HomeMy WebLinkAboutItem 6i - Advisory Body Appointment Vacancies on Jack House Committee, Citizens' Revenue Enhancement Oversight Commission, and Tourism Business Improvement District Board Item 6i Department: Administration Cost Center: 1021 For Agenda of: 5/3/2022 Placement: Consent Estimated Time: N/A FROM: Greg Hermann, Deputy City Manager Prepared By: Kevin Christian, Deputy City Clerk SUBJECT: ADVISORY BODY APPOINTMENTS FOR VACANCIES ON JACK HOUSE COMMITTEE, CITIZENS’ REVENUE ENHANCEMENT OVERSIGHT COMMISSION, AND TOURISM BUSINESS IMPROVEMENT DISTRICT BOARD RECOMMENDATION As recommended by the Council Liaisons, confirm the appointments of Toni Kincaid to the Jack House Committee (JHC), Keith Dunlop to the Citizens’ Revenue Enhancement Oversight Commission (REOC), and Clint Pearce to the Tourism Business Improvement District Board (TBID). DISCUSSION Annual appointments to the various City Advisory Body Committees were made at the March 15, 2022, City Council meeting. The process for those appointments included recruitment by the City Clerk’s office, interviews, and recommendations by the respective City Council sub-committees, with final confirmation of those recommendations made by the full Council. The applications of qualified candidates who are not chosen for immediate appointment are held for one -year for possible consideration in the event an unscheduled vacancy occurs. At the time of annual recruitment, no positions on the TBID were open and therefore recruitment for the board was not included. Following the annual recruitment, two members of the TBID resigned and recruitment was therefore opened to fill those seats. Additionally, due to an insufficient number of qualified candidates, recruitment for the following City Advisory Bodies remained open: Administrative Review Board, Citizens’ Revenue Enhancement Oversight Commission, Construction Board of Appeals, Jack House Committee, Personnel Board, and the Zone 9 board. Subsequently, applications have been received for the JHC, REOC, and TBID. Jack House Committee: The Council Liaison Subcommittee members assigned for the JHC, Councilmembers Marx and Pease, recommend Toni Kincaid to fill the continued vacant term ending March 31, 2025, beginning immediately. Note that there are two additional vacancies on the board: One for the “County Historical Society” representative and one for the Cal Poly faculty with horticultural expertise. Recruitment is ongoing. Page 325 of 395 Item 6i Citizens’ Revenue Enhancement Oversight Commission: The Council Liaison Subcommittee members assigned for the REOC, Councilmembers Marx and Christianson, recommend Keith Dunlop to fill an unscheduled vacancy with a term beginning immediately and ending June 30, 2023. (Note that the REOC terms are for three years and run concurrent with the fiscal year while standard Advisory Body terms are for four years and run April 1 through March 31. Annual recruitment is held with all Advisory Bodies.) Tourism Business Improvement District Board: The Council Liaison Subcommittee members assigned for the TBID, Councilmembers Christianson and Shoresman, recommend Clint Pearce to fill an unscheduled vacancy term ending March 31, 2025, beginning immediately. Note that there is still one additional unscheduled vacancy on the Board with recruitment ongoing. Policy Context The Advisory Body Handbook, last adopted by City Council in September 2021, outlines the recruitment procedures, membership requirements, and term limits for all advi sory bodies. Additionally, the City Council Policies and Procedures Manual, last updated April 2021, describes the “Appointment Procedure” and “Process” for Advisory Body appointments. Recruitment and appointment recommendations were performed in conformance with all recruitment procedures, processes, and bylaws found in these resources. Note that section 6.7.2.5 of the City Council Policies and Procedures Manual allows for the appointment of an Advisory Body member to more than one body which applies to the appointment recommendation for Keith Dunlop as he is currently a member of the Personnel Board. California Government Code Section 54972, Local Appointments List (Maddy Act), requires that on or before December 31st of each year, each legislative body shall prepare and post an appointments list for their boards, commissions, and committees whose members serve at the pleasure of the legislative body. Further GC Section 54974 (a) details the location and timing for posting vacancies. These obligations were met. Note an electronic posting of the Local Appointments list is on-going. Public Engagement Notices that the City was accepting applications for City Advisory Bodies were placed in The New Times, on the City’s website and “e-notification” service, listed in the annual Local Appointments List (Maddy Act Notice – GC 54972) on the City Website and City Information kiosk, and distributed via City social media outlets in November 2021 for the annual recruitment. Further outreach, as listed above, was conducted for the unscheduled vacancies which occurred following the annual recruitment. The costs related to recruitment is accounted for in the annual budget appropriation in the City Clerk program. ALTERNATIVES Council could recommend changes to the sub-committee recommended appointment or direct staff to re-open recruitment for additional candidates. This is not recommended as the Council Liaisons for the committees feel that they have been quite thorough in their consideration of applicant’s qualifications and the Council’s needs in their selection process.
