Vix 1787 Conejo Avenue San Luis Obispo, CA 93401 Marlin (805) 748-9549; mvix@calpoly.edu Cynthia (805) 748-9551; cindyvixslo@gmail.com May 7, 2022 Re: Response to File Number USE-0103-2022 Monterey Street Brewing Company, LLC - Applicant Attention: Planning Commission City of San Luis Obispo Dear Commissioners: Our first concern is the sweeping view by Staff that the proposed use of the property is “Categorically exempt from environmental review under CEQA Guidelines section 15301 (Existing Facilities.)” This project, in very few ways, resembles the previous use of the property by Daylight Gardens. The hours of operation, the number of individual vendors, the use of the property, the impact on the environment, the assumed increase in traffic flow, the hours of operation, and the increase in noise will be significantly greater. We believe that a proper CEQA study, and not one that is full of “Neg Decs” is not only appropriate but necessary. Our specific concerns are the following: • The bar/tavern will be open until 11:00 p.m. daily. What is likely to happen is the patrons will not be served after 11:00 p.m. and the hours of operation more specifically should be regarded as “When the last patron leaves af ter having been served at 11:00 p.m.” Therefore, the tavern would be open much later than 11pm. • Allowed and Allowed with Minor Use Permit approval (1.0 PLANNING COMMISSION PURVIEW) Ax throwing, board games, chess/checkers, etc., we argue will have limited appeal and are events that do not have a predictable future. We would be curious to learn if the Commission has been provided with marketing data to indicate that this is the appropriate venue for such activities. If these specifically stated tenants or activities do not succeed, then what happens? If it is up to the Landlord to find new tenants that meet the Planning Commission’s approval, since the initial approval was for specific tenants, what role will the Planning Commission play in approving a new tenant? • Live Entertainment It is commendable that the hours and days of operation (1:00 a.m. - 8:00 p.m. on Thursdays through Sundays) are limited, however, what will be done to enforce these days and times by the Planning Commission? Limiting live “entertainment within the proposed indoor recreational area” is also commendable, however, we are concerned that unless the building has adequate air conditioning, the doors and windows will NOT remain closed on limited days and hours, thereby causing unintended noise. • Ordinance No.1651 (2018 Series) We are concerned that this excellent ordinance is not being adhered to by the Planning Staff Other neighbors are addressing the noise, light, and environmental issues associated with this project, however, we are concerned about these issues and look forward to learning of your level of concern.
