HomeMy WebLinkAbout7/19/2022 Item 7c, Hill Via E-mail Only emailcouncil@slocity.org July 19, 2022 Attn: Mayor and City Council City of San Luis Obispo 990 Palm Street San Luis Obispo, California 93401 SUBJECT: Council Agenda Report Item 7c for 07/19/2022 Community Workforce Agreement In ecommendation to Proceed with the Cultural Arts District Parking Structure without a CWA Dear Honorable Mayor and City Council: Earth Systems appreciates this opportunity to submit our comments to Council related to the evaluation of a Community Workforce Agreement the Cultural Arts District Parking Structure as part of the C Resiliency & Fiscal Sustainability. report, the parties were unable to reach a consensus on three fundamental provisions of concern that were expressed by Council, Staff, and public comments regarding the adoption of a CWA to its public works projects. At the April 19, 2022 City Council Meeting, its Staff outlined a very thoughtful, methodical and collaborative approach on how the City could potentially adopt a CWA , and was provided clear direction and support from Council on how to proceed. In keeping with having a CWA for the Cultural Arts District Project, and further, the upside would be that the project could proceed as scheduled ic recovery efforts. City Attorney and Community Services Group, to acknowledge that a CWA shall not apply to the Cultural Arts District Project Structure so as to not to cause any unnecessary delay on this project, and if directed to continue its discussion with the Trades for the two other legacy projects, to support its Staff by not departing from Councilestablished resolution to: (1) exempt inspection, testing, surveying, and construction management services procured through professional services from the scope of the CWA; (2) include the 60% local worker participation goal; and (3) limit the 5-year term with no exception. Deviation from these fundamental provisions in the CWA could lead to potentially decreas objective of employing local workers. The Staff report at the April 19, 2022 City Council Meeting clearly outlined the pitfalls of relying on a CWA as a guarantee to have only local workers on the projects.
