Pursuant toourrights under the California Public Records Act (Government CodeSection 6250et seq.), werequest thefollowing records related to litigation or thethreatthereof under theCalifornia Voting Right Act. Specifically, this request seeks: Any and all research reports, city council reports, demographic studies or analyses, meeting minutes or agendas, email communications, and court filings related to litigation or the threat thereof under the California Voting Rights Act. Any and all records showing expenditures related to litigation or the threat thereof under the California Voting Right Act. This includes any receipts, invoices, requests for attorney’s fees, and agreements with demographers. This request reasonably describes identifiable public records orinformation produced therefrom, andwebelieve that there exists noexpress provision oflawexempting such records from disclosure. Accordingly, pursuant to Government Code section 6253(b), weask that youmake therecords “promptly available forinspection.” Iwould bewilling toadjust theparameters of thisrequest inorder toaidin itsfulfillment, andsoas nottounduly burden your office. Inthat spirit, Iwould also liketorequest aconversation with asubject matter expert whocanhelp mebetter understand howrelevant records aredistributed and stored. Ibelieve such aconversation isrequired bytheCalifornia Public Records Act, section 6253.1(a) of whichstates that agencies “shall” assistmembers of thepublic “makeafocused andeffective request that reasonably describes anidentifiable record or records, shall doallof thefollowing, totheextent reasonable under thecircumstances: (1) Assist themember of thepublic toidentify records andinformation that are responsive totherequest ortothe purpose oftherequest, ifstated. (2) Describe theinformation technology andphysical location in whichtherecords exist. (3) Provide suggestions for overcoming anypractical basisfordenying access tothe records orinformation sought.” Ifthereareanyfees for searching or copying theserecords, please inform usifthecost willexceed $50. However, we would also like torequest awaiver ofallfees inthat thedisclosure oftherequested information isinthepublic interest. 1 The California Public Records Act requires aresponse within tenbusiness days. Ifaccess totherecords we are requesting willtake longer, please contact mewith information about when wemight expect therequested records. Please release records onarolling basis.
