SUBJECT: ITEM 4A – 830 ORCUTT ROAD (USE-0680-2022)
Staff received a question from a Commissioner regarding the open space area that is
associated with the Planning Commission’s original approval of the mixed-use
development on December 9, 2020 (ARCH-0764-2019, AFFH-0210-2020, and USE-
0209-2020).
As described in the staff report for and discussed during the preceding hearing, an open
space area, consisting of a common bench and seats located in the courtyard between
Buildings C and D, would be made available as a site amenity for shared use by residents
and patrons of the development. This site amenity was inadvertently not included in the
original set of approved plans, which also did not carry over to plans submitted for the
hotel use permit application. As such, the site plan for the use permit has been revised to
clearly incorporate the common outdoor bench and seats (Attachment A).
Since the common seating area will be available as an outdoor amenity for use by hotel
guests, staff is issuing the following correction to the Noise section on pages 3-4 of the
staff report:
Chapter 9.12 (Noise Control) requires all activities operate in complian ce with
defined noise levels and in a manner that does not constitute a public nuisance.
The project is a small-scale operation consisting of three (3) guest suites that are
less than 500 square feet each, does not include outdoor amenities, is prohibited
from having amplified sounds outdoors, and is subject to compliance with noise
requirements in this preceding chapter (Condition No. 4). As conditioned, the hotel
would not result in adverse impacts related to noise.
Staff’s analysis and recommendation re garding noise remains unchanged because the
project is limited to three (3) guest suites and the outdoor seating area is small in scale.
To address potential noise impacts related to use of the outdoor seating area by hotel
guests, the project is prohibited from having amplified sounds outdoors (Condition No. 4)
and is subject to compliance with noise requirements in Chapter 9.12 (Noise Control).
