commencing the project, the contractor must notify businesses and residences within 300 feet of the worksite about proposed night work. Any portable or fixed equipment that produces noise (such as generators, concrete saws, jack hammers, etc.) must be equipped with sound blankets, temporary sound barriers, or other attenuating devices so as to limit impacts to adjoining properties. When not in use, equipment must be kept in its lowest (quietest) idling state or switched off to limit noise impacts. Any portable lighting must be shielded and/or directed away from adjacent properties. Loudspeakers or other similar forms of communication is prohibited. Contractor will provide lighting for all operations, no exceptions are to be made. Any contractor personnel working outside the lights will be directed to return to a lighted area or the operation must be stopped. All contractor work vehicles, including heavy equipment, backhoes, trenching machines must have two working headlights and taillights. Vehicles without appropriate lighting will be kept from working until they are brought to compliance. Illumination level of 10-foot candles is required for all nighttime operations, which will normally be achieved with light plants or balloon lights. All lighting fixtures must be mounted and directed in manner precluding glare to approaching traffic. Provide traffic control plan and traffic control application at or before the preconstruction meeting. Traffic control plan must be drawn to scale. Traffic control application may be obtained on the City’s website: www.slocity.org/government/department-directory/public-works/documents- online/construction-documents Upon approval of the traffic control plan, the City will issue a no-fee Encroachment Permit. Permittee is responsible to comply with all conditions of the traffic control plan. Complete work using due diligence to restore free flowing of traffic. 8 PROSECUTION AND PROGRESS Replace the 1st paragraph in Section 8-1.02A SCHEDULE, General with: Provide a Level 1 schedule for this work. A one week look ahead schedule shall be provided to the Engineer before commencing the following week’s work. This requirement shall be completed in order to continue construction work. Page 512 of 984 SPECIAL PROVISIONS SPECIAL PROVISIONS 5 DIVISION II GENERAL CONSTRUCTION 13 WATER POLLUTION CONTROL Add to Section 13-7.02 Street Sweeping 13-7.02C Construction Street sweeping shall be performed 24 hours and 30 days after application of Type II slurry seal. The Contractor must post streets for no parking in advance and during the 24 hour and 30 day street sweeping. The Contractor must submit a street sweeping schedule for approval by the Engineer. Street sweeping must be done in a manner that street parking is available within 600 ft from affected addresses, unless approved by the Engineer. 13-7.02D Payment The lump sum item price for Street Sweeping shall include full compensation for furnishing all labor, materials, tools, equipment, personnel, “No Parking” notices, door hangers, and incidentals, and for doing all the work involved with Street Sweeping and no additional compensation therefor. 15 EXISTING FACILITIES Add to Section 15-2.02B Remove Pavement (AC Patch Repair) The outline of the area to be removed must be cut on a neat line with a power driven diamond saw to a minimum depth of 4 inches before removing all existing asphalt. As an alternate, the Contractor may use a grinding device such as a “zipper” to remove the AC patch area. All areas of removal must be cut as marked in the field and must be uniform in pattern (square, rectangle). Paving is not to be done without the inspection of the Engineer. A mechanical tamp is to be used for compacting the base or subgrade and bottom lifts of the AC. A roller is to be used for the top lift of AC. Vibrating Plates are not allowed. Any PCC to be used for pavement must be Class 1 mix per Engineering Standard 6040 General Note B to allow same day AC pave out and immediate traffic use. At each location of roadway repair activity, removal and replacement of existing pavement materials are to be performed on the same working day. Additional AC path repair areas and extents may be identified by the Engineer. Pavement repair locations must be field verified by the Engineer before the start of work. Pavement restoration must comply with section 19 and 77. Add Section 15-2.02 Obliterate Roads, Detours, and Surfacing Micro-milling must be utilized for bike lane and at existing curb ramps edge grinds located in slurry pavement treatment. Edge grinding at curb ramps must extend 5 feet, measured perpendicularly beyond the curb ramp landing in both directions. Micro-milling machines shall: Page 513 of 984 SPECIAL PROVISIONS SPECIAL PROVISIONS 6 Be equipped with a micro-milling drum with tungsten-carbide-tipped cutting teeth spaced no greater than ¼ inch apart on center. The configuration of the teeth shall be such that the deviation in elevation between any 2 teeth does not exceed 1/16 inch. Be capable of removing asphalt concrete pavement to a tolerance of +/- 1/8 inch. Be equipped with an automatic grade control system operating in “profile” mode. Micro-milling shall result in a grid-patterned textured pavement surface with longitudinal ridges approximately the same distance apart as the cutting teeth. The ridges shall be consistent in depth, width, and profile. The distance between the top of the ridge and the adjacent valleys shall not exceed 1/8 inch. Add Section 15-2.02B Payment The linear feet price for Edge Grinds shall include full compensation for furnishing all labor, materials, tools, equipment, personnel, and incidentals, and for doing all the work involved with bike lane and at existing curb ramp edge grinds and no additional compensation therefor. Add to Section 15-2.02C(1) Remove Traffic Stripes and Pavement Markings After existing traffic stripes and pavement markings have been removed, temporary striping tabs must be installed and remain in place until slurry operations have begun. DIVISION V SURFACINGS AND PAVEMENTS 37 BITUMINOUS SEALS Add to Section 37-3.02A General Slurry seal must be Type II. Use Polymer Modified Asphaltic Emulsion with 2% latex additive. Add to Section 37-3.03A General Not all frames, covers, grates, or manholes are shown on the Plans. The Contractor is responsible for examining the site of work. A submission of a bid is conclusive evidence that the bidder has investigated the local conditions to be encountered. Add to Section 37-3.03(D)(2)(a) General Locations of bike