For Council’s review and approval is a draft Resolution (Attachment A) terminating the
local emergency declaration regarding the COVID-19 Pandemic, concurrent with the
State of California’s termination on February 28, 2023.

A RESOLUTION OF THE CITY COUNCIL OF THE CITY OF SAN LUIS
OBISPO, CALIFORNIA, TERMINATING THE DECLARATION OF A
LOCAL EMERGENCY FOR THE COVID-19 PANDEMIC EFFECTIVE
FEBRUARY 28, 2023
WHEREAS, on March 4, 2020, Governor Newsom declared a State of
Emergency for the State of California and, thereafter, on March 12, 2020, the San Luis
Obispo County Public Health Officer declared a health emergency due to the COVID-19
pandemic; and
WHEREAS, on March 17, 2020, the City Council of the City of San Luis Obispo
declared a local emergency to exist in the City of San Luis Obispo by Resolution No.
11099 (2020 Series) as a result of conditions of disaster or extreme peril to the safety of
persons and property within the City of San Luis Obispo, as defined by California
Government Code 8558 (c), caused by the COVID-19 pandemic; and
WHEREAS, viral mutations causing successive waves of infection and illness
within United States, the State of California, and the City and County of San Luis
Obispo have continued since that date and Federal, State and City emergency
declarations have remained in place in order to permit ongoing responses necessary to
prevent and address the spread of COVID-19 and its related impacts; and
WHEREAS, the Governor or the State of California has announced that the
COVID-19 State of Emergency will end on February 28, 2023, following the necessary
period to evaluate and respond to infections following the winter holidays; and
WHEREAS, the City has the tools needed to continue fighting COVID-19 when
the State of Emergency terminates at the end of February, including vaccines and
boosters, testing, treatments and other mitigation measures, like masking and indoor
ventilation as necessary for individuals and vulnerable populations to protect
themselves from the most serious impacts of infection and to avoid overwhelming local
medical resources; and
WHEREAS, following the termination of the State of Emergency, the City Council
now determines that the situation resulting from said conditions of disaster or extreme
peril will then be within the control of the normal protective services, personnel,
equipment, and facilities of and within the City of San Luis Obispo.
NOW, THEREFORE, BE IT RESOLVED by the Council of the City of San Luis
Obispo as follows
SECTION 1. The City Council of the City of San Luis Obispo hereby proclaims
the termination of the local emergency, effective concurrent with the termination of the
State of Emergency by the Governor on February 28, 2023.

SECTION 2. All prior actions authorized by the City Council related to the local
emergency shall terminate on such dates following this termination of local emergency,
as previously specified in the emergency resolutions of this Council, including, but not
limited to Resolutions 11231 (permit extensions), 11232 (business support and recovery
measures), and 11264 (economic recovery alignment and safe parking measures)
(2021 Series).
SECTION 3. The City Council of the City of San Luis Obispo hereby authorizes
the City Manager to seek recovery for eligible costs for the City’s response to the
COVID-19 Pandemic and reimburse the City for said expenses.
