City of San Luis Obispo, Council Memorandum City of San Luis Obispo Council Agenda Correspondence DATE: March 7, 2023 TO: Mayor and Council FROM: Matt Horn, Public Works Director VIA: Derek Johnson, City Manager SUBJECT: ITEM 6D - AWARD NORTH CHORRO NEIGHBORHOOD GREENWAY STAFF AGENDA CORRESPONDENCE The purpose of this agenda correspondence is to provide the Council with an update following the Revenue Enhancement Oversight Commission (REOC) meeting on March 1, 2023, as well as provide a response and clarification to questions received in regard to the North Chorro Neighborhood Greenway project. Revenue Enhancement Oversight Commission (REOC) March 1, 2023 Meeting On March 1, 2023, City staff requested that the Revenue Enhancement Oversight Commission (REOC) consider making a recommendation to the City Council for the use $1.6 million of unassigned Local Revenue Measure (LRM) funds to be allocated to the North Chorro Neighborhood Greenway Project. REOC voted 2-1-1 (with one Member recused) against staff’s recommendation (Reference Attachment A – Draft Minutes from REOC March 1, 2023 Meeting). Local Revenue Measure (LRM) On November 2020, a ballot measure was passed by voters approving a general use tax to protect and maintain essential services and facilities. The ballot language included an illustrative list of general municipal purposes to which the revenue may be directed, as follows: To protect City of San Luis Obispo’s financial stability; maintain fire/community safety, health emergency/disaster preparedness; protect creeks from pollution; address homelessness; keep public areas clean/ safe; retain local businesses; maintain youth/senior services, streets, open space/natural areas, and other general services. Item 6d: Award North Chorro Neighborhood Greenway Staff Agenda Correspondence Page 2 Purpose and Purview of Revenue Enhancement Oversight Commission (REOC) The REOC was established to provide transparency and maximize City accountability . The purpose of the REOC is to review, report, and make budget recommendations directly to the City Council regarding the revenue and expenditures of the LRM funds1. In making its budget recommendations to the Council, the REOC takes into consideration the input provided by residents and community members, the community identified priorities for the community services and revenue measure, the major city goals established by the City Council, and the amount of LRM revenue available from past fiscal years and projected to be available during the next fiscal year, The REOC is a five-member advisory body. At the March 1, 2023, meeting, only four members were present. Due to a conflict of interest with the subject matter, Commissioner Skapinsky recused himself from this item. Only three commissioners were able to vote on this item and ultimately, the REOC voted 2-1-1 (with Commissioner Skapinsky recused) against staff’s recommendation. The Council is the final decision maker on all budget appropriations and the REOC’s input is advisory and the proposed funding is otherwise consistent both with the ballot language and the LRM priorities established by the REOC which are noted below. Staff Recommendation After careful consideration of the REOC’s recommendation, and related public input, City staff’s recommendation remains the same, that the City Council appropriate $1,600,000 in undesignated Local Revenue Measure fund balance to the project. Previously, the REOC supported $1.2 million of Local Revenue Measure funding towards to the project. The North Chorro Neighborhood Greenway supports the Climate Action, Open Space, and Sustainable Transportation Major City Goals and is identified as a Tier 1 Project in the City’s Active Transportation Plan and is the product of years of public input, Council deliberation, and planning. The requested use of Local Revenue Measure funding is consistent with the following LRM ballot measure language: 1 Municipal Code Section 2.14.010 The revenue enhancement oversight commission (REOC) is hereby established to review, report, and make recommendations regarding the use of revenues collected through the city’s voter-approved general purpose, one and one-half percent sales tax authorized by Chapter 3.15. The REOC is authorized to review these tax revenues and expenditures, report on the city’s stewardship of this general purpose tax and provide recommendations directly to the city council regarding expenditures of these tax revenues as an integral part of the budget process. The establishment of the REOC s hall be effective upon voter approval of a revenue enhancement measure to be proposed in November 2020 and shall continue in existence as long as Chapter 3.15 , adopted by such measure, is in effect. (Ord. 1688 § 1, 2020; Ord. 1605 § 1 (part), 2014) Item 6d: Award North Chorro Neighborhood Greenway Staff Agenda Correspondence Page 3 1. Maintain community safety and keep public areas clean/safe: The project includes protected bike lanes and sidewalk repairs along the corridor to enhance pedestrian accessibility and safety, as well as cleaning debris and trash at the Chorro/Highway 101 underpass and installing new safety lighting and public art to increase comfort and safety for all roadway users, particularly those most vulnerable. 2. Maintain streets: The project includes necessary street maintenance (slurry sealing and roadway reconstruction), as well as curb ramp upgrades to enhance ADA and pedestrian accessibility, and new striping. 3. Protect creeks from pollution: The project includes storm water management features including bioretention, a bioswale, and storm drain inlet filters) that will help to replicate natural water systems to capture and filter/infiltrate stormwater before it reaches Stenner and Old Garden Creeks. Additionally, the project includes the replacement of a storm drainage facility at Chorro and Mill Street. 