In accordance with SLOMC 9.10.130 A, “each commercial cannabis business shall allow city of San Luis Obispo officials to have access to the commercial cannabis business’s books, records, accounts, and any and all data relevant to its permitted activities for the purpose of conducting an audit, examination or inspection.” Dustin Tardiff also noted in the initial response from MOM SLO, LLC provided to the City August 31, 2021, that “Any documents can be provided on request, subject to confidentiality.” To that end, please respond with copies of the following documents for City review: 1. 2019 Convertible Promissory Note – “Dayspring Note” 2. 2019 Management Services Consulting Agreement between MOM SLO, LLC and SLO Retail Management, LLC 3. Dayspring Assignment & Termination 4. Non-Compete Agreements entered into by members of MOM SLO, LLC 5. Management Services Agreement between MOM SLO, LLC and MOM USA LLC 6. Tarrah Graves Employment Agreement 7. All Financial Interest Holder Documentation submitted to the state. Please have a designated representative submit copies of the documentation, no later than 5:00 PM, February 4, 2022, to City_Attorney@slocity.org or in such other manner that we may mutually agree is appropriate to address any confidentiality concerns regarding any information you may submit. Documentation should be submitted with an attestation as to the truthfulness of the information submitted and an acknowledgement that failure to respond or City Request for Additional Information from Cannabis Business Page 2 submission of untruthful responses may be deemed a violation of the City’s Municipal Code and a violation of the Commercial Cannabis Operator Permit and could constitute a basis for revocation of an operator permit.
