Before applying for your business license or making
significant business commitments, talk to one of our plan-
ners in the Community Development Department. They

also comply with all city, county and state regulations.
This includes laws pertaining to zoning, building, health
and safety.

Attach The Business License Supplement
In addition to the Business License Application, fill out
the Business License Supplement form and attach it to
your completed application. The supplement is used to
insure that your business meets city planning require-
ments and that necessary permits have been applied for.
Pay The Fees
The completed Business License Application and the
attached Business License Supplement should be return-
ed to the City's Finance Department. The cashier's win-
dow is open weekdays from 8:0,0 am to 5:00 pm.
Business license fe6s are determined by the type and
location of your business. If you submit your application
in person, your fees will be paid at that time. Your
business license certificate will be mailed to you.
If necessary, you may mail us your completed applica-
tion and supplement. However, it may take longer to get
your business license due to the additional paperwork and
mailing time.
If other permits are required (such as a use permit,
sign permit or health permit), you must deal directly with
the appropriate department or agency. The Finance
Department only collects fees and issues your business
license tax certificate.
What Happens Next?
Your business license is valid as long as there are no
significant changes to your business. You must notify us
if there are any changes to your business mailing
address, location, ownership, or types of goods or ser-
vices you offet.-

Dear Mr. Bergantz,
Thank you for calling November 7 to explain your viewpoint about your contractor's yard.
I have reviewed our files again, and am enclosing copies of letters sent to you
previously. The letters confirm what I said to you on the telephone - that a
contractor's yard was not legally established prior to your occupation of the lot. The
lot may have been used as a contractor's yard, but according to our files, this use was
never approved by the city.
You said that you had not received any previous letters from the city, informing you that
a contractor's yard use illegal at 1750 Beach Street. Our records do not show either of
the letters sent previously to have been returned. In fact, the handwritten notes at the
bottom of the 1980 letter indicate that the planner who wrote the letter spoke to you at
that time.
If you believe our information is in error, you must submit evidence that the use of the
site as a contractor's yard was legally established. Verifying that the use existed is
not enough by itself, unless you can show that it was a contractor's yard at a time when
the zoning allowed contractor's yards. Our files show the site zoned R-2 back to at
least 1954. Contractor's yards are not, and never have been, allowed in the R-2 zone.
Therefore, I must again ask that you convert the use to one that has been legally
established - a warehouse, with no outdoor storage. The water tank must be removed along
with all stored materials. We will reinspect the site within thirty days to verify
progress. Conversion should be complete by January 31, 1989.

SUBJECT: Code violation at 1750 Beach Street
Dear Mr. Bergantz,
When you obtained your business license in 1980, it was for storage of drywall only, and
no outdoor storage was allowed. Your business is in an R-2 zone, and is therefore
nonconforming. Any expansion to the use is prohibited.
On several occasions, we have informed you that expanding the storage use is not
permitted, yet when I inspected the site recently I found several trucks, people, and a
significant amount of outdoor storage. A new building was apparently added in 1986, and
there is even a water tank on the premises that appears to be a hazard to nearby
buildings.
You must eliminate all of the outdoor storage and convert the use to indoor storage of
drywall only. We will reinspect the site within thirty days. If no progress has been
made toward converting the business to its legal nonconforming status, we may be forced
to pursue legal action.

We are reviewing your business license application for Bergantz Construction
and Drywall at 1750 Beach Street.
The proposed location for your business is zoned R-2 (Medium -Density Residential).
Local zoning regulations don't allow this type of business in an R-2 zone unless
you operate a business which is similar or more restrictive in nature than the
business previously operating at this location.
Recently, I spoke with the owner of this property and he told me this building
was previously leased to contractors. However, we have no record of a contractor's
business license issued to this address during the past three years.
Unless you can document that the previous tenants operated a lawful use at this
location we can't complete processing your application. We suggest you find a` -

suitable location for your business in a C-H or M zone. If you begin operation
of your business at this location you will be in violation of Municipal Code
Sections 9200.25 and 9200.6A.

Dear Business Owner:
On February 7, 1986, Community Development Department staff inspected property
you occupy at 1750 Beach Street. Staff noted that an addition to the existing
structure is being constructed and the business operation are expanding.
Please be aware that the situation described above does not meet Zoning and
building code ordinance regulations, and appears to violate San Luis Obispo
Municipal Code Section(s) 17.10.010.
We request that you take action to comply with these ordinance requirements by
removing the addition or relocating to a zone where this type of use is
allowed.
Your property will be reinspected in 15 days to determine if further
enforcement action is necessary.

NONCONFORMING USES

17.10.010 Intent.

A nonconforming use is one which was
legally established on the effective date of appli-
cable sections of these regulations but which is
not now an allowed or conditionally allowed use
in the zone in which it is located. The intent of
these regulations is to prevent the expansion of
nonconforming uses, establish the circum-
stances under which they may be continued,
and provide for their removal or change to a
conforming use as soon as practical. (Ord. 941 §
1 (part), 1982: prior code § 9202.2(A))
17.10.020 Regulations.
A. Change of ownership, tenancy or manage-
ment of nonconforming use shall not affect its
legal, nonconforming status.
B. A nonconforming use may be continued
and a nonconforming use may be changed to
another nonconforming use provided:
I. A nonconforming use which ceases for a
continuous period of six months shall lose its
nonconforming status and the premises on
which the nonconforming use was located shall
from then on be used for conforming uses.
2. A nonconforming use may be repraced
with another: provided, that an administrative
use permit is approved by the director. The
director must find that the new use has similar
or less severe impacts on its surroundings in
terms of noise, traffic, parking demand, hours of
operation and visual incompatibility. The appli-
cant shall submit evidence of the date when the
original nonconforming use was established.
C. A lot occupied by a nonconforming use
may be further developed by the addition of
conforming uses and structures, provided an
administrative use permit is approved. (See Sec-
tions 17.58.020 through 17.58.080.) (Ord. 941 §

