Mr. Walter, This correspondence is in response to your ADA complaint dated October 21, 2020 concerning a parking lot located at 699 Monterey Street. Your three items identified in your complaint were: 1. Issues with the parking lot's curb, gutter, and sidewalk along Monterey and Broad Streets including the driveway approach on Monterey Street 2. No off-street ADA compliant parking spaces provided 3. Shoddy construction of existing frontage improvements The City takes these matters seriously and has conducted a thorough review. 1. Issues with the parking lot at 699 Monterey Street’s curb, gutter, and sidewalk along Monterey and Broad Streets including the driveway approach on Monterey Street Based on site review of this parking lot's curb, gutter, and sidewalks along Monterey Street and Broad Street the following ADA deficiencies were identified: 1. The cross slope of the driveway approach is in excess of allowed maximum. 2. The curb ramp at the intersection of Monterey and Broad Street does not meet current requirements including the use of truncated domes and a concrete lip that is in excess of allowed maximum vertical deviation. 3. There are several utility vaults in the sidewalk along Monterey Street with vertical deviations. To address this need the City will replace the existing driveway apron with an ADA compliant driveway apron, add truncated domes to the curb ramp on Monterey/Broad Street and grind the lip of the ramp and put utilities on notice to address vertical deviations. 2. No off-street ADA compliant parking spaces provided The off-street parking lot at 699 Monterey Street does not have any marked ADA parking spaces. This is for two reasons. The first, is the off-street parking lot was constructed prior to the enactment of ADA in 1990. The second is that the existing parking lot slope is in excess of allowable slopes for ADA parking facilities which the City will look at addressing if the parking lot is altered or reconstructed. To provide ADA compliant accessible parking in the vicinity at this time, the City will mark an adjacent on-street parking space or spaces as ADA compliant accessible parking. 3. Shoddy construction of existing frontage improvements Shoddy construction is not a term that is defined by ADA. The existing improvements located on Monterey Street and Broad that serve 699 Monterey Street met the standards for installation at the time they were installed. However, as noted in response to item 1 above, the City will replace the existing driveway apron with an ADA compliant driveway apron and add truncated domes to the curb ramp on Monterey/Broad Street to bring the frontage improvements to the parking lot up to current ADA standards.
