Approve Advisory Body Appointments to MTC, PRC, PC, and Zone 9 Item 6d Department: Administration Cost Center: 1021 For Agenda of: 10/18/2022 Placement: Consent Estimated Time: N/A FROM: Greg Hermann, Deputy City Manager Prepared By: Kevin Christian, Deputy City Clerk SUBJECT: ADVISORY BODY APPOINTMENTS: MASS TRANSPORTATION COMMITTEE, PARKS AND RECREATION COMMISSION, PLANNING COMMISSION, AND ZONE 9 ADVISORY COMMITTEE RECOMMENDATION Confirm the appointments of Franklin Pandoy to the Mass Transportation Committee (MTC), Kari Duperron to the Parks and Recreation Commission (PRC), Justin Cooley and David Houghton to the Planning Commission, and Brian Nelson as Staff Member, and Shelsie Moore as Staff Alternate for City of San Luis Obispo representatives to the San Luis Obispo County Supervisors Zone 9 Advisory Committee (Z9). POLICY CONTEXT The Advisory Body Handbook, last adopted by City Council in September 2021, outlines the recruitment procedures, membership requirements, and term limits for all advisory bodies. Additionally, the City Council Policies and Procedures Manual, last updated April 2021, describes the “Appointment Procedure” and “Process” for Advisory Body appointments. Recruitment and appointment recommendations were performed in conformance with all recruitment procedures, processes, and bylaws found in these resources. California Government Code Section 54972, Local Appointments List (Maddy Act), requires that on or before December 31st of each year, each legislative body shall prepare an appointments list for their boards, commissions, and committees whose members serve at the pleasure of the legislative body. This obligation was met and is on-going. DISCUSSION Annual appointments to the various City Advisory Body Committees were made at the March 15, 2022 City Council meeting. The process for those appointments included recruitment by the City Clerk’s office, interviews, and recommendations by the respective City Council sub-committees, with final confirmation of those recommendations made by the full Council. Page 39 of 161 Item 6d The applications of qualified candidates who are not chosen for immediate appointment are held for one-year for possible consideration in the event an unscheduled vacancy occurs. Several vacancies on various advisory bodies have occurred and no candid ates remain from the annual recruitment for these vacancies. As described under “Public Engagement,” additional outreach was conducted to recruit for these vacancies with the following recommendations for appointment resulting. Mass Transportation Committee: Due to a recent resignation, the MTC has an opening for the Cal Poly ASI representative. This position has a unique term length of two years and an appointment time to coincide with the start of the regular Fall quarter. The resignation fortuitously coincided closely with the specified appointment date for this position. Applicants for this position are required to attain an endorsement from the ASI to be eligible for appointment. The Council Liaison Subcommittee members assigned for the MTC, Councilmembers Shoresman and Pease, recommend Franklin Pandoy to fill a two-year term ending August 31, 2024, beginning immediately. Parks and Recreation Commission: Due to a recent resignation, the PRC has one vacancy. The Council Liaison Subcommittee members assigned for the PRC, Councilmembers Marx and Shoresman, recommend Kari Duperron to fill the remainder of the vacant term, ending March 31, 2023, and to the additional full 4-year term ending March 31, 2027. Planning Commission: The PC has had two recent resignations. The Council Liaison Subcommittee members assigned for the PC, Councilmembers Christianson and Pease, recommend Justin Cooley and David Houghton to fill the remainder of the vacant terms, both ending March 31, 2025. Zone 9: Z9 is an Advisory Body of the County Board of Supervisors (BOS) consisting of six primary members and six alternate members. The City of San Luis Obispo has three seats on this Advisory Body that are appointed by the City Council with each seat having both a primary designated member and an “alternate” designated member. These seats are for City Council, City Staff, and a Public Member appointment. Terms are four years in length and run January 1 through December 31. Public Works Directory, Matt Horn, recommends Brian Nelson, Deputy Director Public Works/City Engineer, as Staff Member, and Shelsie Moore, Engineer III, as the Staff Alternate, each to a 4-year term ending December 31, 2026. Note that there is currently an unscheduled vacancy for the Public Member Alternate which has been vacant since the annual recruitment period with recruitment ongoing. (Also note that City Council assignments will be made during the annual Council Liaison Subcommittee Assignment process, to be completed January 2023.) Page 40 of 161 Item 6d Public Engagement Notices that the City was accepting applications for City Advisory Bodies were placed on the City’s website and “e-notification” service, listed in the annual Local Appointments List (Maddy Act Notice – GC 54972) on the City Website and City Information kiosk, and distributed via City social media outlets, in November 2021, for the annual recruitment. Notices were posted in the City Information kiosk outside City Hall and on the Advisory Body Vacancies page of the City website alerting the public that the City was specifically accepting applications for the MTC, PRC, PC and Z9, following Maddy Act guidelines as vacancies occurred. The Z9 notice has been continuous since the annual recruitment. An update on City Advisory Body openings was published via “City News” (City website e- notification) and City Social Media outlets in April, July, and August 2022. Current openings were also announced mid-year during the 2022 Community Academy and most recently included in the Council Agenda Report for Advisory Body Appointments in the September 6, 2022, City Council Agenda report. CONCURRENCE The Council liaisons for the MTC, PRC, and PC, concur with the recommendations and the Director of Public Works concurs with Z9 staff recommendations. ENVIRONMENTAL REVIEW The California Environmental Quality Act does not apply to the recommended action in this report, because the action does not constitute a “Project” under CEQA Guidelines Sec. 15378. The costs related to recruitment is accounted for in the annual budget appropriation in the City Clerk program. Page 41 of 161 Item 6d ALTERNATIVES Council could recommend changes to the sub-committee and staff recommended appointments or direct staff to re-open recruitment for additional candidates. This is not recommended as there were sufficient qualified candidates for the positions, and the Council Liaisons for the committees feel that they have been quite thorough in their consideration of applicants and the Council’s needs in their selection pr ocess. Additionally, the staff selections for the Zone 9 committee have the appropriate professional qualifications to represent the City on the Zone 9 committee. Page 42 of 161
