CEQA EXEMPTION
CEQA Section 15301 provides Categorical exemptions for continued use of existing
facilities operating at the same level of use. The key consideration is whether the
proposed project involves negligible or no expansion of use.
It could be argued that the proposed project is nothing like the previous use (Retail)
and is not operating at the same level of use. Going from the previous retail use
(Daylight Gardens) with hours of operation from 10am to 6pm, with minor vehicular
traffic, and having a minor impact on the surrounding community, to a mulit-vendor
facility that includes a bar/tavern, restaurant, commercial kitchen, live entertainment,
commercial recreation, food trucks, light manufacturing, and social gathering location
with a larger impact to the surrounding community. These new uses are not a negligible
expansion of the former retail use. This project is a completely different animal than
Daylight gardens.
Without adequate environmental review it is not possible to conclude that the
proposed project is compatible with and will not adversely impact get livability of
abutting residential properties and the surrounding neighborhoods.
ORDINANCE NO 1651 SPECIAL CONSIDERATIONS
The project as designed does not adequately address the special considerations
overlay and does not comply with Ordinance No 1651 Sections 4,6 and 7.
As it's designed it does not adequately address potential impacts related to lighting
and glare, noise, and traffic impacts.
Parking and outdoor recreational uses proposed are not adequately buffered from the
creek and adjacent residences in a manner which mitigates potential offsite impacts.
The current chain link fence does not block headlights from cars parked facing in the
creek and shining into neighboring homes. The metal fence surrounding the outdoor
recreational uses in zones A, D and E.
Outdoor recreational uses are not buffered by the existing building on the east side and
the existing fencing will not mitigate noise.
Prior to approval of the project the site plan should show the proposed commercial
truck circulation and delivery areas, mobile food vendor truck storage and staging
areas in order to ensure compliance with the noise ordinance Section 9.12.050 #5
Loading and unloading: Loading unloading, handling of boxes creates and containers
between the hours of 10pm and lam in such a manner as to cause a noise disturbance
across a residential real property line or at any time in violation of the provision of
Section 9.12.060: Prohibited Acts.
NOISE STUDY REQUIREMENT
Without a noise study how can you adequately determine that the project will operate
in a way that is designed to minimize potential impacts related to noise exposure on
the adjacent residences.

In the staff report under Live entertainment it states that the applicant is proposing to
utilize door security and provide at least 1 staff member per 50 patrons for crowd
management, Is this going to become a concert venue? How many patrons are
allowed in the indoor recreational area? What is the occupancy load?
It states that music acts are intended to be supplementary to the existing ambiance-
