This offer is made to you under the following terms and conditions: 1. Your starting salary will be $7,904 biweekly or $205,504 on an annualized basis. The biweekly salary range for Police Chief is currently $6,519 to $8,149. 2. You will be afforded all of the benefits available to the City's department heads as set by resolution. The current benefits are listed in the attached Resolution No. 11004 (2019 Series). Some of these benefits include: Participation in the Public Employee's Retirement System (PERS) with a 2.7% at age 57 formula. The Public Employees' Pension Reform Act (PEPRA) set limitations on retirement benefits in California, and you and the City are subject to those limits. The limits include a cap on pensionable compensation (currently 153,671) and the requirement that you pay half of the normal cost (currently 13.75%) and an additional 3% cost -sharing to PERS for the amount up to the pensionable compensation limits. The attached "Local Safety Benefits" describes in detail more about this pension benefit. The City participates only in the Medicare portion of FICA, so there is no 6% deduction for Social Security. Enrollment in the City's 401(a) supplemental retirement plan, with the City contributing 1 % of your salary (subject to limitations under PEPRA) and the option for you to contribute up to the IRS maximum upon amendment of the PARS plan. Time off benefits include a bank of 80 hours of administrative leave each year prorated based on your hire date), 15 days of vacation, 12 days of sick leave, and 13 paid holidays annually prorated based on your start date. You are also immediately upon hire eligible for catastrophic leave in the event you have exhausted your paid time off and suffer from a life -threatening or debilitating illness, injury, or condition. The City will contribute the following monthly towards your health plan benefits: 593 for employee only, $1,173 for employee + 1, and $1,588 for family coverage. If you decide to opt -out of the City's medical insurance, you will receive $200 monthly with proof of medical coverage. Benefits coverage will be effective on the first of the month following the date you complete your benefits enrollment. The City pays for a $100,000 life insurance policy. 3. Your first paycheck will include an advance of your annual uniform allowance of $1,000 for the initial purchase of your uniform. Annually, you will receive a uniform allowance split into two payments on the first payday in June and December. 4. You will be assigned the Police Chiefs car for unrestricted business use. This assignment comes with the understanding that you shall be allowed limited personal use within San Luis Obispo County to monitor and use the Police/Emergency service radio and other personal use as approved in advance by the City Manager, excluding vacation and recreation trips. 5. The City will provide you with reimbursement of relocation expenses up to $15,000 to assist you in relocating to San Luis Obispo County. This benefit may be taxed under IRS guidelines depending upon how you use it. It is my hope that you will make a good faith effort to relocate within the City limits of San Luis Obispo with an understanding that there is no legal requirement to live within the City limits. If you voluntarily leave the City within three years of your hire date, you will be responsible for reimbursing the City a prorated amount of the transitional expenses based on your months of service with the City (e.g., if you voluntarily leave after 18 months with the City, you will owe the City up to $7,500). If you are terminated within this period, there is no requirement to pay any amount. 6. The Police Department's budget contains funding for your professional activities and expenses, including membership in the California Police Chiefs Association, the California Peace Officers' Association, and the International Association of Chiefs of Police. The department currently budgets for the expenses associated with attendance at the annual California Police Chiefs Association conference. Attendance will require my approval and will be granted as long as the financial resources are available and that other pressing City business does not take precedence. 7. You will be provided access to the City -paid California Peace Officers' Association (CPOA) Legal Services Program (LSP) for legal defense services for the Police Chief. 8. Your start date is May 13, 2021. 9. Within the first few weeks after your start date, you and I will collaboratively establish a Professional Development Plan and your goals and objectives for 2021-22. These goals and objectives will then serve as the basis for your evaluation in April 2022, when you may be eligible for a Pay for Performance increase. 10. Your employment with the City is at will. If I determine that your employment with the City as Police Chief should be terminated for reasons other than misconduct, malfeasance, or criminal negligence, I will request authority from the City Council to provide you a severance amount of up to six months' salary to assist you in your transition from the City. Congratulations on obtaining a Basic Course Waiver from California POST that allows you to have peace officer powers in California. Another job requirement of the Police Chief is possession and maintenance of a POST Management certificate. I understand your Texas training may be accepted by POST, and you must obtain the California equivalent within a year of employment. Further, I understand that you have a Texas driver's license and that your ability to obtain a valid California Class "C" driver's license by your start date was delayed both due to COVID and to the tragedy this week and that your license is in progress. It is important for you to obtain that license as soon as possible. 2 Again, let me express my enthusiasm in offering you this position. It is a difficult start for a new Chief, and I am looking forward to working with you to support our employees through their grief and refocus on the necessary public safety work in support of our community.