lane edge grind are shown on the plans. Payment shall be as described in Section 15-2.02B. Replace Section 37-3.03D(4)(a)(i) General Roll all seal material with a pneumatic tire roller, a minimum of three coverages, prior to allowing traffic on the surfaced roads. After placement of seal material surfaced roads must be opened to traffic no later than 3 hours after the seal material has been placed and no later than 4:00 p.m. in the evening. Quantities of seal placed daily must be adjusted to accommodate road-opening schedule. For Madonna Inn Pathway, roll all seal materials with a pneumatic tire roller, a minimum of 4 coverages, prior to opening it to the public. Page 514 of 984 SPECIAL PROVISIONS SPECIAL PROVISIONS 7 A coverage must consist of the number of passes a roller needs to cover the width. A pass must be 1 roller movement parallel to the slurry seal application in either direction. Overlapping passes are part of the coverage being made and are not part of a subsequent coverage. Do not start a coverage until completing the previous coverage. Add to Section 37-3.03D(4)(b) Slurry Seal Thru-traffic lanes must be spread in full lane widths only. Sweeping in such a manner as to remove loosened or shed aggregate particles without damaging the new surface. 39 ASPHALT CONCRETE Add to Section 39-1.0A Summary Contractor must phase milling and pavement operations such that public traffic is not directed to traverse milled surfaces, including remaining asphalt or base material. Contractor must submit phasing plan for review and approval. Add to Section 39-1.02B MATERIALS, Tack Coat All vertical edges to be paved against shall be tack coated. These include, but are not limited to, curb faces, gutter lips, swale edges, cross gutter edges, and asphalt concrete edges. Add to Section 39-6 Payment The contract price paid per square foot of AC patch repairs shall include full compensation for all labor, materials (including hot mix asphalt), tools, equipment and incidentals for completing AC path repairs to the length, depth, and width shown on the plans. Work includes, but is not limited to, saw-cutting, grinding, removal and disposal of existing pavement, compaction of underlaying materials, tack coat, and placement and compaction of asphalt. Page 515 of 984 SPECIAL PROVISIONS SPECIAL PROVISIONS 8 DIVISION VIII MISCELLANEOUS CONSTRUCTION 73 CONCRETE CURBS AND SIDEWALKS Add to Section 73-1.03 Construction You must meet with the Engineer for an average of 1.5 hours total per ramp to complete the following coordination tasks: 1. Before saw-cutting to agree on the limits of demolition and removal. 2. After formwork is set, to verify that grades meet those stated on the Plans. 3. Upon completion of new curb ramp installation to verify finished grades. Curb ramps have been designed to comply with the current Caltrans Standard Plan detail RSP A88A and City Std. 4440. Field modifications to the design plans, if approved by the Engineer, must meet the dimensional and slope requirements of Standard Plan RSP A88A. When measuring the ADA facility’s dimensions and slopes, consider the required dimension or slope to have been met if the recorded individual measurements comply with the following: • Dimensional measurement does not exceed ½-inch from the dimension shown, i.e. ½-inch less than a minimum dimension, or ½-inch greater than a maximum dimension. • Slope measurement does not exceed 0.2 percent from the slope shown. You must give the City a 24-hour notice for inspection of formwork before pouring the concrete. You must calibrate all levels used in construction at the beginning of each work day. You must ensure that new ramp flowlines do not create any "ponding" areas. You cannot saw-cut and demolish more than 2 corners at any given intersection in order to allow pedestrian travel. Curb ramp spandrel design may vary from Engineering Standards, as directed by the Engineer, in order to accommodate ramp landing. You are responsible for storing existing signs and boxes for reuse. Add to Section 73-1.04 Payment As shown on the bid item list, each new curb ramp will be paid in lump sum for all work shown on the plans for the individual corner, unless included in a separate bid item on the bid item list. The lump sum price includes all work shown on the Plans, as specified in the Standard Specifications and these Special Provisions. Contractor shall install temporary reflective tape to crosswalks near schools and for markings in speed bumps prior to opening to traffic. New crosswalk markings shall not be installed until all crosswalk warning signage and flashing beacon systems (if applicable) are installed and operational. Otherwise, temporary signage must be installed to convey “CROSSWALK CLOSED” to the satisfaction of the engineer. The Contractor shall promptly pay any final judgment rendered against the City (and its officers, officials, employees and volunteers) with respect to claims determined by a trier of fact to have been the result of the Contractor’s negligent, reckless or wrongful performance. It is expressly understood and agreed that the foregoing provisions are intended to be as broad and inclusive as is permitted by the law of the State of California and will survive termination of this Agreement. The Contractor obligations under this section apply regardless of whether such claim, charge, damage, demand, action, proceeding, loss, stop notice, cost, expense, judgment, civil fine or penalty, or liability was caused in part or contributed to by an Indemnitee. However, without affecting the rights of the City under any provision of this agreement, the Contractor shall not be required to indemnify and hold harmless the City for liability attributable to the active negligence of City, provided such active negligence is determined by agreement between the parties or by the findings of a court of competent jurisdiction. In Page 521 of 984 APPENDIX APPENDIX 2 instances where the City is shown to have been actively negligent and where the City’s active negligence accounts for only a percentage of the liability involved, the obligation of the Contractor will be for that entire portion or percentage of liability not attributable to the active negligence of the City. ARTICLE V. It is further expressly agreed by and between the parties hereto that should there be any conflict between the terms of this instrument and the bid of said Contractor, then this instrument shall control and nothing herein shall be considered as an acceptance of the said terms of said bid conflicting herewith.
