Authorization to Enroll in the Federal Excess Personal Property Program Item 5i Department: Fire Cost Center: 8501 For Agenda of: 3/15/2022 Placement: Consent Estimated Time: N/A FROM: Keith Aggson, Fire Chief Prepared By: James Blattler, Senior Administrative Analyst SUBJECT: AUTHORIZATION TO ENROLL IN THE FEDERAL EXCESS PERSONAL PROPERTY PROGRAM RECOMMENDATION Adopt a Resolution entitled, “A Resolution of the City Council of the City of San Luis Obispo, California, authorizing participation in the Federal Excess Property (FEPP) Program in accordance with United States Forest Service Cooperative Forestry Assistance Act (CFAA) of 1978.” DISCUSSION The Federal Excess Personal Property (FEPP) program enables certain non -federal organizations to obtain excess federal government personal property. Surplus personal property includes all types and categories of personal property such as computer workstations, office furniture, tractors, trailers, vehicles, and fire equipment. Background The FEPP program refers to Forest Service -owned property that is on loan to State Foresters for the purpose of wildland and rural firefighting. Most of the property originally belonged to the Department of Defense (DoD). Once acquired by the Forest Service, it is loaned to state cooperators for firefighting purposes. The property is then loaned to the state forester, who may then place it with local departments to improve local fire programs. State Foresters and the USDA Forest Service have mutually participated in the FEPP program since 1956. There is no cost to join the FEPP program. The property is free o n a loan basis for as long as the local fire agency needs the equipment as described in Department of Forestry and Fire Protection (CAL FIRE), Materials Management Handbook, section 2700 & 2782, in accordance with the US Forest Service Cooperative Assistance Act (CFAA) of 1978. The only monetary cost to the local fire agency is for repairs and maintenance of property, as well as registration and liability insurance costs for any type of rolling stock (e.g. fire vehicles, trailers, etc.). No weapons or munitions are being requested as part of this Federal Excess Property Program. Page 533 of 984 Item 5i CAL FIRE has been approved as an agent of the United States Department of Agriculture (USDA) Forest Service for administering FEPP as part of the Cooperative Fire Protection Program, which allows the City of San Luis Obispo Fire Department to take custody and use FEPP property for fire or emergency services. The requirement is that FEPP be used at least 90 percent of the time for fire or emergency services . Up to 10 percent planned non-fire use is allowed. The Fire Department recommends participating in this program to allow staff to secure equipment through this program as needs are identified, allowing the City to obtain federal excess property at no cost. To participate, the City Council must pass a resolution (Attachment A) accepting the cooperative agreement between Cal FIRE and the Fire Department and authorize the fire chief to enter into the agreement (Attachment B). Public Engagement This item is on the agenda for the March 15, 2022 City Council meeting and will follow all required postings and notifications. The public will have an opportunity to comment on this item at or before the meeting. ENVIRONMENTAL REVIEW The California Environmental Quality Act does not apply to the recommended action in this report, because the action does not constitute a “Project” under CEQA Guidelines Sec. 15378. Should staff acquire property through this program, any transportation, repairs, registration costs can be absorbed in the approved operating budget for the Fire Department. Page 534 of 984 Item 5i ALTERNATIVES The Council could decide not to enroll in the Federal Excess Personal Property Program. This is not recommended as there is no cost in enrollment into the program and allows the department to secure vital equipment at minimal to no cost and would only serve to enhance the effectiveness of the Fire Department while increasing fiscal sustainability for the City. NOW, THEREFORE, BE IT RESOLVED by the Council of the City of San Luis Obispo that: Page 537 of 984 Resolution No. _____ (2022 Series) Page 2 R ______ SECTION 1. The City of San Luis Obispo accepts the agreement (Exhibit A) between the State of California, Department of Forestry and Fire Protection (CAL FIRE) and the City of San Luis Obispo Fire Department for the loan of Federal Excess Property, and, authorizes Fire Chief, Keith Aggson, to sign the agreement for the City Council.
