POSITION TO THE CITIZENS’ REVENUE ENHANCEMENT OVERSIGHT
COMMISSION, TWO POSITIONS TO THE TOURISM BUSINESS
IMPROVEMENT DISTRICT BOARD
RECOMMENDATION
Confirm the appointments of Anthony Bozzano to the Citizens’ Revenue Enhancement
Oversight Commission (REOC), along with Lydia Bates and Prashant Patel to the
Tourism Business Improvement District Board (TBID).
POLICY CONTEXT
The Advisory Body Handbook, last adopted by City Council in September 2021, outlines
the recruitment procedures, membership requirements, and term limits for all advisory
bodies. Additionally, the City Council Policies and Procedures Manual, last updated April
2021, describes the “Appointment Procedure” and “Process” for Advisory Body
appointments. Recruitment and appointment recommendations were performed in
conformance with all recruitment procedures, processes, and bylaws found in these
resources.
California Government Code Section 54972, Local Appointments List (Maddy Act),
requires that on or before December 31st of each year, each legislative body shall prepare
an appointments list for their boards, commissions, and committees whose members
serve at the pleasure of the legislative body. This obligation was met and is on -going.
DISCUSSION
Annual appointments to the various City Advisory Body Committees were made at the
March 15, 2022 City Council meeting. The process for those appointments included
recruitment by the City Clerk’s office, interviews, and recommendations by the respective
City Council sub-committees, with final confirmation of those recommendations made by
the full Council.

The applications of qualified candidates who are not chosen for immediate appointment
are held for one-year for possible consideration in the event an unscheduled vacancy
occurs. Several vacancies on various advisory bodies have occurred an d no candidates
remain from the annual recruitment for these vacancies.
Citizens’ Revenue Enhancement Oversight Commission: The REOC has unique term
lengths and appointment dates that differ from the Advisory Body standard. Terms are for
three years and run on a fiscal year cycle beginning in July. One seat was open following
the end of a scheduled term, July 1, 2022, but there were not enough applicants in the
annual recruitment to fill this vacancy at that time. Therefore, recruitment was held open
continuously since the annual recruitment cycle to obtain applicants. The Council Liaison
Subcommittee members assigned for the REOC, Councilmembers Marx and
Christianson, recommend Anthony Bozzano to fill a three-year term ending June 30,
2025, beginning immediately.
Tourism Business Improvement District Board: Due to recent resignations from the TBID,
there are two unscheduled vacancies. The Council Liaison Subcommittee members
assigned for the TBID, Councilmembers Christianson and Shoresman, recommend Lydia
Bates to assume the vacant term ending March 31, 2024, and Prashant Patel to assume
the vacant term ending March 31, 2025.
Advisory Body Vacancies Update: The following advisory bodies have ongoing
vacancies:
Administrative Review Board (ARB): There is currently one vacancy on this three-
member board. No applications are currently under review.
Construction Board of Appeals (CBoA): There is one position open for a disability
representative on this seven-member board. No applications are currently under review.
Cultural Heritage Committee (CHC): Due to a recent resignation there is currently one
vacancy on this seven-member committee. Applications are currently being accepted.
Jack House Committee (JHC): There are three Council appointed positions
currently open on this seven-member committee. No applications are currently
under review.
Mass Transportation Committee (MTC): The Cal Poly ASI representative position
is currently open on this seven-member committee. Outreach to the ASI is
underway to request that they provide a nomination for the position.
Parks and Recreation (PRC): Due to a recent resignation, there is currently one
position open on this seven-member commission. Applications have been
received, the recruitment is now closed, and an interview schedule is currently
being created.
Planning Commission (PC): Due to recent resignations there are two currently
open positions. With several applications received thus far, recruitment remains
open to insure a qualified applicant base for sub -committee review.
Zone 9: The Citizen-at-large “Alternate” position is currently open for this three-
member committee. Each of the three positions are to have a designated alternate.
No applications are currently under review.

Public Engagement
Notices that the City was accepting applications for City Advisory Bodies were placed on
the City’s website and “e-notification” service, listed in the annual Local Appointments List
(Maddy Act Notice – GC 54972) on the City Website and City Information kiosk, and
distributed via City social media outlets, in November 2021, for the annual recruitment.
Notices were posted in the City Information kiosk outside City Hall and on the Advisory
Body Vacancies page of the City website alerting the public that the City was specifically
accepting applications for the REOC and TBID, following Maddy Act guidelines,
continuously since November for the REOC and when the vacancies occurred for the
TBID. An update on City Advisory Body openings was published via “City News” (City
website e-notification) in April and current openings were announced during the 2022
Community Academy.
CONCURRENCE
The Council liaisons for the REOC and the TBID concur with the recommendations.
ENVIRONMENTAL REVIEW
The California Environmental Quality Act does not apply to the recommended action in
this report, because the action does not constitute a “Project” under CEQA Guidelines
Sec. 15378.

Advisory body members serve as volunteers and donate their time. The costs related to
recruitment is accounted for in the annual budget appropriation in the City Clerk program.
ALTERNATIVES
Council could recommend changes to the sub-committee recommended
appointments or direct staff to re-open recruitment for additional candidates. This
is not recommended as there were sufficient qualified candidates for the positions, and
the Council Liaisons for the committees feel that they have been quite thorough in their
consideration of applicants and the Council’s needs in their selection process.
