Mejia, City Clerk SUBJECT: COUNCIL COMPENSATION COMMITTEE RECOMMENDATIONS RECOMMENDATION: As recommended by the Council Compensation Committee: 1. Adopt a Resolution entitled “A Resolution of the City Council of the City of San Luis Obispo, California, setting new salaries for the Mayor and Council Members,” increasing compensation to $1,500 per month for Mayor and $1,200 per month for Council Members and providing for an option to opt out of medical, dental, and vision coverage so that the individual member will receive the opt out amount equal to City department heads, effective the first full payroll period in January 2015. 2. Adopt a Resolution entitled “A Resolution of the City Council of the City of San Luis Obispo, California, increasing compensation for Architectural Review Commission and Planning Commission Members” from $50 to $60 per meeting, not to exceed $240 per month, effective July 1, 2014. DISCUSSION Background The City of San Luis Obispo's Charter (Section 410) requires that a Council Compensation Committee be formed during even numbered years to review the Mayor's and Council Members' compensation. Recommended adjustments would then become effective the following January for the next two-year period. Additionally, in 2001 Council adopted Resolution No. 9189, directing a review of compensation for Architectural Review Commissioners and Planning Commissioners in conjunction with its periodic review of Council compensation, as set forth in the Council Policies and Procedures. On November 5, 2013, Council appointed the following five members to the Council Compensation Committee: former elected official John Ewan, Personnel Board representative Marcia Nelson, and citizens-at-large Amy Kardel, Gordon Mullin, and Ken Tasseff. The 2006 Council Compensation Committee recommended the monthly compensation for the Mayor and Council Members be increased by $100 per month. No further changes were recommended at that time. Council concurred and approved the increase effective January 1, 2007, setting the Mayor’s salary at $1,200 per month and the Council Members’ at $1,000 per month. Prior to the 2007 increase, Council’s compensation had not been increased since 2000. Meeting Date Item Number 04-15-2014 B7 - 1 The 2008 Council Compensation Committee concurred that it is important that small incremental increases should be made during each two-year review. Members, therefore, recommend a 3% increase per year based on the approximate 3% Consumer Price Index (CPI) over recent years, for a total increase of 6%. This equaled a $60 monthly increase for each Council Member and $72 monthly increase for the Mayor, effective January 1, 2009. On September 30, 2008, Council considered short-term actions to rebalance the Fiscal Year 2008-09 Budget and determined to rescind the Council’s prior action to increase its salary. In 2010 and 2012 Council determined to defer the entire process for appointing a Council Compensation Committee. Committee Meetings and Review This committee met on November 21, December 16, February 24, and concluded its business on March 17, 2014 and said meeting minutes are Attachment 1. Members reviewed the full Council compensation package including salary, benefits, expense reimbursement, professional development allowances and other compensation provided. In addition, the Committee compared the Council's compensation package with that of Mayors and Council Members in nine other cities (Charter and General Law). As part of the review, the Committee also examined survey results of what the same cities are paying their Planning Commission and Architectural (or Design) Review Committees, if applicable. In addition, the Committee developed and considered a questionnaire for past members of City Council, Architectural Review Commission, and Planning Commission (Attachment 2). Planning Commissioners and Architectural Review Commissioners The compensation for Architectural Review Commissioners and Planning Commissioners was increased in 2001 from $25 to $50 per meeting, with a maximum not to exceed $200 per month. The surveys conducted in 2004, 2006, and 2008 indicated that the stipends paid by the City had remained competitive and the Council Compensation Committee did not recommend an increase at that time. The 2014 Council Compensation Committee has recommended that Architectural Review Commission and Planning Commission compensation be increased from $50 to $60, not to exceed $240 per month, in recognition of the time commitment and dedication required to serve on said committees. FISCAL IMPACTS The monthly salaries of the Mayor and Council Members would be increased from $1,200 to $1,500 and $1,000 to $1,200 per month, respectively. This increase to salaries will increase the Council’s annual budget for Fiscal Year 