I have attached some of the documentation for this removal for your review. The tree removal was approved under the following section of the Municipal Code: 12.24.090 (E) 1. b. The tree is dead, dying, diseased, or damaged beyond reclamation The tree regulations afford the City Arborist with very specific criteria for non-construction removal approvals, and any appeal is then heard by the Tree Committee. A public comment session is provided at Tree Committee meetings for each agenda item, as well as items not on the agenda. The City Arborist currently uses a heavy card stock for public notices, and thanks to your recommendations, I have asked staff to order prelaminated card stock from our local stationary vendor for testing with these public notices. Once we identify a better option, we will permanently implement it. Currently, we add approved removals to the City’s website approximately every two weeks. The website editing timing is mainly due to resource constraints. On 1/12/2023, staff presented an Urban Forest Study Session to the City Council which included a proposed work plan. Council was supportive of the plan, which includes a dedicated Arborist to solely focus on the regulatory aspects of the City’s Urban Forest. Currently, the City Arborist splits their time between maintenance and regulatory functions. This new position is anticipated to start sometime shortly after July 1, 2023, which could potentially expedite updating of the approval website. The 10-day appeal period applies to all administrative decisions made by the City and is bound by section 1.20.030 of the Municipal Code. Appeal fees are established through a comprehensive fee schedule study, which is the cost of staff time to process the appeal. The City is scheduled to conduct a fee study this calendar year. Dear Tree Committee, City Arborist, and Major Stewart, I am writing to comment on the City’s process for reviewing and posting tree removal decisions. I noticed a bent over sign that was no longer visible at 162 Serrano Heights. Because I was concerned about this big beautiful oak tree, I took the time to fold open the sign. I learned that the big oak tree was approved for removal. The sign did not specify the reason for the approval. Looking at the City website I found that the tree is not on the list of tree removal application. I only saw this posting because I happened to walk by and took the time to unfold the sign. I see from the sign that the appeal period ends in three days. I also see that it would cost $135 to appeal to the tree committee for a review of the Arborist decision. I ask the Tree committee to consider the following: 1. Postings should be more durable and not plain paper, which rapidly folds or falls off in anything except perfect weather conditions. 2. If a removal request is approved at the staff level, the appeal period should extend BEYOND the time that it is posted on the City website. It is not reasonable to expect that residents should prowl the neighborhoods looking for removal postings where the appeal period expires before the application is posted on the website. The appeal period should end 10 days after it is posted on the website, not 10 days after a non-visible paper sign is posted. 3. Appeals to the Tree Committee should not cost money. It is economic discrimination for a citizen to need to be wealthy enough to have a “second set of eyes” on a removal decision. In this case, the tree looks healthy and beautiful and I can’t imagine why a native tree would be permitted for removal. I am not a professional, so it seems reasonable for me to ask the Committee to review this decision, but the $135 fee makes that infeasible for me. At one time, only land owners could vote, and this seems very similar. I would expect that this service would be available to all citizens, as our trees are a part of every citizen’s environment. 4. The appeal period should extend BEYOND the date of the next Committee meeting. I would like to speak about this issue to the Committee, but I will not have a chance without paying a fee ($135) for that opportunity. Could the Committee please agendize or consider motions addressing these items? Not sure of your process, but these need to be addressed to be fair, inclusive, and equitable to all citizens. The removal of the mentioned application was submitted based on: San Luis Obispo Municipal Code 12.24.090 (E) 1 b. The tree is dead or dying or diseased or damaged beyond reclamation. Upon inspection of the tree(s), I concur the Coastal live oak tree(s) is dead and has problems that will limit lifespan, and I APPROVE the removal application. Replanting 1 * 24-inch box tree(s) off Master Tree list within 60 days of removal. Owner or Applicant shall submit a photo taken after tree(s) are planted and mailed to Urban Forest Services 25 Prado RD. San Luis Obispo CA 93401 or emailed to City Arborist awhipple@slocity.org is a condition of this approval. California Fish and Game Code Section 3503.5 and the Migratory Bird Treaty Act of 1972. If the nests in the trees marked for removal are active, they will have to have a biologist determine when the young have fledged or if the nest is no longer active. and the City Biologist would need to see a report on that before any tree removals can commence. Depending on when construction is slated to begin, the nesting bird season window is February 1 – August 31st. NOTE: All trees replanted shall be maintained until established as a condition of their Tree Removal Permit.
