The group thought it would be helpful to have a flow chart showing documents/submittals/approvals (flow chart attached). Shute, Mihaly & Weinberger (SMW) will create the first draft conservation easement. (The group agreed that the Open Space Management Plan including funding will be a separate document from the conservation easement. The effort to firm up the land management aspects can wait until the resource agency specifies requirements in the 404, 401 and 1602 permits. Many of the resource agency requirements are typical and can be included in the draft pending resource agency agreement. Placeholders will be inserted into the conservation agreement with intended purpose and details and timing where details are still being determined. This could be in the form of a clause within the document or attachments.) SMW to send a list of information needed to draft easement. List forwarded by Bob Hill on 3/20; information/response from Chevron 3/23 is shown in green: 1.List of Parcels to be encumbered by the easement and if existing parcels will be subdivided or subject to lot line adjustments to align with specific plan designations noting which parcels will be only partially encumbered by the easement)sent 1/30/14 draft Tract Map drawing showing proposed Open Space parcels) 2. If not included in the items above, documents describing the prohibited/required uses related to a)the Airport Reserve Areas B and C;b)the airport facilities runway lights, access road(s),paved pad, other?)that the easement will need to allow as permitted uses; and c)any other airport restrictions we should know about. Please also provide a map or diagram showing the airport facilities.See below) The City should provide prohibited/required uses related to the Airport Reserve Areas. We have the supporting documents for encumbrances listed in the PTR and will attempt to clear those that are no longer valid before property transfer takes place. Let’s discuss the need for any specific documents and we will get them to you. The Tract Map drawing Item 1)shows the easement for the airport runway lights on the property. 5. The Remedial Action Plan the RAP is focused on remediation actions for approval by the RWQCB;a link was sent for the County website posting of the EIR as it provides a more up-to-date,concise,and comprehensive description of the project scope) 6. The Project Execution Plan same as 5) 7. The County’s Final Conditions of Approval,CEQA findings, and mitigation monitoring and reporting program. The Conditions of Approval were sent;a link was sent for the County website posting of the CUP staff report) 8. The City’s MMRP if it differs from the County’s.the City has taken no discretionary action at this point except to certify the EIR) 9. If available,an expanded version of Table 2-19 from the EIR project description listing pending and anticipated permit applications together with contacts for the agencies involved and a summary of the status of the application and expected timing for decision. This may not have been prepared and is not essential, but this or something like it would provide a good overview of where things stand and are headed.it is not clear what information you need, let’s discuss) New Discussion Points: Information Needs - Unrecorded encumbrances/property interests not listed in title report what is needed and by when?)