A lot having less area, width, depth or front-
age than required by the subdivision
regulations, as set forth in Title 16 of this code,
for the zone in which it is located, but which was
lawfully created prior to the effective date of
regulations requiring such greater area or
dimension, shall be considered a nonconform-
ing lot. These regulations are intended to pro-
vide for the reasonable use of such
nonconforming lots, consistent with other stan-
dards adopted to protect the public health.

common ownership with any contiguous prop-
erty at any time since November 18, 1977, it

forming parcels or one parcel which more nearly
conforms.

SUBJECT: Code violation at 1750 Beach Street
Dear Mr. Bcrgantz,
When you obtained your business license in 1980, it was for storage of drywall only, and
no outdoor storage was allowed. Your business is in an R-2 zone, and is therefore
nonconforming. Any expansion to the use is prohibited.
On several occasions, we have informed you that expanding the storage use is not
permitted, yet when I inspected the site recently I found several trucks, people, and a
significant amount of outdoor storage. A new building was apparently added in 1986, and
there is even a water tank on the premises that appears to be a hazard to nearby
buildings.
You must eliminate all of the outdoor storage and convert the use to indoor storage of
drywall only. We will reinspect the site within thirty days. If no progress has been
made toward converting the business to its legal nonconforming status, we may be forced
to pursue legal action.

Dear Business Owner:
On February 7, 1986, Community Development Department staff inspected property
you occupy at 1750 Beach Street. Staff noted that an addition to the existing
structure is being constructed and the business operation are expanding.
Please be aware that the situation described above does not meet Zoning and
building code ordinance regulations, and appears to violate San Luis Obispo
Municipal Code Section(s) 17.10.010.
We request that you take action to comply with these ordinance requirements by
removing the addition or relocating to a zone where this type of use is
allowed.
Your property will be reinspected in 15 days to determine if further
enforcement action is necessary.

NONCONFORMING USES

17.10.010 Intent.
A nonconforming use is one which was
legally established on the effective date of appli-
cable sections of these regulations but which is
not now an allowed or conditionally allowed use
in the zone in which it is located. The intent of
these regulations is to prevent the expansion of
nonconforming uses, establish the circum-
stances under which they may be continued,
and provide for their removal or change to a
conforming use as soon as practical. (Ord. 941 §
I (part), 1982: prior code § 9202.2(A))
17.10.020 Regulations.
A. Change of ownership, tenancy or manage-
ment of a nonconforming use shall not affect its
legal, nonconforming status.
B. A nonconforming use may be continued
and a nonconforming use may be changed to
another nonconforming use provided:
I. A nonconforming use which ceases for a
continuous period of six months shall lose its
nonconforming status and the premises on
which the nonconforming use was located shall
from then on be used for conforming uses.
2. A nonconforming use may be replaced
with another; provided, that an administrative
use permit is approved by the director. The
director must find that the new use has similar
or less severe impacts on its surroundings in
terms of noise, traffic, parking demand, hours of
operation and visual incompatibility. The appli-
cant shall submit evidence of the date when the
original nonconforming use was established.
C. A lot occupied by a nonconforming use
may be further developed by the addition of
conforming uses and structures, provided an
administrative use permit is approved. (See Sec-
tions 17.58.020 through 17.58.080.) (Ord. 941 §

A lot having less area, width, depth or front-
age than required by the subdivision
regulations, as set forth in Title 16 of this code,
for the zone in which it is located, but which was
lawfully created prior to the effective date of
regulations requiring such greater area or
dimension, shall be considered a nonconform-
ing lot. These regulations are intended to pro-
vide for the reasonable use of such
nonconforming lots, consistent with other stan-
dards adopted to protect the public health,
safety and general welfare. (Ord. 941 § I (part),
1982: prior code § 9202.3(A))
17.12.020 Regulations.
A. If a nonconforming lot has been held in
common ownership with any contiguous prop-
erty at any time since November 18, 1977, it
may not be individually developed. The area
within such a lot may be developed only after it
has been merged with contiguous property, or
otherwise resubdivided in conjunction with the
contiguous property to create one or more con-
forming parcels orone parcel which more nearly
conforms.
The merger or resubdivision requirement set
forth in the first paragraph of this subsection
shall not apply to a nonconforming lot and con-
tiguous commonly owned property where each

Local zoning regulations don't allow 'this type of business in an R-2 zone unless

Recently, I spoke with the owner of this property and he told me this building
was previously leased to contractors. However, we have no record of a contractor's
business license issued to this address during the past three years.
Unless you can document that the previous tenants operated a lawful use at this
location we can't complete processing your application. We suggest you find a
suitable location for your business in a C-H or M zone. If you begin operation
of your business at this location you will be in violation of Municipal Code
Sections 9200.25 and 9200.6A.
