RE: California Public Records Law, SB 1421 and SB 16
Pursuant to the Cal. Gov't Code Secs. 6250 through 6276.48, Senate Bill 16 and Senate Bill 1421 I am
requesting digital copies of the following records, or other matters1,, for noncommercial purposes, from
the San Luis Obispo Police Department Records:
●The investigative report regarding San Luis Obispo Police Department Detective Luca Benedetti
●All public records and materials pertaining to the death of San Luis Obispo Police Department
Detective Luca Benedetti and civilian death of Eddie Giron on May 10, 2021
According to SB 16, Sec. 3, which came into effect January 1, 2022, these records to be released
include “all investigative reports; photographic, audio, and video evidence; transcripts or recordings of
interviews; autopsy reports; all materials compiled and presented for review to the district attorney or to
any person or body charged with determining whether to file criminal charges against an officer in
connection with an incident, whether the officer’s action was consistent with law and agency policy for
purposes of discipline or administrative action, or what discipline to impose or corrective action to take;
documents setting forth findings or recommended findings; and copies of disciplinary records relating to
the incident, including any letters of intent to impose discipline, any documents reflecting modifications
of discipline due to the Skelly or grievance process, and letters indicating final imposition of discipline or
other documentation reflecting implementation of corrective action. Records that shall be released
pursuant to this subdivision also include records relating to an incident specified in paragraph (1) in
which the peace officer or custodial officer resigned before the law enforcement agency or oversight
agency concluded its investigation into the alleged incident.”
As a representative of the news media, specifically the San Luis Obispo Tribune, please waive any fees
for record retrieval or copying associated with this request. Release of this information is in the public
interest, because it will contribute significantly to understanding of San Luis Obispo County’s law
enforcement.
If there are ever fees associated with compiling or transmitting these records, please contact us so we
can make appropriate arrangements.
If there are any segregable portions of the records responsive to this request available before the
entirety, please provide those as they become available.

records or other matters being denied.
