SUBJECT: ITEM #5f – AUTHORIZATION TO ACCEPT CARPETING DONATION THE
HISTORY CENTER OF SAN LUIS OBISPO COUNTY
Staff received a question asking for clarification on the process of the donor donating to
the History Center for the carpeting replacement.
The donor will make the monetary donation for the carpet project to the History Center,
who would in turn make a donation of new carpeting and associated labor to the City.
There could be many underlying benefits to providing a donation to the History Center
and not directly the City. The three that were identified by staff are as follows:
1. The City has an agreement with the History Center to maintain and manage the
property and they are best positioned to receive the donation and honor the wishes
of the donor to quickly replace the carpet.
2. The donor could possibly receive a tax benefit as a direct donation to the City is
not tax deductible. This path would involve the History Center, the donor, and the
IRS. There are no legal underlying concerns with staff’s recommendation.
3. With the History Center taking the lead on this project and not the donor, the donor
would not be required to enter into an agreement with the City and provide the
necessary insurance requirements.
