Madam Mayor and Council Members, First of all, I want to say that the proposed update of the 2022 California Building and Fire Codes which was prepared by Michael Loew, Deputy Building Official and Rodger Maggio, Fire Marshal/Chief Building Official is comprehensive and commendable. I appreciate their professional work. But I have a concern about the addition of paragraphs 302.2 and 305.6 in Section 1504.090. These paragraphs add regulations regarding "Hazardous Fire Areas". Paragraph 305.6 gives the Fire Chief the authority to designate an area as a "Hazardous Fire Area" wherever he or she "determines that a fire hazard exists in any area due the presence of flammable material or cover". I submit that this authorization is unduly broad in that almost any area within the City could be said to contain "flammable material or cover". Also, the proposed regulation requires no action on the part of the Fire Chief other than posting notice, prohibiting smoking and potentially closing the area to entry and offers no resolution to the designation. It is not at all clear what the intent is of the proposal. what the consequences are of the designation or what remedies are available to the property owner. I suggest that the proposed paragraphs be either deleted or thoroughly rewritten. Thank you, Robert Vessely 1
