Jeff Jorgensen, City Attorney, contacted me on 2/27/91 with regard to my earlier memo dated 2/25/91,
about a responsible party. He has determined that the City is responsibility for this tank. However, in
further discussing this matter, it is our recommendation that we do not move in an aggressive manner
because of the circumstances that surround this tank, i.e., approximate age of tank; length of time that
tank has been abandoned (not used); inability to determine the exact location of tank, no maps or
records can be located; the tank was said to be small, less than 250 gallons and existing utilities prevent
any type of subsurface investigation. In his opinion, this matter should be deferred until a later date
when some of the above mentioned items can be cleared up.
Background on City's Tank Policy
Current underground storage tank regulations (City Ordinance 999, 1983 series), and the Uniform Fire
Code, allows for the abandonment of underground tanks, providing that certain provisions are met:
1) All product has been removed and disposed of properly.
2) Seals the tank to minimize any threat to the public safety and the environment by
filling with an inert solid material.
3) Shows that the site has been investigated to determine if product was released and
that remedial action has been taken, when required.
4) Documents to the property deed the size, location, method of closure and content of
tank.
However, contrary to these regulations, it has been the City's policy not to allow the abandonment -in -
place of any underground tanks unless their removal threatens the structural integrity of a building,
utilities or other structures. This process is approved by the Fire Chief on case -by -case basis. In my
opinion, this site would fall into that category. The only problem is trying to accomplish the above
mentioned criteria.
Recommendations
Two options are available, "Do nothing" and "D fer to a Later Date." The first option is clear, but by
pursuing the second option, although not meet a law s e ' y, we would be attempting to meet
its intent. Documentation on this matter has been developed which shows what actions have
taken is a nothin hysicaIly has been done. To go one step

RE: Investigation of a Possible Abandoned Underground Tank in the Garden Street Alley
I have been directed by Bob Neumann, the Interim Fire Chief, to look into the matter of a possible
abandoned underground fuel storage tank below the Garden Street alley, adjacent the SLO Brewing
building. However, prior to moving forward with the investigation and mitigation measures, I am
requesting a determination from your office on whether the City has sole responsibility for this site.
This matter was discussed briefly with Cindy Clemens on Monday, 2/25/91.
The Garden Street alley was deeded to the City by Resolution #449 (1958 series) through a Quit
Claim Deed. (see attached) At that time, there were no provisions for disclosing various below ground
structures, like underground fuel tanks. As such, there are no records of this tanks existence, except
for word-of-mouth and a tank vent line at this location. Randy Miller (my predecessor), had first
brought this matter to light in 1987 when he had contacted one of the prior owners/occupants, John
Hanna of Hanna Hardware, 1119 Garden Street. He stated that the tank in -question had contained
gasoline and that it was located in the alley. Also, that it had not been used for over 35 years. It had
a hand pump that was located inside the exit doorway of the now SLO Brewing building. Mr. Hanna
believed the tank was installed in the 1920's. Randy Miller had also contacted the City Attorney, Ann
Russell regarding this matter, but my records show that nothing was ever followed up on.
Currently I have not been able to locate any formal record of this tank and therefore cannot pinpoint
its precise location or size. To further complicate matters (assuming that this tank is located in the
alley), the following utilities run over the tanks suspected location:
1) Gas line
2) PG&E High Voltage lines
3) Cable T.V. line
4) Telephone lines
Of concern is the publics view on how the City is regulating itself with respect to abandoned
underground storage tanks. If you have further questions, please call me at ex: 380.

RE: Abandoned Underground Storage Tank in the Garden Street Alley
Earlier this year, I had discussed with you the matter of an abandoned underground storage tank
located in the Garden Street alley, adjacent to the SLO Brewing Company. The City's Underground
Storage Tank policy requires that these types of tanks be removed from the ground, unless their
removal threatens the integrity of a building and/or utilities. In these cases, documentation measures
would be taken to accurately locate the tank, identify its size and the material it contained, as well as
the method of closure (filled with sand or slurry). This information would then be added to the
property deed.
As the property owner of the alley, the City is responsible for meeting the regulatory provisions for
underground storage tanks. However, because of the lack of information regarding this tank; i.e. exact
location, size and method of closure, in conjunction with the abundance of existing utilities in the area,
it is the position of this department, the administering agency of the Underground Tank Program, that
the following information be attached to official city documents that show ownership of this land.

NOTICE OF ABANDON UNDERGROUND STORAGE TANK
(Garden Street Alley)
1. The purpose of this notice is to serve as a disclosure of information with regard to an
abandoned underground tank located within the Garden Street Alley, adjacent to 1119
Garden St.
2. The Garden Street alley was deeded to the City in by Resolution #449 (1958 series)
through a Quit Claim Deed. At that time, there were no provisions for disclosing various
below ground structures such as fuel tanks. As such, there are no records of this tanks
existence, except for word of mouth and an existing vent line at this location.
3. In 1987 this office had contacted one of the prior owners/occupants of 1119 Garden Street,
John Hanna of Hanna Hardware, who stated that there was a gasoline tank and that it was
located in the alley. Also, that it had not been used for over 35 years. It had a hand pump
that was located inside the exit doorway adjacent to the alley, now SLO Brewing, 1119
Garden Street. Mr Hanna believed the tank was installed in the 1920's.
4. To date, I have not been able to locate any official records of this tank and therefore
cannot pinpoint its precise location or size. To further complicate matters, a gas line,
PG&E cable T.V. and telephone utility lines run over the area of the tanks suspected
location.

RE: Abandoned Underground Storage Tank, Garden Street Alley (Public Right -of -Way)
During a recent inspection of the occupancy located at 1119 Garden Street, it was discovered that an
abandoned underground storage tank is located below the alley, adjacent to the rear of SLO Brewing
Co. Apparently this alley was dedicated to the City some time back, so it is now the City's
responsibility to have it removed. City Ordinance 999 (1983 series), Underground Storage Tank
Regulations, requires any abandoned underground tank to be removed from the ground. (No
Exceptions)
Therefore, in order to address this matter, a plan must be submitted to this office addressing the
removal of this tank. I have attached a copy of a memo from our files that shows the approximate
location of the tank and its contents. It should be noted that the City is currently being scrutinized for
a site that also has abandoned underground tanks, but was not handled properly. So, in order to be
consistent with any other business, removal should be completed within 30 days.
I have included a list of contractors authorized to do this type of work. Assuming that there is no soil
contamination, it is estimated that the total cost of removal and site reconstruction should be between
$3,000 - $5,000, if that. If you have any questions regarding this matter, please call me at ex: 380.
