SUBJECT: FY 2022-23 GRANT APPLICATIONS FOR THE EDWARD BYRNE
MEMORIAL JUSTICE ASSISTANCE GRANT, ALCOHOLIC BEVERAGE
CONTROL, OFFICE OF TRAFFIC SAFETY, AND LAW ENFORCEMENT
MENTAL HEALTH AND WELLNESS ACT
RECOMMENDATION
1. Authorize staff to submit grant applications to the following entities:
a. FY 2022-23 Edward Byrne Memorial Justice Assistance Grant in the amount of
$15,107 for protective police equipment
b. FY 2022-23 Department of Alcoholic Beverage Control – Office of Traffic Safety
Local Enforcement Grant Program in an amount not to exceed $50,000
c. FY 2022-23 Office of Traffic Safety in the amount not to exceed $123,000
d. FY 2022-23 Law Enforcement Mental Health and Wellness Act grant in the amount
of $50,000
2. Adopt a Draft Resolution entitled, “A Resolution of the City Council of the City of San
Luis Obispo, California, Authorizing Grant Applications for Funding Provided Through
the Department of Alcoholic Beverage Control-Office of Traffic Safety Through the
National Highway Traffic Safety Administration to Increase Education and Enforcement
Programs Focusing on Underage Drinking]” authorizing the City Manager to enter into a
contract with the State as required by the Alcoholic Beverage Control – Office of Traffic
Safety Local Enforcement Grant; and
3. If the grants are awarded, authorize the City Manager or his designee to execute grant
related documents and authorize the Finance Director to make the necessary budget
adjustments upon the award of the grant.
POLICY CONTEXT
The recommended actions are consistent with the City of San Luis Obispo’s Financial
Management Manual, Section 740 - Grant Management Policy. The policy states that
Council must approve all grant applications in excess of $5,000 and delegates receipt and
contract execution to the City Manager.

DISCUSSION
California Office of Traffic Safety
The California Office of Traffic Safety (OTS) provides grant funding to agencies each year
aimed to prevent deaths and injuries on our roadways through special enforcement and
public awareness efforts. Grant funding helps the City’s ongoing effort to improve traffic
safety and quality of life in our community.
The department has been awarded funding from the Office of Traffic Safety for well over
twenty years. OTS grant funding has enabled the Police Department to conduct numerous
operations specifically focused on alcohol or drug impaired drivers. For FY 2022-23, an
application was submitted for grant funding in the amount of $122,145. If awarded, grant
funds will be used for overtime costs associated with the following activities: DUI
Checkpoints, DUI Saturation Patrols, Traffic Enforcement, Distracted Driving, and
Pedestrian and Bicycle Enforcement. If Council denies this request, the application can be
withdrawn.
Law Enforcement Mental Health and Wellness Act
Funding from the Law Enforcement Mental Health and Wellness Act grants are used to
improve the delivery of and access to mental health and wellness services for law
enforcement officers. The grant is competitive and there are no City match requirements.
The department submitted an application requesting funds in the amount of $50,000 to
expand training opportunities for the department’s Peer Support Team and to provide
professional mental health services to department personnel. The department is dedicated
to investing in the mental health and wellness of personnel (both sworn and civilian).
Encouraging mental health and overall well-being provides employees an accessible path
to cope with occupational stressors, which ultimately leads to enhanced service to the
community. Although the grant application has already been submitted online due to timing
and grant application deadlines, the award can be declined if Council denies this request.
Edward Byrne Memorial Justice Assistance Grant
The U.S. Department of Justice Edward Byrne Memorial Justice Assistance Grant (JAG)
Program is the primary provider of federal criminal justice funding to the State and local
jurisdictions. The JAG Program is a non-competitive formula grant, and the funding
allocation is based on the population and crime rate of the local jurisdiction. The amount
available to the City of San Luis Obispo for 2022 is $15,107.
The grant application deadline was August 8, 2022, if necessary, staff can withdraw the
application or decline the award if the request is denied. The department intends to use
grant funding to purchase 24 specialized rifle rated ballistic vests which would be
assigned to each department vehicle. Overall, these vests will aid and better protect
officers that may be called to rapidly respond to an active shooter situation in a publicly
accessible area, which would place first responders and community members at
significant risk for loss of life. These vests would be in addition to the mandatory ballistic
vest officers wear on duty.

