Item 1. Use Permit Appl. U 0635. Rod Erb for a warehouse building at 169 Prado Rd.,
C-H-S Zone.
Ken Bruce, the assistant planner, presented the staff analysis saying that the site
is on the north side of Prado Road between South Higuera Street and Elks Lane. It
is a large site, approximately 2.4 acres, with a frontage of 170-feet and a depth of
about 590-feet. The site is adjacent to San Luis Creek, is generally flat, and is
subject to flooding. A city 21-inch sewer trunk main traverses the site in a north -
south direction. He explained that the site is within Area 3 of the San Luis Obispo
County Airport Land Use Plan which allows the proposed use. He also noted the
architectural review commission has approved the project.
Chairperson Schneider declared the public hearing open.
Jay Whisenant, representing the applicant, wanted some clarification of recommended
condition 2.
Ken Bruce explained that the exact location of the sewer trunk main needs to to be
verified in the field by the applicant and the city provided with an accurate, dimen-
sioned plan showing location of the sewer main.
Mr. Whisenant also requested modification of conditions number 8 and 11. Concerning
condition 8, the residential structure is now being used as a refrigerator repair shop.
He asked that if during the course of construction that the use be permitted to remain
until occupancy of the new warehouse building. The occupant of the building makes his
living from the repair shop and he needs the extra three months to relocate. He also
asked if condition 11 could be changed because during the course of construction the
construction crews could be utilized to clean-up the site. He asked that the con-
dition be changed,to read that the site be cleaned -up prior to occupancy,not prior to
issuance of any building permits.
Chairperson Schneider declared the public hearing closed.
Commr. Breska stated that he doesn't agree with condition 10 limiting use of the new
building to warehouse usei. He said this is an unnecessary restriction because of

Commr. Breska asked if the applicant would have to come rack to the City if he wishes
to go to another use on the property.
Dan Smith, senior planner said yes and this is due to a cooperative procedure with
the airport land use commission and its plan.
Ken Bruce explained that there have been many problems over the past 2-3 years con-
cerning the residence listed in condition 8. These were health department and
building department concerns. The building department feels strongly that this con-
dition should read as stated because it is hard to keep people from occupying a
completed building and next to impossible to remove then once they occupy it.
Chairperson Schneider stated we should not ask them to remove the building because
it could be used. Let him leave it and bring it up to code. We need housing in
this city.
Mr. Whisenant pointed out that they are going to remove the building but would like
to remove it prior to occupancy and that the building department could refuse to
issue the occupancy permit until the building was removed.
Dan Smith suggested that the condition could read that a final inspection of the
new building not be given until a demolition permit is taken out, the residence
removed and the site cleaned up.
On motion of Commr. Krause, seconded by Commr. Johansen, Resolution 1159-77 was
adopted, approving the use permit since it will not be detrimental to the health,
safety or welfare of persons living or working in the area and subject to the
following conditions:
1. The proposed warehouse building shall be relocated so that it is a minimum 5-feet
clear of existing sewer trunk main. Site plan revision shall be to the approval
of the community development director.
2. Applicant shall verify exact location of sewer trunk main in the field and pro-
vide as built location drawings to the city engineer.
3. Applicant shall install curb, gutter and sidewalk across entire street frontage
to the approval of the public services department.
4. Applicant shall install street trees to the approval of the public services
department and architectural _review commission.
5. Applicant shall install an on -site fire hydrant to the approval of the fire
department and utilities engineer.
6. Applicant shall install a heat activated fire alarm system throughout the new
warehouse building to the approval of the fire department.
7. The finish floor elevation of new warehouse building shall be at minimum of
136.5 elevation.
8. Applicant shall remove existing residential structure near southwest corner of
site concurrently with construction of warehouse structure. Complete removal
shall take place prior to final inspection on warehouse structure.
9: Applicant shall install fencing, paving, and other site improvements as noted
on site plan submitted with application and shall meet any conditions of approval
set by the architectural review commission prior to occupancy of new warehouse
building.
10. The new warehouse building shall be limited to warehouse uses only. Any other
use shall be approved by the city and county airport land use commission.
11. Applicant shall clean-up site of inoperable vehicles, trailers, boats, lumber,
metal, concrete, etc. to the satisfaction of the community development director
prior to final inspection on warehouse structure.
12. The property shall be maintained in a clean and orderly manner. All plant
materials shall be maintained and replaced as necessary.