2014-15 by $6,600 and $13,200 annually thereafter. The opt out option for medical, dental, and vision would result in a net saving, as opt out compensation is lower than cafeteria plan contributions. The compensation package for expenses and professional development would remain unchanged. The increase to compensation for the Architectural Review Commission and Planning Commission from $50 to $60 per meeting, not to exceed $240 per month, would result in an increase not to exceed $3,360 annually. APPROVAL OF MINUTES MOTION BY COMMITTEE MEMBER KARDEL, SECOND BY COMMITTEE MEMBER MULLIN CARRIED 5-0, to approve the Council Compensation Committee Minutes of February 24, 2014. DISCUSSION OF CITY COUNCIL, PLANNING COMMISSION, AND ARCHITECTURAL REVIEW COMMISSION COMPENSATION AND BENEFITS The Committee evaluated and discussed the City Council, Planning Commission and Architectural Review Commission’s compensation and benefits data from the Council Compensation Survey 2014: Mayor and City Council Compensation and Benefits survey. B7 - 10 Council Compensation Committee Minutes – March 17, 2014 Page 2 Council Compensation Committee discussion ensued relative to: 1) whether Council should be compensated equivalent to a Full-Time Employee (FTE) position; 2) whether increased compensation would provide greater opportunity for the ‘average’ citizen to participate on the Council; 3) whether providing an opt out option for medical coverage would create more equitability among members; and 4) whether there is a correlation between increasing compensation and achieving compensation philosophy objectives (e.g. does increasing compensation result in better outcomes for the community). Following discussion, MOTION BY COMMITTEE MEMBER NELSON, SECOND BY COMMITTEE MEMBER KARDEL, CARRIED 4-1, (COMMITTEE MEMBER MULLIN VOTING NO), to increase the monthly salary for Mayor to $1500 per month and Council to $1200 per month. MOTION BY COMMITTEE MEMBER NELSON, SECOND BY COMMITTEE MEMBER KARDEL, CARRIED 5-0, to provide an option to opt out of medical, dental, and vision coverage so that the individual member will receive the opt out amount equal to City department heads. Architectural Review Commission and Planning Commission Committee discussion ensued relative to: 1) whether commission compensation should be increased due to median compensation being comparable to other cities; 2) whether commissioners should be compensated for serving on other advisory committees such as the Land Use and Circulation Element Task Force and Tree Committee; and 3) whether increasing commission compensation would incentivize the calling of special meetings. MOTION BY COMMITTEE MEMBER KARDEL, SECOND BY COMMITTEE MEMBER MULLIN, CARRIED 5-0, to increase the compensation for the Planning Commission to $60 per meeting with a maximum of $240 per month. (2014 Series) A RESOLUTION OF THE CITY COUNCIL OF THE CITY OF SAN LUIS OBISPO, CALIFORNIA, SETTING NEW SALARIES FOR THE MAYOR AND COUNCIL MEMBERS WHEREAS, Charter Section 410 provides for compensation and reimbursement of expenses for the Mayor and Council Members and establishes a procedure for a biennial review by a five-member Council Compensation Committee; and WHEREAS, a five-member Council Compensation Committee was appointed and has met and reviewed Mayor and Council Member compensation in accordance with the procedure provided by the Charter; and WHEREAS, the Council Compensation Committee has determined that the present criteria for compensation remain valid. However, an adjustment is now appropriate particularly in light of the significant demands associated with the official duties of the Mayor and Council Members. NOW, THEREFORE, BE IT RESOLVED, by the City Council of the City of San Luis Obispo as follows: Section 1, Chapter 2.1 of the Council Policies and Procedures shall be amended to read as follows: Effective the first full payroll period in January 2015, compensation for services rendered in an official capacity shall be provided as follows: Mayor and Members of the City Council shall receive a monthly salary of $1,500 per month for the Mayor and $1,200 per month for the Council Members. Section 2, Chapter 2.2 of the Council Policies and Procedures shall be amended to read as follows: The Mayor and Council Members shall be entitled to City-funded participation in P.E.R.S. retirement. The City shall contribute an amount equivalent to that received by City department heads monthly towards the Mayor and Council Members participation in PEMCHA, dental, vision and life insurance. Any unexpended amount shall not be distributed to the Mayor and Council Members in cash. If the Mayor and Council Members elect to opt out of medical, dental, and vision that individual member will receive the opt out amount equal to City department heads.
