1. CLOSED SESSION: STARTS AT 5:00 PM
A Closed Session of the San Luis Obispo City Council was called to order on
October 18, 2022 at 5:00 p.m. in the Council Hearing room, 990 Palm Street,
San Luis Obispo by Mayor Stewart.
1.a CONFERENCE WITH LABOR NEGOTIATORS
Action: City Attorney Dietrick reported that there was no reportable action
for this item.
1.b ADJOURN CLOSED SESSION
Closed Session adjourned at 5:45 p.m. to the Regular City Council Meeting.
2. CALL TO ORDER
A Regular Meeting of the San Luis Obispo City Council was called to order on
October 18, 2022 at 5:47 p.m. in the Council Chambers, 990 Palm Street, San
Luis Obispo, by Mayor Stewart.
3. PLEDGE OF ALLEGIANCE
Vice Mayor Christianson led the Council in the Pledge of Allegiance.
4. PRESENTATIONS
4.a PROCLAMATION - RECOGNITION OF CHRIS MILLER, MANAGING
DIRECTOR OF THE PERFORMING ARTS CENTER
Mayor Stewart presented a proclamation recognizing the retirement of
Chris Miller, Managing Director of the Performing Arts Center.

4.b INTRODUCTIONS - NEW CAL POLY STAFF MEMBERS
City Manager Derek Johnson introduced the following Cal Poly staff members:
• Ryan Gruss, Interim Managing Director of the Performing Arts Center
• Kristin Hoover, Executive Director for the Foundation for the
Performing Arts Center
• Molly Clark, Director of Cal Poly Arts
4.c PRESENTATION - PUBLIC ART SUMMARY FY 2021-22
Parks & Recreation Director Greg Avakian and Recreation Manager
Meghan Burger presented the Public Art Summary for Fiscal Year 2021 -22.

Approve the minutes of the City Council meeting held on October 4, 2022.

6.c SECOND READING OF ORDINANCE NO. 1721 (2022 SERIES) TO
AMEND TITLE 13, CHAPTER 13.12, OF THE MUNICIPAL CODE TO
ADD AN UNDERGROUNDING DISTRICT COMPRISING THE LIMITS OF
THE PRADO BRIDGE REPLACEMENT PROJECT
Adopt Ordinance No. 1721 (2022 Series) entitled, “An Ordinance of the City
Council of the City of San Luis Obispo, California, amending Section
13.12.040 of the San Luis Obispo Municipal Code to Establish a New
Underground Utility District 16.”
6.d APPROVE ADVISORY BODY APPOINTMENTS TO THE MASS
TRANSPORTATION COMMITTEE, PARKS & RECREATION COMMISSION,
PLANNING COMMISSION, AND ZONE 9 ADVISORY COMMITTEE
Confirm the appointments of Franklin Pandoy to the Mass Transportation
Committee (MTC), Kari Duperron to the Parks and Recreation
Commission (PRC), Justin Cooley and David Houghton to the Planning
Commission, and Brian Nelson as Staff Member, and Shelsie Moore as
Staff Alternate for City of San Luis Obispo representatives to the San Luis
Obispo County Supervisors Zone 9 Advisory Committee (Z9).
7. PUBLIC HEARING AND BUSINESS ITEMS
7.a FISCAL YEAR 2021-22 ANNUAL REPORT OF THE TOURISM
BUSINESS IMPROVEMENT DISTRICT (Estimated Time: 30 minutes)
Deputy City Manager Greg Hermann and Tourism Manager Molly Cano
provided an in-depth staff report and responded to Council questions.

1. As recommended by the Tourism Business Improvement District Board,
receive and approve the TBID annual report for FY 2021-22; and
2. Adopt Resolution of Intention No. 11369 (2022 Series) entitled, “A
Resolution of the City Council of the City of San Luis Obispo,
California, declaring its intention to continue the San Luis Obispo
Tourism Business Improvement District, to continue the basis for
and to levy the assessment for the district, and to set a date for the
Public Hearing on the district and the assessment for 2022-23.”

7.b INTRODUCTION OF AN ORDINANCE TO AMEND MUNICIPAL CODE
CHAPTER 9.10 (CANNABIS REGULATIONS) AND ANNUAL CANNABIS
BUSINESS PROGRAM AND REGULATION UPDATE (Estimated Time:
90 minutes)

1. Introduce an Ordinance entitled, “An Ordinance of the City Council
of the City of San Luis Obispo, California, amending Chapter 9.10
(Cannabis Regulations) of the Municipal Code for Commercial
Cannabis Business Businesses and Personal Cultivation” clarifying
the requirements for applying, obtaining, activating, and renewing
commercial cannabis operator permits in the City; with the
following modifications to Ordinance Section 5, Subsection E:
E. Prohibition against Social Equity Owner reductions. Notwithstanding
any other provisions of this subsection, any transfer of ownership
within three years of the permit activation that will result in the
reduction or elimination of the total number of Social Equity Owners
or percentage interest of Social Equity Ownership in the
Commercial Cannabis Business from the number or ownership
percentage proposed in the original Commercial Cannabis Operator
Permit applications is prohibited. This prohibition shall include the
internal transfer of ownership from one currently permitted Operator
to another, and transfers of Social Equity Owner interests of any
kind required both prior notice and approval of the City to verify
compliance with this section. Thereafter, any transfer, at any time,
that would result in reduction of the total number of Social
Equity Ownership percentage in a commercial Cannabis
Business to be reduced below a minimum of 2%, shall be
prohibited.

2. Adopt Resolution No. 11370 (2022 Series) entitled, “A Resolution
of the City Council of the City of San Luis Obispo, California,
approving amendments to the Cannabis Operator Permit Ranking
Criteria” updating the merit criteria used in the evaluation of retail
storefront cannabis business operator permit applications; and
3. Provide direction to staff to further evaluate and return at the next
annual cannabis program update with recommendations
addressing requests to modify specific cannabis retail storefront
rules regarding hours of operation, delivery operations by retail
stores, and age limits for medical cannabis customers.

8. LIAISON REPORTS AND COMMUNICATIONS
Council Member Marx attended the Reach annual meeting on October 5th, the
Tank Farm roundabout ribbon cutting, and the reception for the Norwegian
Consul General.
Mayor Stewart attended the College Corps launch, gave a presentation at SLO
High School to share with students how to get involved in government, attended
the Downtown SLO breakfast update, attended a meeting with Senator Laird
regarding the next steps with Diablo, and the Lumina fun run.
Council Member Shoresman attended the Tank Farm round about ribbon cutting
ceremony and an event hosted by Community Counseling Center at the Dalidio
Adobe for Ellie Axelrod.
9. ADJOURNMENT
The meeting was adjourned at 9:03 p.m. The next Regular City Council Meeting
is scheduled for November 1, 2022 at 5:30 p.m. in the Council Chambers at City
Hall, 990 Palm Street, San Luis Obispo.
