Dear Archana Pisupati,
I am responding to your Public Records Act request received by the San Luis Obispo
Police Department on February 2,2023 in which you requested:
. Sexual assault complaint filed to the SLOPD against Nathan Abate and Julian
Contreras. Arrest records for Nathan Abate and any update on his charges from last
Thursday. Arrest records for Julian Contreras
Please note the other items in your request will be handled by City departments other
than the Police Department.
Please note that per California law, I am unable to provide all contacts as that is
considered criminal history information per California Penal Code Section 13300. I am
also unable to provide criminal history information to you via Public Records Act request
as the public is not on the list of entities that criminal history information may be released
to (see Penal Code S 13300(bxl)-(17) and $ 13300(c)(1)-(12)).
. Please note that our agency has not arrested either of the named individuals in
your request in the past 10 years. The arrest you are referring to was made by a
different ju risdiction.
Pursuant to Government Code section 7923.600, "Records of complaints to, or
investigations conducted by...any state or local agency...." are exempt from disclosure
so I am unable to release a copy of any reports.
Please also note that the Public Records Act does have specific provisions regarding
the disclosure of law enforcement records when the request is for scholarly, journalistic,
political or governmental purpose, or for an investigation by a licensed private
investigator, however, those provisions are limited to the release of the names and
addresses of arrestees and certain victims. See Government Code section 7923.620.|n
other words, even when the request is for a journalistic purpose, such as yours, the
requestor is not entitled to the full police report, just names and contact information.

As mentioned above we haven't arrested either individual in the past 10 years, and
since any victim information for a sexual assault would be confidential per PC 293, I do
not have any journalistic information to provide.
