Dear Council:
I am absolutely appalled by the recent decision by this so- called "administrative law judge" regarding the people's vote
on arbitration. The people have spoken. We voted it in, we voted it out. My experience in the past with administrative
law judges is that they do not know the law as well as they should. PLEASE do not accept his decision and please
appeal.
One other thing to think about. The citizens of this city got behind the action to repeal binding arbitration because of its
impact on the finances of the city. If you have any hope of getting the citizens behind renewal of Measure Y to extend
the sales tax increase, you better think long and hard about not appealing. You choose not to appeal and then take the
position that Measure Y money is go to pay for these outrages fire and police salaries, think twice about getting
organizations like the Chamber to back your renewal request. I know I will fight long and hard to not renew it.

I am shocked and dismayed to learn today that an administrative law judge in Sacramento has decided that
City Council engaged in an "unfair labor practice" when the City Council put to a vote by the people whether
to repeal binding arbitration from our city charter in 2011- Measure B.
This is outrageous and insulting to our city's electorate who voted to repeal binding arbitration by an
overwhelming margin of 73% - 27 %! And yet this same judge let stand Measure A which allows the city to
alter pension benefits?
The salient point is this: The voters established binding arbitration in 2000 and thus the voters should have
the right to repeal binding arbitration as they did - loud and clear - in 2011.
Mayor Marx was a proponent of the repeal of binding arbitration from our city's charter. I fully expect
that the mayor and all 4 city council members will vote unanimously at your special meeting this coming
Monday morning to appeal this decision! Please speak in unison with aloud and clear voice.
Any consideration of the costs to appeal this ruling should be quickly dismissed. The costs of defending this
issue in the courts is miniscule in comparison with the costs our city will face in the future if binding arbitration
is restored.
Remember that in June 2008, an arbiter gave sworn police officers a 30% raise and the same arbiter gave
police dispatchers a 37% raise over a 4 -year contract. You cannot allow control over our city's personnel costs
to ever again be under the control of a judge or arbiter who has no concern nor liability over how we will pay
for their decisions. Please show unity and solidarity on this issue and vote unanimously to appeal this ruling!

My wife and I walked the neighborhoods discussing Measure A & B with voters and a significant majority of the contacts
supported these two measures. The results were obvious with more than 70% support at the ballot box.
Not only were these measures supported by the residents of this city, there are ramifications to the extension of the
Measure Y tax. The current thought is to send the added monies to the general fund. If Measure B is reinstated, then the
next contract negotiation will have access to these additional funds when determining wages and benefits. You do
remember the effect the last binding arbitration had on the distribution of the Measure Y monies. If I am correct, it was
60% capital improvements and 40% staff. This distribution of monies is NOT what was expected when we voted for
Measure Y.
The question of whether we met the "Meet and Confer" process was argued successfully by City Counsel before
Measures A and B were written.
It is your responsibility as representatives of the community to represent us in all city matters. Therefore, our
expectations are that the city will appeal this decision through PERB and the courts.

Dear Mayor Marx and Council Members Smith, Ashbaugh, Christianson and Carpenter,
I understand that an administrative law judge has ruled that the election that resulted in repealing binding arbitration
(Measure B) constituted an 'unfair labor practice' and therefore the voters' decision is invalid because the Council
placed the measure on the ballot without first going through the necessary 'meet and confer' steps. This is an
unfortunate ruling that denies voters the right to modify the City's Charter, regardless of the means by which the
measure is placed onto the ballot. The ruling seems to have placed the ability of the voters to make decisions by freely -
held elections in a place very secondary to matters of process. As such, it seems to attack the very foundations of
democracy.
I urge the Council to appeal this decision, if necessary, all the way to the State Supreme Court. I think this issue should
ultimately be decided by the highest Court in our State, not by an administrative law judge whose ruling may reflect a
very narrow interpretation of process and not fairly balance the rights of voters vs. procedural issues.

I just heard about the PERB decision regarding Measure B of 2011. While I am not a city resident,
encourage you to appeal the decision. Letting the decision stand could have detrimental
ramifications on the city's finances, including impacting the vote on extending the sale tax.

Luis Obispo City Charter.

BINDING ARBITRATION IS UNCONSTITUTIONAL, AND SHOULD BE ELIMINATED, PLEASE,
SLO City Council had to eliminate $1.6 million in street and sidewalk improvements, $600,000 in flood protection
projects, $300,000 in parks and open space projects, and $500,000 in public safety projects. The on -going annual cost of
the last arbitration award is $2.5 million.
California courts have already ruled binding arbitration unconstitutional for general law cities.
Please adopt this. The costs to our city are unconstitutional with binding arbitration.