4. Maintain natural areas: The project includes 63 newly planted trees, which will fill the gaps in the mature canopy and enhance existing green spaces and streetscapes, helping the City meet its Climate Action goal of 10,000 new trees by 2035. It is important to note, that the current budget (previously approved by Council and REOC) for the North Chorro Neighborhood Greenway project include s LRM funds in the amount of $2M. Grant Stipulations The City received $1.7M in Urban Greening Grant (UGG) funds from the California Natural Resources Agency (CNRA) to fund elements of the project that will result in a reduction of Green House Gas (GHG) emissions. Specifically, the items eligible for grant reimbursement include site preparation for and related to all greening elements, including new trees, landscaping and stormwater management facilities, and all work associated with constructing the bicycle facilities (class I, II, III and IV). Project elements specifically NOT eligible for reimbursement through the grant are curb ramps, sidewalks, crosswalk improvements and public art/enhancements to the Chorro /Hwy 101 undercrossing. The agreement in place between the CNRA and the City identifies a Project Performance Period ending 3/1/2024. This date can, however, be amended with grant agency approval, but cannot extend past 3/1/2026. While minor adjustments to the grant scope are appropriate, major changes or reductions to project scope require approval by the grant agency and could jeopardize some o r all of the grant funding. The City also received a $200,000 Safe Routes to Schools (SRTS) Grant from SLOCOG, which contributes funds to the shared-use path connecting Ramona and Foothill Boulevard through an easement within the LDS Church property. Un less otherwise approved by SLOCOG, construction of the improvements must begin before the end of Fiscal Year 2022/23 in order to retain this grant funding. Item 6d: Award North Chorro Neighborhood Greenway Staff Agenda Correspondence Page 4 Estimated Savings to Remove Bikeway Features from “Middle” Segment During the project’s planning phase, several design alternatives were considered for the challenging “middle” segment of the greenway route between Lincoln Street and Ramona Drive. In addition to the protected bike lane alternative adopted by the City Council, which required partial removal of street parking, another alternative (“The Lincoln Street Alternative”) was previously considered as an option to retain existing street parking. This alternative included retaining a shared street design (bikes and autos share travel lanes) with traffic calming, guide signage, and pavement markings directing cyclists to follow a route utilizing Lincoln Street, Mission Street, and Broad Street through this “middle” segment. Staff has received questions from a few stakeholders asking how much the current project cost would be reduced if staff either (a) removed all bikeway elements from this “middle” segment, or (b) revisited the Lincoln Street Alternative. Without a detailed design for the Lincoln Street Alternative, it is difficult to provide a detai led cost estimate for that option. However, if all bicycle -related features included in the current construction plans along the “middle” segment of the route were removed from the project scope, including bike lane markings, signage, medians and planter b oxes, the total construction cost would be reduced by approximately $300 -500k. While this may appear as a savings, the bicycle facilities are directly funded by the Urban Greening Grant funds. Thus, removal of these features would reduce project costs by $300K-$500K but could also result in a loss of $1.7M in grant funds. Existing Roadway Users Staff has received questions from a few residents about level of bicycle and pedestrian travel along the proposed greenway route. For reference, the following table summarizes the daily traffic volumes by mode recorded in spring of 2022. (Bike and pedestrian counts are typically collected via video recorded over two consecutive days.) Reference Attachment B for the detailed data collection sheets. Several questions and public inquires followed the placement of video cameras. Additionally, this is consistent with the Performance Monitoring Program outlined in the Anholm Bikeway Plan which will also include data collection at 12- and 24-months post construction. These reports will be presented to the City Council as well as available to the public to monitor the impact of the improvements and whether they have created the outcomes and changes that promote a safer transportation corridor. Item 6d: Award North Chorro Neighborhood Greenway Staff Agenda Correspondence Page 5 Additional Alternatives Should the City Council decide not to appropriate the requested $1.6M Local Revenue Measure funding, the following alternatives are available: 1. The City Council could approve the request to award the project, but instead of using LRM funding, could utilize $1.6M from the Infrastructure Investment Fund. Staff does not recommend this alternative because the Infrastructure Investment Fund would need to be backfilled with the 2023-25 Financial Plan. 2. The City Council could direct staff to include a budget request for the $1.6M in the 2023-25 Financial Plan. Staff does not recommend this alternative. Though Council could still award the contract now, the project would not be fully funded unless additional funding is appropriated with the 2023-25 Financial Plan. This alternative would put the project at risk if sufficient funding is ultimately not appropriated, requiring contract termination and resulting in unfinished work, as well as jeopardizing $1.9M in grant funding, which would require repayment. 3. The City Council could direct staff to revise the project plans and rebid the project with the goal of reducing project cost. Staff does not recommend this alternative as it will likely take approximately nine months to complete this work, incur additional staff and consultant costs to fund the plan revisions and redirection of staff time from other program work, reduce the value of the funding that is currently appropriated to this project due to inflation and the fluctuating cost of construction environment. This alternative could also risk the $1.7M in grant funding, as the Urban Greening Grant specifically funds over $900k of the greening elements (trees, landscaping and stormwater management facilities), which would likely be the areas first reviewed to decrease project costs.