Alcoholic Beverage Control – Office of Traffic Safety Local Enforcement Grant
The Alcoholic Beverage Control – Office of Traffic Safety Local Enforcement Grant Program
(ABC-OTS) awards grants up to $50,000 to local law enforcement agencies to utilize the
Minor Decoy and Shoulder Tap programs. This grant is sponsored by OTS through the
National Highway Traffic Safety Administration and managed by ABC. The overall goal of
the program is to deter underage drinking. The department intends to utilize grant funds for
overtime to conduct various operations associated with alcohol enforcement and education.
Grant materials were posted on the ABC website on August 2, 2022, and the deadline to
submit an application is September 2, 2022.
Public Engagement
This item is on the agenda for the September 6, 2022, City Council meeting and will follow
all required postings and notifications. The public may have an opportunity to comment on
this item at or before the meeting.
CONCURRENCE
The Director of Finance concurs with staff’s recommendations.
ENVIRONMENTAL REVIEW
The California Environmental Quality Act does not apply to the recommended action in this
report because the action does not constitute a “Project” under CEQA Guidelines Section
15378.

ALTERNATIVES
Do not submit grant applications or decline funding. This alternative is not
recommended. These grants provide funding for specialized equipment purchases and
overtime for targeted education and enforcement opportunities. Without grant funds the
department would not be able to carry out these types of programs which increase safety in
our community.

A RESOLUTION OF THE CITY COUNCIL OF THE CITY OF SAN LUIS
OBISPO, CALIFORNIA, AUTHORIZING GRANT APPLICATIONS FOR
FUNDING PROVIDED THROUGH THE DEPARTMENT OF
ALCOHOLIC BEVERAGE CONTROL – OFFICE OF TRAFFIC SAFETY
THROUGH THE NATIONAL HIGHWAY TRAFFIC SAFETY
ADMINISTRATION TO INCREASE EDUCATION AND ENFORCEMENT
PROGRAMS FOCUSING ON UNDERAGE DRINKING AND
AUTHORIZING THE CITY MANAGER TO EXECUTE ALL RELATED
GRANT DOCUMENTS
WHEREAS, the San Luis Obispo Police Department (the “Police Department”)
through the City of San Luis Obispo desires to undertake programs to increase
education and enforcement to deter underage drinking; and
WHEREAS, the Police Department submitted a grant through the Department of
Alcoholic Beverage Control (ABC), sponsored by the Office of Traffic Safety (OTS),
through the National Highway Traffic Safety Administration (NHTSA), in September
2022 to conduct education and enforcement activities to deter underage drinking; and
WHEREAS, on August 2, 2022, the Police Department was notified of the ABC-
OTS Local Enforcement Grant opportunity in an award amount not to exceed $50,000;
and
NOW, THEREFORE, BE IT RESOLVED by the Council of the City of San Luis
Obispo as follows:
SECTION 1. The Chief of Police or his designee is hereby authorized to submit
grant applications consistent with program requirements to pursue a grant administered
by ABC-OTS, including the Police Department's September 2022 application.
SECTION 2. The City Manager of the City of San Luis Obispo is authorized to
execute all grant related documents, including the State of California Standard
Agreement, any extensions or amendments thereof, and any subsequent contract with
the State in relation to the ABC-OTS Local Enforcement grant administered by ABC.
SECTION 3. Authorize Finance Director to make the necessary budget
adjustments upon the award of the grant.
SECTION 4. The City agrees that any liability arising out of the performance of
this contract, including civil court actions for damages, shall be the responsibility of the
grant recipient and the authorizing agency and acknowledges that the State of California
and ABC disclaim responsibility for any such liability.

SECTION 5. Grant funds received hereunder shall not be used to supplant
expenditures controlled by this body.
SECTION 6. This award is not subject to local hiring freezes.
