Sandercock for a variance or variation of use at 1750 �170 Beach Street Gentlemen: 1'he undersigned is the owner of the property and premises located at 1750 Beach Street in the City of San Luis Obispo. The area in which this property is located is an R-2 District under the provisions of the Zoning Ordinance of the City of San Luis Obispo. However, the use of this property has been for many years a non -conforming use. Both prior to and since the passage of the Zoning Ordinance it has been used for truck and commercial storage and truck repair. The lease of the most recent tenant of the premises has expired and the prospective tenant has been denied a business license. The building on the premises is a wooden structure on a concrete floor and foundation covering an area seventy (70) feet by fifty (50) feet. It is entirely unsuited and unadaptable to residential purposes and hence, as matters stand, must either remain vacant or be demolished. Without prejudice to any other remedy which he may have the undersigned respectfully requests that the Council grant a variation of use to permit the use of these premises for the purposes of truck and commercial storage and/or auto repair. Assuming that the information provided in the report is accurate and representative of existing conditions, it has been determined that no additional sampling or'cleanup will be required for this site by the City Fire Department. It should be noted that this letter does not relieve the property owner of any responsibilities mandated under the California Health & Safety Code if existing, additional or previously unidentified soil and or groundwater contamination is discovered. Two underground storage tanks (USTs) were removed from this site and hydrocarbon contaminated soil was remediated on -site. One of the two USTs was partially abandoned in place on the neighboring property at 478 High Street, due to the tank's proximity to the foundation of the building at 478 High Street. This law requires every local jurisdiction in Seismic Zone 4 to create a list of "potentially hazardous buildings" that identifies certain buildings which contain walls constructed of brick or other masonry materials, built before earthquake resistant codes were enforced, and which do not have steel bars embedded in the walls. Such buildings, commonly called "unreinforced masonry buildings", may not withstand earthquakes well, and they have caused many injuries and deaths in large earthquakes. The State has encouraged jurisdictions to enact local ordinances or other mitigation programs to reduce the hazard posed by these buildings. The City of San Luis Obispo is in the process of developing a mitigation program/ordinance that may require strengthening of unreinforced masonry buildings. It is expected that an ordinance will be in effect by March 1990. However, public hearings will be held before this goes into effect, and the City intends to update all affected property owners during the process. The City of San Luis Obispo has completed the identification task, and has compiled a list of approximately 140 buildings believed to be of unreinforced masonry construction. The building referenced above is on this list. Before this list of "potentially hazardous buildings" is finalized, the Building and Safety Division wants to be sure the list is accurate. If you believe that your building is not an unreinforced masonry building, or the building is an unreinforced masonry building that does not need strengthening or has already been strengthened against earthquakes during past renovation work, please check the appropriate box on the attached form, and return it within 10 days of the date of this letter. Include information to support your opinion. You may schedule an appointment to bring supporting documents, plans, etc. to this office for review and a determination.
